BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 4th day of June, 1991, with the following present: HONORABLE: Lulu L. The Pledge of Allegiance was led by Councilman Cokinos, who asked Jeanne Mitchell, Community Affairs Advisor for Mobil oil Corporation, and three unidentified participants in the Mo-Beau summer youth employment program to join him in leading the Pledge of Allegiance. -000- Mayor Pro Tem Smith reported that Mayor Lord is out of town, and that Councilman Goodson is in Houston with a deposition. -000- Three Proclamations were issued: "National Flag Week, " June 9-15, 1991; "National Safe Boating Week, " June 2-9, 1991; and "Management Week, " June 3-7, 1991. -000- MAYOR PRO TEM SMITH: And, now we have a very special presentation. . .Jeanne Mitchell, who's Community Affairs (Advisor) of the Mobil Oil Corporation. We're very appreciative of Mobil and all that they do for our community, but -130- June 4, 1991 particularly for the summer program to hire youth. We're very grateful to you, and I ' ll let you tell us all about what Mobil is doing for us. JEANNE MITCHELL• Well, thank you. I appreciate your kind words. I want to call up my team members up here: Tom Abbage, Cheryl Martin, Steve Rothrock and Tim Stelly are all co-Mobil counterparts with me. And, we are very pleased today to present to you this $32, 000.00 check (large replica) from the Mobil Foundation. COUNCILMAN MOORE• How much again, Jeanne? JEANNE MITCHELL• Thirty-two thousand dollars. This check will be used to support the Youth Employment Program at the City of Beaumont. As you all know, it involves hiring 20 youth for the summer, and we are especially pleased this year because the departments have increased from two to seven, so these students are going to get real-life experiences in other, in other locations, such as Planning, Maintenance, Health, Environment, the City Parks and Libraries again, and Engineering. So, we're especially pleased that the City has decided to explain this program. It will still involve 20 students for nine weeks and two days this year, due to the increase in minimum wage. But, as you can see, behind us, if they'll stand up, they look wonderful. We believe your concern for this city's youth is evident through this program also, and it's a great partnership--Mobil and the City of Beaumont. It's Mobil 's belief that programs such as Mo-Beau will only have a positive impact in the future of Beaumont through our young people. Last year you guys got tee-shirts just like they did, so this year we'd like to present you with one of our very own shirts. The Mobil Refinery employees have adopted the organizational improvement slogan, "Believe in Beaumont, Be the Best, " and we'd like to give each one of you our shirts, because we know you believe Beaumont can be the best also. Council expressed appreciation for Mobil 's commitment to our community and hope that other corporate citizens might join the program and expressed their belief that the youth is our future, and we need to reach out and give them opportunity for training in the work force. Mr. Riley pointed out that this is one of the few times, or maybe the only time, the City and it's citizens have been the recipients of this kind of grant at the request of the industry. Usually, the City initiates grant information and submits applications with proposals and requests. -000- -131- June 4, 1991 Citizen comment was invited on the Consent Agenda and Main Agenda Items 1 through 4 . No one wished to address these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held May 28, 1991; and Resolution No. 91-126 appointing Raymond Ambres, Bobbie Patterson, and Marilyn Adams to the Community Development Advisory Commission with terms expiring May 31, 1991; Glenda McCray to the Martin Luther King, Jr. Parkway Commission for a term expiring January 1, 1993 ; the Reverend Myron Barns and Nancy Davis to the Parks and Recreation Advisory Commission with terms expiring June 30, 1993 ; Mike Conwell to the Sister City Commission for a term expiring December 31, 1992 ; and Bobby Ward to the Electrical Board of Review for a term expiring April 30, 1994; Resolution No. 91-127 authorizing payment in the amount of $63,740.04 to Mustang Tractor and Equipment Co. for emergency repairs (pivot shaft, nose cone, steering controls, lift cylinders, tracks replaced, overhaul of engine and transmission) of Unit 5061, a 1987 Caterpillar D7H Bulldozer used daily (moving garbage and covering materials) at the Landfill; and Resolution No. 91-128 authorizing full and final settlement of a property damage claim brought against the City by Gwen Gallien as the result of a traffic accident April 30, 1991, at Lavaca and Park Streets with a Police Department vehicle in the amount of $5, 500. 00. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- (Councilman Samuel left the Council Chambers at 1:57 p.m. ) Resolution No. 91-129 authorizing an annual contract for purchase of polyethylene drainage pipe, couplings and tees for use by the Streets and Drainage Department from Hancor, Inc. of Yoakum Texas, in the amount of $22,276.50 for estimated yearly requirements of corrugated interior pipe and fittings (15" corrugated pipe - $3. 10/ft. , 18" corrugated pipe - $4.95/ft. , 24" corrugated pipe - $8. 67/ft. , 15" split coupling - $4 . 00/ft. , 18" split coupling - $5.70/ft. , 24" split coupling - $9. 00/ft. , 15" tees - $35.00/ea. , 18" tees - $75. 00/ea. , and 24" tees - $180. 00/ea. ) and Coburn Supply of Beaumont, in the amount of $45,670.00 for estimated yearly requirements of smooth interior pipe and fittings (15" smooth interior corrugated pipe - $4.49/ft. , 18" smooth interior -1 32- June 4, 1991 corrugated pipe - $6.44/ft. , 24" smooth interior corrugated pipe - $9.22/ft. , 36" smooth interior corrugated pipe - $21.49/ft. , 15" split coupling - $4 .49/ea. , 18" split coupling - $6. 44/ea. , 24" split coupling - $9.21 ea. , 36" split coupling - $21. 49/ea. , 15" tees - $137.75/ea. , 18" tees - $152 . 00/ea. , 24" tees - $215. 65/ea. , and 36" tees - $543 .40/ea. ) was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- (Councilman Samuel returned to the Council Chambers at 2:00 p.m. ) Resolution No. 91-130 authorizing a contract with Cleveco of Lumberton, Texas, for furnishing labor, materials, equipment and engineering services necessary for removing and installing a new canopy over the covered play area and basketball court at the Municipal Athletic Complex, 6455 College, in the amount of $32, 175. 00 was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Ordinance No. 91-50 amending Chapter 20, Section 20-4 (d) of the Code of Ordinances to establish a 12 o'clock midnight curfew until 6: 00 a.m. on Riverfront Park effective from and after 12 :00 a.m. , June 10, 1991, was considered: ORDINANCE NO. 91-50 ENTITLED AN ORDINANCE AMENDING CHAPTER 20, SECTION 20-4 (D) ESTABLISHING A CURFEW ON CITY PARKS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. After a short discussion, Ordinance No. 91-50 was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 91-131 authorizing acceptance of construction of a pre- engineered metal building at the Water Utilities Service Center by Alvin G. Randolph (reassigned to Randolph and Company on October 16, 1990, at the request of B & B Enterprises who could not fulfill the contract) and making final payment in the amount of $49, 240. 00, which includes Change Order No. 1 in the amount of $360. 00 for addition of a walk door, required by City building codes, and additional fill was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. These parcels of property have been inspected, are vacant, and found to be in violation of Article III, Section 14-50 of the Code of Ordinances. Notices have been sent to owners by Certified Mail and published in the Beaumont Enterprise. -134- June 4, 1991 The fourteen (14) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council 's order. The Public Safety Department is requesting authorization from City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition. 2795 Atlanta, 1490 Bolivar, 3940 Avenue B, 2398 Avenue E, 3465 W. Euclid, 2531 Harriot, 2110 Hayes Lane, 2312 Irving, 3605 Johnstown, 1477 Land, 2320 McFaddin (rear) , 2255 Orange, 950 Spruce (rear) , and 957 Spruce. Mrs. Zohreh Shahrodi and her husband, Fred Shahrodi, 1225 Wilchester Circle, addressed Council to request additional time to demolish the 14 structures on Bean Court. There being no one else to address Council, the public hearing was closed. Ordinance No. 91-51 declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by their owners was considered: ORDINANCE NO. 91-51 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Councilman Cokinos said the structure at 2232 North (rear) is owned by H. W. Loventhal, Jr. , not H. W. Loventhal, and reported he has been advised that demolition will begin within two weeks, and questioned the structure at 4195 Ironton owned by John Mazzola, Jr. Councilman Moore verified the structure listed at 3910 Avenue A is the church at Avenue A and Brockman and stated he knew of work being done by church members in the recent past and requested Staff verify that church officials have received proper notification of procedures. After a discussion and Council consensus that the above listed 14 structures on Bean Court are not repairable, are unsightly, dangerous to the neighborhood and contribute to crime in the area, Councilman Samuel made a motion, seconded by Councilman Moore, to amend the Staff recommendation for the 14 structures on Bean Court by ordering their demolition and removal within 60 days with Staff review for progress after 60 days to determine if additional time should be allowed the owners to complete the demolition. The motion was approved. Question: Ayes: All Nayes: None -135- June 4, 1991 Ordinance No. 91-51 was approved as amended on a motion made by Councilman Samuel and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Councilman Moore extended congratulations to all recent high school and college graduates in the area and reported that the Parks and Recreation Department summer program is in progress and encouraged all parents and youth to avail themselves of the opportunities. Councilman Samuel questioned the type of railroad tracks on the access road entering Downtown and asked for an evaluation to see if the same type crossing could be installed at the railroad tracks on Magnolia Avenue at Long and reported a damaged manhole cover in the 3700 block of Bowen Drive that needs to be replaced. Councilman Cokinos commended the reception welcoming the Russian scientists invited to the United States by Lamar University. Councilman Moore complimented Mayor Pro Tem Smith for coordinating the reception for the Russian guests. Mayor Pro Tem Smith explained that Lamar University's Chemistry Department brought in Professor Kaiser, a world renowned chemistry expert in chromotology, and 10 Russian scientists to spend 13 days at Lamar University. They are touring the area and conducting seminars. Three other chromotology experts will also be participating in the seminars. Yesterday, the City of Beaumont hosted a reception for the 10 scientists at the Civic Center. Mayor Pro Tem Smith said this is the only city they will visit, and they have been very pleased with Southeast Texas. Mayor Pro Tem Smith announced that "Sunday in the Park" will be sponsored by the Power Squadron, the Coast Guard, and Channel 12 emphasizing a safe boating theme. -000- Mr. John Milton, 9350 Gross, addressed Council to oppose garbage collection and recycling collection once each per week and presented a petition to Council with approximately 160 signatures requesting continuation of twice weekly garbage collection. Mrs. Delia Harrington, 815 Willow, addressed Council to commend the quick response by the City for mowing the Delia Harrington Welcome to Beaumont Park.
