CITY COUNCIL - CITY OF BEAUMONT
HELD MAY 71 1991 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 7th day of May, 1991, with the following
present:

The Invocation was given by The Very Reverend John Badeen, Saint
Michael 's Orthodox Christian Church.
The Pledge of Allegiance was led by Councilman Alter.

Mayor Lord announced that Councilman Moore is absent due to an
unexpected meeting in Houston today.

Five Proclamations were issued: "Clean Air Week, " May 6-12, 1991;
"National Nurses Week, " May 6-12, 1991; "Goodwill Industries Week, " May
6-10, 1991; "Nursing Home Week, " May 12-18, 1991; and "Kaleidoscope 191
Weekend, " May 11-12, 1991.

Mayor Lord introduced her sister, Betty Gates, visiting Beaumont from
Florida and presented her with a card of honorary citizenship.

Thirty students from Austin Middle School and mentors of the "I Have A

Dream" program were introduced. Mr. Ben Rogers, initiator of the idea,
acknowledged the progress he has witnessed since the inception of the
program two years ago and said these young people will be the leaders
when they enter Lamar University because they strive for excellence and
know where they're going.

Citizen comment was invited on the Consent and Main Agenda Items 3 and
4. No one wished to address these items. Item No. 5 is deferred.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held April
30, 1991;
Resolution No. 91-100 reappointing George C. Hudspeth to the Small
Business Revolving Loan Fund Advisory Commission for a term expiring
December 31, 1992 ;
Resolution No. 91-101 accepting street and storm sewer improvements on
Marion Drive from the existing pavement 102 feet north to the centerline
of the cul-de-sac, then 617 feet east to Cypress Point, Cypress Point
from Marion Drive 204 feet south to the existing pave on Cypress Point,
and Sawgrass Circle from the intersection of Marion Drive and Cypress
Point 152 feet northeast to and including the cul-de-sac and water and
sanitary sewer improvements on Lots 8 through 22 , Block 15 in Willow
Creek Country Club Estates - Phase II, Section VIII-D; and
Resolution No. 91-102 authorizing settlement of a lawsuit styled Kevin
Smith v. the City of Beaumont and City of Beaumont Water Utilities
Department, Cause No. 63396, in the amount of $6, 000. 00.
The Consent Agenda was approved on a motion made by Mayor Pro Tem
Cokinos and seconded by Councilman Alter.

Ordinance No. 91-40 canvassing the returns of the May 4, 1991 Joint City
General Election showing a total of 4,881 votes cast--Councilman, Ward
I: Lulu L. Smith, 1, 146 votes, Wilber S. White, 375 votes; Councilman
Ward II: Guy N. Goodson, 752 votes; Councilman, Ward III: Alton
Buxton, Sr. 35 votes, Audwin Samuel 662 votes, Mark A. Acree, 31 votes;
Councilman, Ward IV: David W. Moore, 1, 102 votes, Gethrel "Get"
Williams, 487 votes was considered:

ORDINANCE NO. 91-40
ENTITLED AN ORDINANCE CANVASSING THE
RETURNS OF THE REGULAR CITY ELECTION
HELD IN THE CITY OF BEAUMONT ON THE
4TH DAY OF MAY, 1991, FOR THE PURPOSE
OF ELECTING FOUR (4) WARD COUNCIL
MEMBERS; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
Those elected were Lulu L. Smith, Councilman for Ward I, Guy N. Goodson,
Councilman for Ward II, Audwin Samuel, Councilman, for Ward III, and
David W. Moore, Councilman for Ward IV.
Ordinance No. 91-40 was approved on a motion made by Councilman Alter
and seconded by Councilman Goodson.
Question: Ayes: All Nayes: None

Lupe Flores, Municipal Court Magistrate, administered the Oath of Office
to Lulu L. Smith as Councilman for Ward I of the City of Beaumont, Guy
N. Goodson as Councilman for Ward II of the City of Beaumont, Audwin
Samuel as Councilman for Ward III of the City of Beaumont and David W.
Moore as Councilman for Ward IV of the City of Beaumont as elected on
May 4, 1991.

Mayor Lord invited comments from the newly seated councilmembers.
COUNCILMAN SMITH•
I would just like to thank everyone that worked on my campaign and all
of, particularly those who went to vote. I appreciate your support. I
appreciate your confidence. I 'm happy this campaign is over, and I 'm
ready to go back to work.
COUNCILMAN GOODSON:
I don't have many people to thank in my campaign, Mayor, but
MAYOR LORD:
Seven hundred sixty-five, fifty-two!
MAYOR PRO TEM COKINOS:
Well, that's a landslide.
COUNCILMAN GOODSON:
Landslide! But, I do want to say, no matter where I sit up, it's a
pleasure to be up here.

COUNCILMAN SAMUEL:
Well, first of all, I thank God for the opportunity, allowing me the
opportunity to serve on this Council. It's good to be back to work with
each one of you. I 'd like to thank my wife for working with me
throughout the campaign and carrying the ball while I 've been away in
school, and I thank my committee. They all worked very hard. And, I
thank all my friends, all the churches, all the pastors, and I hope I
didn't leave anyone out because I really appreciate the opportunity to
serve, and I will continue to serve, learn, and grow, and I hope that
Beaumont will grow as well. So, thank you very much.
MAYOR LORD:
Thank all you, and I may say that your mayor is very happy to have you
all back here, because I think we're a pretty good team, and I hate to
lose any of you.

On a motion made by Mayor Pro Tem Cokinos and seconded by Councilman
Samuel, Councilman Lulu L. Smith was elected to serve as Mayor Pro
Tempore for a one-year term in accordance with Article III, Section 6 of
the City Charter.

The presence of James McNicholas, a former mayor for the City of
Beaumont was acknowledged, and Mayor Lord expressed her gratitude to
Councilman Cokinos for his conscientious and dependable performance as
Mayor Pro Tem for the past year.

Resolution No. 91-103 authorizing a contract with Crain Brothers, Inc.
in the amount of $399, 610. 00 for Phase II of the Irving Street Outfall
Drainage Project to repair the section between Hemlock and Burt Street
was approved on a motion made by Councilman Alter and seconded by Mayor
Pro Tem Smith.

Resolution No. 91-104 authorizing use of $41,000. 00 in Community
Development Block Grant funds from the historic preservation line item
in the Statement of Objectives and Projected Use of Funds as part of the
financing for an estimated $110, 000. 00 project for restoration of the
original Kansas City Southern (KCS) railroad depot recommended by the
Historical Landmark Commission was approved on a motion made by
Councilman Cokinos and seconded by Councilman Alter.

Councilman Alter congratulated the incoming Councilmembers and reminded
everyone to remember their mother this weekend by perhaps taking her to
Kaleidoscope.
Councilman Cokinos encouraged everyone to attend Kaleidoscope and
congratulated Councilman Smith as the newly elected Mayor Pro Tem.
Councilman Goodson added his congratulations to all successful
candidates, encouraged Kaleidoscope attendance and thanked the YMBL for
a great job in conducting the rodeo.
Mayor Pro Tem Smith said that in addition to Mother's Day and
Kaleidoscope activities this weekend, "Sunday in the Park" will begin
at 2 : 00 p.m. Sunday and Mayor Lord will be the reader for the children.
Mayor Lord repeated congratulations to the new Councilmembers and said
she looks forward to serving with Councilman Smith as Mayor Pro Tem.
She said that not only did the YMBL conduct a good rodeo, but they had a
wonderful olympics for children with learning and physical disabilities,
and reported the opportunity of visiting the art workshop, and that
Herman Davis, a carver, presented her with a cedar cane carved that
morning from a scrap of cedar wood.
Councilman Samuel pointed out this is the first time he remembers that
both leadership positions of Mayor and Mayor Pro Tem have been held
simultaneously by the female gender. Mayor Lord assured him they would
endeavor to do a good job.

Dr. Cruse Fuqua, 2420 Pecos Boulevard, addressed Council about the
increased number of daytime burglaries in his eight-block neighborhood.
Mr. Ben Rogers, 2030 Thomas Road, congratulated the newly elected
Councilmembers, complimented their dedication, and requested ownership
information of the King Edward Hotel and status of the building.
Mr. Joe Forkner, owner of Automatic Lawn Systems at 5830 Cole Road,
congratulated Council seat winners, complained of lost paperwork by City

staff processing dumping permits, and the same fees charged for dumping
varying size loads at the landfill.
The Reverend Timothy Hunley, 1698 LaSalle, congratulated Council
winners, complained of flooding at Weiss Park near Magnolia during heavy
rains, requested additional lighting, picnic tables, and playground
equipment on the east side of Weiss Park, complained of a blanket park
curfew and suggested spot curfew.
Mr. Henry Dannenbaum, 1567 Wall Street, expressed his gratitude to
Council for their loyalty and dedication.

There being no other business, Workshop or Executive Session, the
Regular Session of City Council was adjourned.
