Lord Mayor Andrew P. Cokinos Councilman At Large Brian R. Alter Councilman At Large Lulu L. Smith Mayor Pro Tem and Councilman, Ward I Guy N. Goodson Councilman, Ward II Audwin Samuel Councilman, Ward III David W. Moore Councilman, Ward IV Ray A. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by Councilman Brian Alter. The Pledge of Allegiance was led by Councilman Audwin Samuel. -000- MAYOR LORD: I think before we do anything else, it would be most appropriate if we swore in Councilman Moore one more time. And, I believe you are prepared to do this, Mr. Nichols? Is that correct? CITY ATTORNEY LANE NICHOLS: Yes, Mayor. MAYOR LORD: Would you like to stand and go ahead with this so we can make David official? COUNCILMAN MOORE: At least she didn't say legal. David W. Moore, Councilman, Ward IV, was administered the Oath of Office by City Attorney Lane Nichols. -108- May 14, 1991 MAYOR LORD: David, on behalf of all Council I 'm congratulating you and telling you we're very glad to have you back on board. COUNCILMAN MOORE• Well, thank you, Evelyn. It's good to be back. They say changes are healthy. .so I 'll be making all the necessary adjustments getting back; but, it's really great to work with you all and it's been a great working relationship since everybody on Council ' s been here and apparently the citizens must be relatively happy since we are all back -- almost back in our happy places (referred to new seating arrangement of councilmembers) . MAYOR LORD: Well, that may change again, too. COUNCILMAN MOORE• And, to my family, if you will indulge me just for a second. I 'd like to thank them all for coming. My dad, two aunts, my mom, and the first time I 've ever said this in public, my wife. MAYOR LORD: Yes, won't you all stand up, please? Well, I know you're just as proud of David as we are and it's very nice to have you here today and he's bound to behave if you are all watching. -000- The following proclamations were issued: "Employee Health and Fitness Day in Beaumont" - May 15, 1991; "Mental Health Month in Beaumont" - May, 1991; "National Historic Preservation Week in Beaumont" - May 12- 18, 1991 and "Transportation Week in Beaumont" - May 12-18, 1991 and "National Defense Transportation Day in Beaumont" - May 17, 1991. -000- Citizen comment was called for items of the Consent Agenda and Main Agenda. No one wished to address City Council concerning items to be considered today. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held May 7, 1991; and -109- May 14, 1991 Resolution No. 91-105 approving a pipeline permit to Amoco Production Company for a 270-foot section of eight-inch casing to be installed under Delaware Street at Dowlen Road at a license fee of $270.00. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 91-106 accepting the recommendation of the Historical Landmark Commission to adopt the "Charleston Principles" promulgated by the National Trust for Historic Preservation, to foster and encourage historic preservation in the local community was considered. The Charleston Principles are: Principle I: Identify historic places, both architectural and natural, that give the community its special character and that can aid its future well-being. Principle II: Adopt the preservation of historic places as a goal of planning for land use, economic development, housing at all income levels and transportation. Principle III: Create organizational, regulatory and incentive mechanisms to facilitate preservation and provide the leadership to make them work. Principle IV: Develop revitalization strategies that capitalize on the existing value of historic residential and commercial neighborhoods and properties and provide well-designed, affordable housing without displacing existing residents. Principle V: Ensure that policies and decisions on community growth and development respect a community's heritage and enhance overall livability. Principle VI: Demand excellence in design for new construction and in the stewardship of historic properties and places. Principle VII: Use a community's heritage to educate citizens of all ages to build civic pride. Principle VIII: Recognize the cultural diversity of communities and empower a diverse constituency to acknowledge, identify and preserve America's cultural and physical resources. Resolution No. 91-106 adopting the "Charleston Principles" formulated by the National Trust for Historic Preservation to foster and encourage historic preservation in the local community was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 91-107 authorizing execution of a contract with Hamilton Pools, Inc. , in the amount of $20,785. 00 for repairing the Magnolia Park swimming and wading pools located at 2855 Magnolia was approved on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -110- May 14, 1991 Resolution No. 91-108 authorizing execution of an annual contract with APAC-Texas of Beaumont in the amount of $15.20 per ton for furnishing cement stabilized base material for use by the Street and Drainage Department for repair and replacement of driveways and storm sewers was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem. Smith. Question: Ayes: All Nayes: None -000- Resolution 91-109 authorizing execution of an annual contract with Guillory's Lawn Maintenance Company for grounds and facilities maintenance for the Athletic Complex in the amount of $4,800 per month with an option to extend for an additional year if requested by the City was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution 91-110 authorizing execution of an annual contract with C enterprises, Inc. , for furnishing plumbing services for City facilities at $32. 00 per hour for the Plumber; $15. 00 for the Helper; minimum service call at $32 . 00 and twenty-five percent added to material costs was approved on a motion made by Councilman Goodson and seconded by Councilman Cokinos. Question: Ayes: All Nayes: -000- Resolution 91-111 authorizing execution of a six-month contract with APAC-Texas of Beaumont for furnishing asphaltic concrete patching material at a unit price of $29.25 per ton f.o.b. plant site was approved on a motion made by Mayor Pro Tem Smith and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Councilman Samuel reported a pile of trash in the 5200 block of Helbig. Councilman Moore questioned the City's ditch digging program and was told the item was scheduled for workshop discussion on May 28, 1991. Councilman Alter complimented Sunday in the Park activities and congratulated the Art Museum of Southeast Texas for its Kaleidoscope held this past weekend. Councilman Cokinos thanked staff for quick response in correcting condition of Longfellow Drive and for speed limits along St. Anthony school. -111- May 14, 1991 Councilman Goodson complimented the Art Museum for the great Kaleidoscope crafts and activities and reminded all of the Concert in the Park at Rogers Park to be held tonight at 7:00 p.m. - Jimmy Simmons Jazz Band to entertain. Mayor Pro Tem Smith said that she was sorry to have missed the many weekend festivities but had been attending a medical meeting in Dallas. Mayor Lord announced that the City's policy concerning Military personnel would be a topic for discussion at next week's Council Workshop Session. After a brief discussion, it was decided that the regular City Council session scheduled for May 28, 1991, would be held in the City Council Chambers at 7: 00 p.m. with a regular session/workshop format. -000- Mr. William G. Johnson, 2390 Pecos, and Dr. William Cruse Fuqua, 2422 Pecos, addressed Council to complain about poor drainage in the Oaks Addition. Mr. Johnson presented a petition containing approximately 159 signatures requesting drainage relief, saying a project which would alleviate the drainage problems was included in promoting the passage of the 1983 Drainage Relief Bond Issue. Mrs. Gwen Genn, 5765 Hooks, addressed Council to express her concerns for the treatment of Beaumont Police Officer Burmeister as a member of Desert Storm as reported by the Beaumont Enterprise in a recent article. -000- There being no further business, the meeting was recessed before continuing with the City Council Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the minutes of the regular City Council session held May 14, 1991.
