BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 6th day of August, 1991, with the following present: HONORABLE: Evelyn M. Lord Mayor Andrew P. Cokinos Councilman At Large Brian R. Alter Councilman At Large Lulu L. Smith Mayor Pro Tem Councilman, Ward I Guy N. Goodson Councilman, Ward II Audwin Samuel Councilman, Ward III David W. City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend James Blackwell, South Park Baptist Church. The Pledge of Allegiance was led by Kevin Thompson. -000- Mayor Lord presented a City of Beaumont Honorary Citizenship Card to Ulf Zick of Lingen, Germany. Ulf is in Beaumont for three weeks as a Rotary Club sponsored exchange student. He is visiting in the home of Mr. and Mrs. Robert Thompson, 1245 Nottingham Lane, and their son, Kevin, is accompanying Ulf to various points of interest and functions in Southeast Texas to acquaint him with the culture and life in the Southwest United States. In return, Ulf presented Mayor Lord with an pamphlet containing information with economic instructional data about Lingen. He thanked Council for the honor bestowed upon him and extended an invitation to visit his country. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 2 through 5. No one wished to address these items. -000- The following Consent Agenda items were considered: -184- August 6, 1991 Approval of the Minutes of the regular City Council session held July 30, 1991; Resolution No. 91-184 appointing Leo Lemell to the Airport Advisory Committee for a term expiring May 31, 1983 ; Karen McLane to the Beaumont Advisory Commission for Prevention of Child Abuse and Neglect for a term expiring June 30, 1993 ; Allison Golias and Ken Bartos to the Parks and Recreation Advisory Committee for terms expiring June 30, 1993 ; Jakey Dalco to the Transit Advisory Committee for a term expiring June 30, 1993 ; and Lynn Harden to the Electrical Board of Review for a term expiring April 30, 1994 ; and Resolution No. 91-185 amending Resolution No. 89-255 (accepting the donation of Halbouty Park and authorizing filing an application for a grant to develop the park) to incorporate wording now required for a State Land and Water Conservation Grant, i.e. certifying eligibility to receive assistance under these programs; officially designating City Manager as representative to the Texas Parks and Wildlife Department; designating City Manager to officially receive grant funds; and dedicating the Halbouty Neighborhood Park for public outdoor recreation purposes in perpetuity. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- PUBLIC HEARING GRANT APPLICATION FOR BEAUMONT MUNICIPAL TRANSIT SYSTEM PROGRAM OF PROJECTS FOR FISCAL 1992 UNDER SECTION 9 OF THE U.M.T.A. OF 1964 AS AMENDED MR. RAY A. RILEY, CITY MANAGER: With their. . .annually, the City of Beaumont, as many other cities do, ask for, request for grant assistance from the Department of Mass Transit. This requires a public hearing concerning the application for, from the Federal Government for assist, for federal assistance with regarding to all of the funds that are used. Basically speaking for operations, the manner in which we are eligible for the grant, is that of the total revenues from the fare box is applied against the total operating cost, and then the net deficit is split between Local Government and the Federal Government. In this case, we're anticipating next year the local assistance being required would be $700, 000. 00 as part of the grant application, which is a 50-50 match for the deficit in -185- August 6, 1991 order to operate the System. In addition to that, the application also provides for capital projects which is normally an 80-20 pro-rata split between local and federal, with local picking up 20%. There are three projects that are involved in the application this year. One is to renovate the BMT offices at a total cost of $30, 000. 00, which would require a local match of $6, 000. 00; replace the bus stop signs of some 600 that are in dire need of replacement, which would require a local match of $1,400. 00, against a total of $7, 000. 00; and also to purchase two computers for use in the office, a total cost of $8, 000. 00 with the local match being $1, 600. 00. That point then, with this having been posted, and there is a requirement then that we conduct the public hearing to have all interested parties to have an opportunity to comment on the application before Council can consider it formally. MAYOR LORD: With that explanation, at this time I will open the public hearing and ask if any citizen wishes to address our grant application? I would ask again, is there any citizen who would wish to speak to us on the grant application? If not, I will close the public meeting and ask our City Manager to read the ordinance proposed. END OF EXCERPT -000- Mr. Riley read a portion of the resolution: "That the City Manager be, and he is hereby, authorized to file a grant application and execute a grant agreement with the Urban Mass Transportation Administration. " Resolution No. 91-186 authorizing filing a grant application under Section 9 of the Urban Mass Transportation Act of 1964, as amended, for an estimated $736, 000.00 (up to $700,000. 00 for operating costs and $36, 000. 00 for capital outlay) for the Beaumont Municipal Transit System for Fiscal Year 1992, from October 1, 1991, through September 30, 1992, and authorizing execution of a grant agreement with the Urban Mass Transportation System was approved on a motion made by Mayor Pro Tem Smith and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Ordinance No. 91-61 amending Section 28-5 of the Code of Ordinances regulating charter bus service provided by the Beaumont Municipal Transit System by deleting the two references to "regular" and "contract" charter rates to agree with federal regulations and replacing with one category known as "charter service" and increasing the charter -186- August 6, 1991 rate to $40. 00 per hour, with an $80. 00 minimum for up to two hours, was considered: ORDINANCE NO. 91-61 ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY DELETING SECTION 28-5 (7) AND ADDING A NEW SECTION 28-5 (7) ; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Ordinance No. 91-61 was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Smith. Question: Ayes: All Nayes: None -000- Resolution No. 91-187 authorizing purchase of two tractor-loader-backhoe combinations for the Water Utilities Department to be used for trenching in the installation and maintenance of water and sewer lines from Equipment Headquarters in the amount of $61, 350. 00 ($30, 675. 00 each) was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 91-188 authorizing a contract with S & M Builders in the amount of $23,230. 00 for roof replacement on the maintenance hangar at the Municipal Airport with a 24 gauge galvanized roof (guaranteed for 20 years and workmanship guaranteed for one year) , and a provision for supplying any additional deteriorated replacement materials at ten (100) percent above cost was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 91-189 authorizing a contract with Service Painting Company in the amount of $18, 091. 00 for preparing the surface and coating the roof of the aircraft storage building designated at the "A" T-hangar at Municipal Airport with workmanship guaranteed for one year was approved on a motion made by Councilman Goodson and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- -187- August 6, 1991 Councilman Moore congratulated the pastor and congregation at Highland Avenue Baptist Church for their efforts this past week in conducting a neighborhood block party to bring the community together and activities that included honoring Mayor Lord. He thanked all the sponsors who gave of their time, property, material, and equipment and expressed admiration for the leadership of the pastor of the church. Councilman Alter announced the opening of Cajun Joe's, a new small business, located in the 5900 block of Eastex Freeway, and congratulated the Housing Services Division for their accomplishments displayed last Sunday in the open house for the affordable housing project in the Charlton-Pollard neighborhood and asked Staff to investigate the possiblity of installing garbage disposals in the homes. Councilman Cokinos thanked the Olive Garden Restaurant for bringing lunch to the Administrative Offices in celebration of their second year of operation in Beaumont and invited citizen participation in "Concerts in the Park, " Thursday at 6: 30 p.m. at Rogers Park with entertainment provided by the Jimmy Simmons Band. Councilman Goodson added his appreciation for the lunch provided by the Olive Garden and thanked the Beaumont Chamber of Commerce for hosting a reception at the Art Museum of Southeast Texas for law clerks working this summer at various firms. He said each clerk was impressed with their summer in Beaumont and the services provided by the Chamber. Mayor Pro Tem Smith announced "Sunday in the Park" will be hosted by American Valve and Hydrant, the Big Thicket National Preserve, St. Elizabeth Hospital Junior Volunteers, and the Camp Fire Council, on August 11, that Councilman Moore will be reading to the children and encouraged everyone to attend and enjoy a very good program. Mayor Lord brought to Staff's attention the deplorable condition of overhead street signs along Washington Boulevard and related an incident involving delayed delivery of a package and postal requirements regarding address abbreviations. -000- Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to announce a birthday celebration to be held at First Baptist Church, Sunday evening, at 7: 30 p.m. -000- There being no further business, the Regular Session of City Council was adjourned to reconvene in Workshop Session. -000- -188- August 6, 1991 I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held August 6, 1991.
