BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 30th day of April, 1991, with the

The Invocation was given by the Reverend Leo Lane, Bolden Memorial
Church of God in Christ.
The Pledge of Allegiance was led by Councilman Moore.

Mayor Lord announced that Councilman Samuel sent regrets for his
absence. He is taking a final examination at Texas Southern University,
where he is a law student.

Three Proclamations were issued: "Supplemental Security Income Outreach
Weekend, " May 4 and 5, 1991; "Shrine Hospital Day, " May 4, 1991; and
"Western Week, " April 29-May 4, 1991 --- "YMBL Rodeo Days, " May 1-4,
1991.

Mayor Lord said she and City Council spent time this week with the
Rotary Club visiting the schools in the community "recognizing young
people who've given of themselves and who have been selected from
amongst several candidates for special recognition in the Rotary
"Service Above Self" Award. She said "this means much to our community

because it's these young people who are our hope for tomorrow, and they
have learned already what it is to give of themselves, and hopefully, to
receive a little bit back in the warm feeling and sense of belonging
that comes with being a volunteer. "
Mayor Lord read a commendation presented to Donald D. Braugh, III from
Beaumont Christian School, Andrew Scott Milgram from Kelly High School,
Kristy Beth Schroeder and Robert Benjamin Leggington, Jr. from Central
Senior High School, and Katherine Danielle Kostelny and Natalie Pauline
Wolf from West Brook Senior High School:
"It is my pleasure on behalf of City Council and citizens of Beaumont to
acknowledge you as recipient of the 1991 Youth Service Day "Service
Above Self" Award. You are indeed one of today's outstanding students
who has selflessly given your time and talent to a variety of community
needs.
I commend you for seeking a quality educational experience of which
service is an integral part. The quality of life in Beaumont is
dependent upon this tradition of service being adopted by our youth and
future leaders. Your idealism and enthusiasm have set a very positive
example for others to follow.
You have my whole-hearted appreciation and admiration for your exemplary
community service. Thanks to your fine example, there is an exciting
groundswell of young people rededicating themselves to helping others.
You are considered Beaumont's brightest hope for the future.
Best wishes for future success.

MR._ DAN HALLMARK, ROTARY CLUB PRESIDENT:
Mayor, we just want you to know we appreciate you and the City Council 's
support in recognizing these young people who are making such an
important contribution to our community. Throughout communities all
over America everyday, young people make valuable contributions in the
form of community service, and we're pleased to join with the City of
Beaumont at the Beaumont Rotary Club in saying thank-you to these young
people and telling them how much we appreciate the job that they're
doing, the example that they're setting for all of us to follow. And,
so we're proud of you and we appreciate all the hard work that you all
do on our behalf.
Mr. Hallmark introduced Calvin Spindor, Chairman of the Youth
Recognition Committee, Co-Chairman Paula O'Neal, and Committee Members
Sheryl Cooper and Brian Alter.
KRISTY SCHROEDER, CENTRAL HIGH SCHOOL RECIPIENT:
Good afternoon. I would first like to welcome each of you here today,

and I, along with other students being honored here, appreciate the time
you're taking from your busy schedules. I would also like to begin by
giving our deepest appreciation to the Rotary Club of Beaumont for
selecting me as one of the recipients of the "Service Above Self" Award.
I 'm very honored to have been chosen as, very honored to have been one
of the ones who were chosen. I have a great deal of concern for the
City of Beaumont, and I believe that the services I provide for this
community show this. I feel that serving the community is extremely
important. Helping the less-fortunate, keeping the Beaumont street
clean, and raising money for various organizations are all a part of the
service in "Service Above Self. " This is why the recognition I 'm
receiving today is so special to me. The services I do for this
community are as beneficial to me as they are to the people I serve.
Being able to see bright smiles on the faces of old folks in
Schlesinger's Nursing Home and knowing that my dedication and hard work
to Drill Team support my school and community during Kick-A-Thon, I feel
a warmth in my heart. Through the Anchor Club, I have served the
community in several ways. Our club bags groceries at St. Mark's Church
for the needy. Also, on every other Monday of the month we play Bingo
with the elderly at Schlesinger' s Geriatric Center. We play a part in
beautification of our society by cleaning up a section of Eleventh
Street on certain Sundays. We help answer telephones at the Jerry
Lewis' Tele-A-Thon each year to help raise money for muscular dystrophy.
Also, to raise money for the Muscular Dystrophy Association, we sell
carnations. Recently we participated in the March of Dimes Walk-A-Thon
to help prevent birth defects. Also, we contributed to the Cerebral
Palsy Rehabilitation Center by purchasing two rubber ducks to be entered
in the First Annual Rubber Ducky Derby. Being the current president-
elect and the soon to be president of the Central High School Anchor
Club, I am proud to say that these are only some of the services we
provide to our community. I 'm presently a lieutenant in the Drill Team
here at Central High School, and we, too, help our community. Each year
the Silver Steppers participate in the Kick-A-Thon which raises money
for the Muscular Dystrophy Association. Also, we serve our community by
supporting our school throughout football season. I 'm deeply honored to
receive this acknowledgment of my service to the community. It is often
hard work to keep up the yearly service I provide to our society, and it
is rarely recognized. These students being honored here with me today
understand this. They, too, are outstanding people in this community.
Each of them work either through school clubs and organizations, church
groups or other volunteer groups to help the city of Beaumont. Though I
cannot completely change the world, I do, I do feel as though my service
to the community is essential. With my help and the help of many other
people, our community will continue to grow strong. The effort every
person puts forth, though not always recognized, is helpful and will
always be in demand in our community. At this point and time, there are
problems in every community which include homelessness and drug abuse
among other things. This is why I believe that "Service Above Self"
should always be the main priority in everyone's life. Perhaps by hold
this belief, we can all change our

community into a better place to live. Thank you.
PAULA O'NEAL, YOUTH RECOGNITION CO-CHAIRMAN:
We hope that by hearing the activities of Kristy that you will
understand that all of these students are very outstanding. It was very
difficult having to pick from the over-forty that were nominated, but
these are six of the finest young people in Beaumont, and we hope by
hearing Kristy's activities that you understand that they are all
wonderful and very deserving, and we're very proud of all of them.
Mayor Lord thanked the participants and remarked that indeed the world
can be changed with young people like these because there is a lot of
hope.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held April
23, 1991;
Resolution No. 91-90 authorizing purchase of three semi-automatic
defibrillator advisory units for the Emergency Medical Services in the
amount of $15,900. 00 from Physio-Control Corporation;
Resolution No. 91-91 authorizing purchase of a 50 h.p. diesel driven
tractor for the Water Utilities, Water Reclamation Division, in the
amount of $15, 090. 00 from Eastex Farm and Home of Beaumont;
Resolution No. 91-92 authorizing an annual contract with Transit Mix for
ready mix concrete at $53 .55 per cubic yard for five sack mixture, plus
or minus $4. 00 per sack for different mixtures and a partial delivery
load charge of $10. 00 for loads of 1-1/4 to 2 cubic yards and $20. 00 per
load for 2-1/4 to 4-3/4 cubic yards for the Streets and Drainage
Department; and
Resolution No. 91-93 authorizing a six month contract with Tri-Con, Inc.
for furnishing engine oil at $2 .89 per gallon, transmission oil--Dextron
II and Type F at $. 93 per quart and hydraulic oil at $2 . 39 per gallon.
The Consent Agenda was approved on a motion made by Mayor Pro Tem
Cokinos and seconded by Councilman Goodson.

Resolution No. 91-94 authorizing purchase of one (1) tandem axle, diesel
power cab and chassis mounted with a fourteen (14) cubic yard dump body
for use by the Water Utilities, Water Distribution Department for
transporting excavated materials from construction sites from Barrett
White GMC of Tyler, Texas in the amount of $59,998.00;
Resolution No. 91-95 authorizing purchase of one (1) medium duty truck
mounted with a four (4) cubic yard dump body for use by the
Transportation Department for hauling materials excavated from signal
and traffic control construction projects from Knapp Chevrolet of
Houston, Texas in the amount of $29, 170.80; and
Resolution No. 91-96 authorizing purchase of one (1) medium duty chassis
mounted with an eight (8) cubic yard dump bed for use by the Park
Maintenance Division from Barrett White GMC of Tyler, Texas in the
amount of $34,498. 00 were approved on a motion made by Councilman
Goodson and seconded by Councilman Smith.

Ordinance No. 91-37 amending Chapter 28, Section 28-6 (b) (3) of the Code
of Ordinances to allow handicapped persons to obtain transit
identification cards by providing acceptable documentation showing proof
of disability from a governmental authority or medical doctor was
considered:

Ordinance No. 91-38 amending Chapter 13, Section 13-16 of the Code of
Ordinances establishing new fees for services provided by the Health
Department (STD Treatment from $8. 00 to $10. 00; BCHC Medical Clinic from
$3. 00 to $5.00; BCHC Dental Clinic from $3.00 to $5.00; HIV
Certification from $10. 00 to $25. 00 and Cervical Screening Clinic from
no charge to $5. 00) was considered:

PROVIDING FOR A PENALTY.
After a discussion emphasizing no policy or fee change in care for the
indigent, Ordinance No. 91-38 was approved on a motion made by
Councilman Smith and seconded by Councilman Moore.

Resolution No. 91-97 authorizing an annual contract with SmithKline
Beecham Clinical Laboratories for medical laboratory testing services
for the Beaumont Health Department for the tests most frequently
required--CBC at $3 .50; Glucose, Fasting and Two Hour at $8.25; Glucose
at $3 .75; Chem-Zyme at $6.00; Chem-Zyme and CBC at $9. 00; Substance
Abuse Panel 10 at $25. 00; RPR at $4. 00; GC Culture at $9. 00; MHA-TP at
$11. 00; Pap Smear at $5.75 for an estimated annual expenditure of
$69, 050. 00--and a 38% discount off all other laboratory testing was
approved on a motion made by Councilman Smith and seconded by Councilman
Moore.

Resolution No. 91-98 authorizing payment to Russ Miller Construction
Company ($183,653.40 less the usual 5% retainage to insure satisfactory
completion of the contract) for materials (a 51x4 ' concrete storm sewer
box, prefabricated storm inlets and corrugated polyethylene pipe)
purchased for the reconstruction of College Street at the western end
between Goliad and Avenue A in view of a change in the construction
schedule calling for work to begin at the eastern end of the project
extending from Avenue A to Goliad was approved on a motion made by
Councilman Goodson and seconded by Councilman Smith.

Resolution No. 91-99 authorizing contracts as authorized by State law as
an "assigned sheltered workshops" to help create jobs for the severely
disabled to Beaumont Products and Services, Inc. (Beaumont State
Center) , in the amount of $4,649.92 per month for grounds and facility
maintenance at the Municipal Complex, and Trust Industries, Inc. (MHMR) ,
for Tyrrell Park, in the amount of $10,337.45 per month for the months
of March through October and $2,941.42 per month for the months of
November through February, or $94,465.28 annually, was approved on a
motion made by Councilman Moore and seconded by Councilman Goodson.

City Manager Riley asked that Agenda Item 8 regarding maintenance for
non-utilized City-owned property be deferred for additional information.

Mayor Lord announced that an Executive Session will be conducted in
accordance with Section 2 (e) of the Texas Open Meetings Act to discuss
pending or contemplated litigation concerning an update of all pending
litigation involving the City of Beaumont, overtime provisions of wage
and hour related matters.

These parcels of property have been inspected, are vacant, are found to
be in violation of Article III, Section 14-50 of the Code of Ordinances.
Notices have been sent to owners by Certified Mail and published in the
Beaumont Enterprise.
The twenty (20) structures listed below have been condemned by City
Council and the owners ordered to either raze or repair them within
specified time frames. Reinspection of these structures have revealed
non-compliance with the Council 's order. The Public Safety Department
is requesting authorization from City Council to demolish these
structures in accordance with the Dangerous Structure Ordinance and
charge the property owners with the cost of demolition.

College, 8797 College (Comm. 11, 8797 College (Comm. 2) , 1825
Cottonwood, 275 North 4th Street, 4745 Galveston, 1750 Gladys, 1833-35-
37 Grand, 2445 Hebert, 2457 Hebert, 1575 West Highland, 1575 West
Highland (Shed), 1397 Liberty, 5270 Midford, 1301-03 Orange, and 1440
Sherman.
Mr. Alvin Morgan, Silsbee, addressed Council regarding the structure at
8050 Mitchell Road to explain that he has sold the property to Mr. David
as a contract sale and that Mr. David plans to demolish and remove the
structure within thirty (30) days. Mr. Morgan was advised to instruct
Mr. David to acquire a demolition permit in the Building Codes Division.
Mrs. Zadie Akers, 1483 Avenue H, addressed Council regarding the
structure at 3077 South 5th Street. Mrs. Akers explained her personal
situation and expressed concern about repayment of demolition charges on
her water bill and requested to use the building for storage if
possible. In answer to questions by Council, Staff reported that
demolition charges will be assessed as a lien against the property and
that zoning prohibits use of the building as a storage shed.
Mrs. Stephanie Lane, 5255 Midford, addressed Council in support of
demolition of the property at 5270 Midford.
There being no one else to address Council, the public hearing was

closed.
Ordinance No. 91-39 declaring certain structures to be public nuisances
and ordering their repair or removal by their owners was considered:

TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR
OR DEMOLITION; PROVIDING FOR SEVERABILITY AND
PROVIDING FOR A PENALTY.
After a short discussion, Ordinance No. 91-39 was amended to remove the
structures at 3077 South 5th Street and 740 Prairie Street from Section
1 of the ordinance and approved on a motion made by Mayor Pro Tem
Cokinos and seconded by Councilman Goodson.

Mayor Lord reported reading of recycling materials from demolished
houses and suggestions for city-owned property and requested a list of
city-owned properties and those in which the City has an interest.

Councilman Alter thanked citizens for a successful "Spring Sweep" at
Fair Park Saturday. He said that Dr. Tom Nelson from the Clean
Community Commission served as Chairman for the event and that
participation was approximately tripled and that it was fun as well as
successful.
Councilman Moore encouraged everyone to exercise their opportunity to
vote on Saturday, asked for an update of the Eleventh Street ditch
issue, and asked for clarification of City policy addressing Reserve
duty. Mr. Riley reviewed Council action on that issue
Mayor Lord shared receiving three letters complementing City Staff. One
letter commended the Police Department for their courteous and helpful
behavior in a burglary investigation; the Ladies of the Symphony
commended Mark Arrington of Community Facilities as an "absolutely
wonderful technical director, " and that everything they asked of him was
handled "efficiently, ethically and appropriately, " and that on most
occasions their needs were anticipated and they also complimented
Claudie Hawkins for her assistance throughout the year to help improve
local organizations and to promote their growth and credibility; and a
letter commending a Water Utilities Department crew for their
competence, knowledge of the system and courtesy. Mayor Lord commented
that Fireman Jeff McNeel reported that while serving as a greeter today,
he held the door open for a gentleman who responded that that action

made paying his bill a lot easier. Mayor Lord extended bouquets to
Staff for their helpfulness and friendliness.

Mr. Jack Tinkle, 410 North Major Drive, addressed Council in support of
their recent vote to allow construction of Lamar Bancshares on Dowlen
Road; mentioned businesses leaving Beaumont; in opposition to zoning
regulations on Concord, weed liens, personal property tax; and told of
his "dare to be different" philosophy.
Dr. Wilbur White, 3495 Kenwood, distributed and read a letter to Council
that he sent to members of the Youth Commission recently established by
Mayor Lord. Dr. White discussed meeting with Roy Huckaby, Director of
the John Gray Institute, regarding possibilities for this program and
volunteered to serve on the Youth Commission, which he stated as a
parallel idea of his, and complimented the Mayor for taking it on as a
project.
Mayor Lord took exception to the statement in Dr. White's letter, "I
never dreamed when talking about this to Mayor Lord last month. . . "
saying to the best of her recollection, Dr. White had never spoken to
her "about any youth commission. "

adjourned to reconvene in Workshop Session in the Third Floor Conference
Room.
