CITY COUNCIL - CITY OF BEAUMONT
HELD FEBRUARY 19, 1991 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 19th day of February, 1991, with the
following present:

The Invocation was given by Pastor Douglas Rathgaber of St. John's
Lutheran Church.
The Pledge of Allegiance was led by Councilman Alter.

One Proclamation was issued: "National Engineers Week, " February 17-
23, 1991.

Citizen comment was invited on the Consent and Main Agenda items. No
one wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held
February 12, 1991; and
Resolution No. 91-34 appointing Mike Ramsey to the Community Development
Advisory Commission for a term expiring May 31, 1992 .
The Consent Agenda was approved on a motion made by Mayor Pro Tem

Cokinos and seconded by Councilman Alter.

Mayor Lord announced that an Executive Session would be conducted
following the close of the Workshop Session in accordance with Section 2
(e) of the Texas Open Meetings Act to discuss pending or contemplated
litigation regarding Tammy Lynn Taylor v. Lamar University et al and
Section 2 (g) for an annual evaluation of the Chief City Magistrate.

Mr. Bill Munson, Manager of the Beaumont Transit Authority, extended an
invitation to attend the Annual Bus and Van Rodeo, Sunday afternoon, at
Fair Park and presented Council with caps and tee-shirts like the ones
entrants will wear during competition when they navigate their vehicles
through an obstacle course of cones and barrels. Mr. Munson said the
winning bus and van drivers will advance to a State competition
sponsored by the State Highway Department at the end of March in E1
Paso.

Resolution No. 91-35 authorizing purchase of property damage insurance
for City buildings and their contents to include fire and flood
insurance and extended coverage up to a total insured value of
$104,913, 000. 00, subject to a $100,000. 00 deductible, from the Hartford
Insurance Group represented by the Wisenberg Insurance and Risk
Management Agency of Houston in the amount of $74,500.26 for the period
from February 21, 1991, through February 20, 1992, was approved on a
motion made by Councilman Alter and seconded by Councilman Smith.

Resolution No. 91-36 accepting the work performed on a contract with the
Swain Company for installing a new metal roof over the existing roof on
the Best Years Center and furnishing materials, labor and equipment to
replace the metal roof sections of the Coliseum in Fair Park and
authorizing final payment in the amount of $16,639.82 for additional
replacement of deteriorated materials found to be necessary was approved
on a motion made by Councilman Goodson and seconded by Councilman Smith.

Resolution No. 91-37 authorizing an annual contract, with an option to
extend the contract for an additional six months, with Tri-Con, Inc. for

unleaded 87 octane gasoline, unleaded 89 octane gasoline, and diesel
fuel at plus $.0128, transport load, and plus $. 0328, tankwagon load,
above the O.P.I.S. posted average per gallon was approved on a motion
made by Mayor Pro Tem Cokinos and seconded by Councilman Alter.

Resolution No. 91-38 authorizing support and encouragement for passage
of legislation exempting municipalities from payment of state taxes on
gasoline products to be used in publicly operated vehicles was approved
on a motion made by Councilman Moore and seconded by Mayor Pro Tem
Cokinos.

Ordinance No. 91-12 amending Chapter 28, Section 28-7 of the Code of
Ordinances to specify two-year terms for the Transit Advisory Committee
ORDINANCE NO. 91-12
ENTITLED AN ORDINANCE AMENDING
CHAPTER 28 SECTION 28-7 OF THE
CODE OF ORDINANCES OF THE CITY
OF BEAUMONT TO DECREASE THE
TERM FOR NEW MEMBERS OF THE
TRANSIT ADVISORY COMMITTEE FROM
THREE YEARS TO TWO YEARS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR REPEAL.
and Ordinance No. 91-13 amending Chapter 2, Section 2-30 of the Code of
Ordinances to specify two-year terms for the Senior Citizens Advisory
Commission for consistency of uniform terms of advisory boards in order
to allow broader citizen participation was considered:

OF THE CITY OF BEAUMONT TO REDUCE THE
TERM OF NEW APPOINTEES TO THE SENIOR
CITIZENS ADVISORY COMMISSION FROM THREE
YEARS TO TWO YEARS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL.
Ordinance No. 91-12 and Ordinance No. 91-13 were approved on a motion
made by Mayor Pro Tem Cokinos and seconded by Councilman Goodson.

Councilman Goodson expressed appreciation for the opportunity of
attending a presentation Friday night by Habitat Humanities who is
building a home in Beaumont for a lady and her daughter. He said
Habitat Humanities in a non-profit organization using volunteer labor to
offer affordable housing to people who could not otherwise own a home
and added that the cost of the house they are building is in the price
range of the affordable housing project planned in Beaumont for the
Charlton-Pollard area.
Councilman Alter publicly thanked the Port Arthur City Council for their
hospitality at lunch today.
Mayor Pro Tem. Cokinos reported it was a pleasure to represent the Mayor
and Council at a ribbon cutting for the Career Center named in honor of
former Beaumont Independent School Superintendent, Dr. Mike Taylor.
Councilman Moore asked that the problem of stagnant water in the ditches
at Waco and Hebert Streets be addressed and removed and said there is a
problem requiring the City to continually flush out a sewer line at 3297
Martin Luther King, Jr. Parkway that needs a permanent rather than
temporary solution.
Councilman Samuel extended gratitude to the staff at the Civic Center
for good scheduling of events such as the play, Tell Pharoah, performed
at the Julie Rogers Theater. He also thanked staff and Sterling Pruitt,
Director of Administrative Services, for prompt attention to a problem
concerning LeBlanc Road reported by Mr. Roy LeBlanc and requested the
Street Department to give a schedule update regarding work commencement
on Cleveland Street near the James Bowie School.
Councilman Smith highly complimented the performance by the Laini Kuumba
Ngoma Dance Troupe, especially the four children of the Journee family,
who performed for two hours February 12th at the Art Museum.
Mayor Lord reported that lunch with the Port Arthur City Council and
Mayor was very nice and meetings such as this afford opportunities to
discover that all our problems are not isolated, but regional, and
present an atmosphere for an exchange of ideas in search of solutions.
Also, she said she had the pleasure of cutting the ribbon at the Murry
J. Frank Planetarium this weekend and asked that she and Councilmembers
receive like calendars of events to cross compare appropriateness of
attendance and not miss an event of interest or importance.

Mr. Bill Cooley, 6725 Eastex Freeway, addressed Council regarding a drug
and alcohol-free teen center he has established in the Rosedale Shopping
Center and complained of a neighbor filing complaints with the Police
Department. Mayor Lord advised Mr. Cooley to leave his telephone number
with the City Attorney or City Clerk and told him his complaint would be
researched and a response given him.

Mrs. Zohreh Shahrodi addressed Council to discuss the sale of property
at Gill and Magnolia. Mayor Lord reported to Mrs. Shahrodi that item
had been deferred last week until more information could be obtained and
the information had not been received.

There being no other business, the Regular Session of City Council was
adjourned to reconvene for the Work Shop Session to be followed by an
Executive Session.
