BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 5th day of March, 1991, with the following present: HONORABLE: Evelyn M. Lord Mayor Andrew P. City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Harland Merriam of Saint Andrew's Presbyterian Church. The Pledge of Allegiance was led by Hugo Castillo, Sylvester Freddie, Stephen Marks, Kali Patillo, Christina Petry, Avery Taylor, Alex Walker, and Joseph Wilson, students at Caldwood Elementary School. -000- Seven Proclamations were issued: "Mental Retardation Month, " March, 1991; "National Sales Month, " March 1991; "Texas Public Schools Week, " March 4-8, 1991; "Girl Scout Week, " March 10-16, 1991; "Energy Education Day, " March 15, 1991; "Red Cross Month, " March, 1991; and "Irish Heritage Month, " March, 1991. -000- Mr. David Fisher, the Beaumont Site Chairperson for the March of Dimes, announced that Mayor Lord will be competing with the mayors of Orange and Port Arthur in a walk over the Veteran's Memorial Bridge on March 18th at 5:30 p.m. Mr. Fisher explained that the March of Dimes is an organization that sincerely desires to eradicate birth defects. He announced that there will be a National Walk-a-thon on April 13th starting at Rogers Park in Beaumont. Mr. Fisher and Ms. Angela Baker, a Regional March of Dimes Representative, presented Council with Team Captain tee shirts and Walk-America buttons. Mayor Lord expressed her -45- March 5, 1991 appreciation for the March of Dimes and delight in helping with the walk. She said that as a child her son contracted polio, and after exhaustive medical treatment, the March of Dimes provided for physiotherapy three times a week for him. -000- Mayor Lord acknowledged that our City Attorney, Lane Nichols, has completed twenty years of public service with the City of Beaumont. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held February 26, 1991; Resolution No. 91-44 reappointing Ed Sigee to the Beaumont Housing Authority Commission for a term expiring February 28, 1993 ; Resolution No. 91-45 authorizing an annual contract for furnishing computer paper to Century Papers at $10.25 per thousand sheets for 14- 7/8" x 11" green bar paper and $6.97 per thousand sheets for 9-1/2" x 1l" for white continuous feed recycled paper including freight, inside delivery and stacking for an approximate total of $11,496.40; Resolution No. 91-46 approving a License to Encroach with Chevron, U.S.A. , Inc. for a groundwater monitoring well on Calder Avenue right-of- way, adjacent to lot 162, Calder Terrace Addition, to trace concentrations of various pollutants for a one-time fee of $500. 00; and Resolution No. 91-47 authorizing purchase of Parcel No. 2 : 0.4720 acre out of "College Square" of the Original Town Site of Beaumont, Noah Tevis Survey, Abstract 52 (partial taking) from Beaumont Independent School District for the appraised value of $38,950. 00 for the College- Wall Connector Project, to be constructed as part of the College Street T. I.P. Project, connecting College Street with Wall Street on the east side of Martin Luther King, Jr. Parkway. The Consent Agenda was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Ordinance No. 91-22 amending Chapter 30, Section 30-28 of the Code of Ordinances to regulate election signs, prohibit signs obstructing the vision of motorists and make other revisions in the sign ordinance was considered: -46- March 5, 1991 ORDINANCE NO. 91-22 ENTITLED AN ORDINANCE AMENDING CHAPTER 30, SECTIONS 30-28 a (EXEMPTIONS) AND 30-28 f (PROHIBITED SIGNS) OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. After a brief discussion concerning enforcement, fines, and definitions, Ordinance No. 91-22 was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Ordinance No. 91-23 amending Chapter 2, Section 2-52 of the Code of Ordinances to establish a uniform policy for collection of delinquent loans from the Small Business Revolving Loan Fund was considered: ORDINANCE NO. 91-23 ENTITLED AN ORDINANCE AMENDING CHAPTER 2, SECTION 2-52 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT AUTHORIZING THE CITY MANAGER TO ENFORCE COLLECTION OF DELINQUENT LOANS FROM THE SMALL BUSINESS REVOLVING LOAN FUND; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. After a discussion concerning criteria and pay-back of the loans and a suggestion for workshopping the item for an update of the performance of the program, Ordinance No. 91-23 was approved on a motion made by Councilman Alter and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 91-48 authorizing a contract with Russ Miller Construction Company, Inc. in the amount of $3 ,299, 161. 19 for widening and construction of improvements to the section of College Street between Goliad and Main Streets including construction of the College- Wall Connector for movement of westbound College Street traffic across Martin Luther King, Jr. Parkway was approved on a motion made by Mayor Pro Tem Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- -47- March 5, 1991 Resolution No. 91-49 authorizing purchase of an articulated, off-road 20- cubic-yard dump truck from Mustang Tractor and Equipment Co. in the amount of $164,489. 00 for use at the landfill where the articulated bed linked to the cab by a flexible joint would afford maneuverability for use in restricted spaces, and as a safety factor, minimize the seriousness of accidents, was approved on a motion made by Councilman Moore and seconded by Mayor Pro Tem Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 91-50 amending the Community Development Block Grant Statement of Objectives and Projected Use of Funds to transfer $250, 000. 00 from the Multi-Family Housing Program to the Housing Rehabilitation Program in order to continue operation through September 30, 1991 was approved on a motion made by Councilman Alter and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Resolution No. 91-51 authorizing the City Attorney to take all steps necessary to appeal an adverse judgment should one be entered in the case of Woodford Bouillion, et al vs. The City of Beaumont was approved on a motion made by Councilman Goodson and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Smith announced the first "Sunday in the Park" for the 1991 season will be hosted by City of Beaumont employees on March 10th at Riverfront Park, and the comic reader will be Mayor Pro Tem Cokinos. Councilman Moore questioned traffic routing during street repairs on Walden Road, again asked for a progress report on the anticipated completion date of the Martin Luther King, Jr. Parkway, reported that he has received calls regarding stagnant water in ditches and suggested return to a scheduled ditching program. Mayor Pro Tem Cokinos said this is going to be a great year for "Sunday in the Park" and invited everyone to attend next Sunday and discover in the story that he will be reading to the children, why leprechauns don't lie. Councilman Goodson reported receipt of a call from a citizen who has commercial garbage pickup and was charged for dumping at the Landfill and questioned City policy for this service. Mayor Lord said she has received a lot of compliments on the Greeters Program at City Hall and complimented the City Clerk for coordinating -48- March 5, 1991 the program and supplying answers to the unusual questions, reported that the first meeting of the Beaumont Friendly Commission was yesterday and met with a lot of enthusiasm, and announced there will be no Council meeting next week because of a National League of Cities meeting in Washington, D.C. -000- Mr. Forrest F. "Ted" Posey, 3695 Edmonds Street, addressed Council to express his hope that our nation will attain a lasting peace and complained about the condition of the railroad crossing on College Street.
