CITY COUNCIL - CITY OF BEAUMONT
HELD JANUARY 15, 1991 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 15th day of January, 1991, with the
following present:

The Invocation was given by the Reverend Rayfield Walker, West
Tabernacle Missionary Baptist Church.
The Pledge of Allegiance was led by Boy Scout Mark Wolfe of Troop 221.
Mark attended Council as part of a requirement for earning a Boy Scout
merit badge.

One Proclamation was issued: "Dr. Martin Luther Ring, Jr. Day,11 January
19, 1991.

Mrs. Debbie Gill, Project Coordinator for the Home Sweet Home Military
Support Club, reported to Mayor Lord and Council that copies of the
Proclamation issued on November 6, 1990 in support of their club sending
share packages and letters to the Armed Forces personnel serving in
Saudi Arabia was sent to over 100 military units in Saudi Arabia. She
said several thank-you letters have been received from soldiers and read
portions of two.
Mrs. Gill delivered a presentation to Mayor Lord:
"The 363rd Tactical Fighter Wing, Commander Citizenship Award, presented
to Evelyn M. Lord, Mayor of the City of Beaumont, Texas. This award is

given to you on the 11th of December, 1990 in recognition for your
patriotic generosity, involvement, and thoughtfulness during Operation
Desert Shield. Your support exemplifies the spirit of democracy, and we
commend you for your act of citizenship to our country. I am proud to
present this citation to you as a fine example for your family, school
and community. "
Mayor Lord expressed her appreciation and thanks to Mrs. Gill, and in
accepting the award said, "it is particularly touching that it should be
delivered today. " (the deadline for Iraqi President Saddam Hussein to
remove his military forces out of Kuwait)
To date, between four and five tons of items have been sent to the
military in Saudi Arabia by the Home Sweet Home Military Support Club.

Citizen comment was invited on the Consent and Main agendas. No one
wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held January
8, 1991; and
Resolution No. 91-10 appointing Bobbie Patterson to the Community
Development Advisory Commission for a term expiring May 31, 1991;
reappointing Gearld C. Clark to the Small Business Revolving Loan Fund
Advisory Commission for a term expiring December 31, 1992 ; and Charles
Gibbs to the Sister City Commission for a term expiring December 31,
1992 .
The Consent Agenda was approved on a motion made by Councilman Alter and
seconded by Mayor Pro Tem Cokinos.

Mayor Lord introduced Assistant City Attorney Joe Sanders, sitting in
for City Attorney Lane Nichols as legal counsel.

Resolution No. 91-11 authorizing acceptance of the work performed by
Cutler Repaving, Inc. for the recycling and repaving of 20 sections
(Corley, Houston to M.L. King; Sabine Pass, M.L. King to Harriot;
Blanchette, Neches to M.L. King; Blanchette, Victoria to Avenue C;
Franklin, Orange to 4th; Franklin, Johns to Main; Avenue A, College to

Washington; Avenue E, Elgie to Washington; Fillmore, Magnolia to
Harding; East Lucas, Eastex to Magnolia; Delaware, Eastex to West Lucas;
11th, IH-10 to Smart; 11th, Hollywood to College; McFaddin, 11th to 6th;
Gulf, IH-10 to North; Magnolia, IH-10 to Leight; Pine, Liveoak to IH-10;
Calder-Phelan to Marceline/Long to Phelan; 4th, Calder to Fannett; and
Park, North to College) in the first phase of the 1990 Street
Maintenance and Rehabilitation Program, with Change Order No. 2 reducing
the contract cost $86,756. 05 by adjusting estimates to reflect the as-
built quantities of materials used, and authorizing final payment in the
amount of $92,464.84 of the $1, 378,454.80 completed project was approved
on a motion made by Councilman Moore and seconded by Councilman Smith.

Resolution No. 91-12 authorizing a contract with Norman Materials
Construction Co. of Orange in the amount of $628,889.50 for
reconstruction of Walden Road as a 22-foot-wide concrete street, from IH-
10, 2260 linear feet west and 930 linear feet east, as a project of the
Major street Rehabilitation Program was approved on a motion made by
Mayor Pro Tem Cokinos and seconded by Councilman Goodson.

Resolution No. 91-13 authorizing purchase of Parcel 164-B: 0.987 acres
of land out of the Hezekiah Williams Survey, Abstract No. 56, on the
south side of Bluebonnet to the east side of Major Drive, from the
Beaumont Community Church, dba Beaumont Bible Church for the appraised
value of $9, 870. 00 for the widening and improvement of Major Drive
(FM364) north of Dishman Road was approved on a motion made by
Councilman Alter and seconded by Councilman Goodson.

Ordinance No. 91-6 amending Chapter 11 of the City Code relating to
issuance of food manager certificates to provide a basis for reciprocity
in accepting training and certification by other approved agencies as
equivalent to the training course and testing administered by the City
and changing the regulatory authority from the Health Department to the
Public Safety Director or his designee was considered:

CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO
AMEND THE REGULATIONS CONCERNING FOOD SERVICE
MANAGER'S CERTIFICATION; CHANGING THE DEFINITION
OF "REGULATORY AUTHORITY;" PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING
A PENALTY.

Ordinance No. 91-6 was approved on a motion made by Councilman Samuel
and seconded by Councilman Alter.

Councilman Goodson thanked everyone for their prayers and support of our
military troops in the Middle East and asked them to continue.
Councilman Alter echoed Councilman Goodson's remarks, congratulated Mark
Wolfe for doing an excellent job at his Bar Mitzvah, and reported that
last week he attended a function sponsored by the plant managers of all
the petro-chemical plants in the area regarding proposed installation
of a new protection system. He said that the system is "an absolute
state-of-the-art protection system that could potentially replace the
emergency broadcast system. " If it should be installed, he said it will
be the first one installed for private industry in a community. The
United States does not have one installed, but it is in use in Israel,
Germany and other countries to protect their perimeter borders against
invasion. Councilman Alter commended the plant managers for foresight
in installing the system to warn against fires or chemical spills.
Councilman Moore acknowledged Dr. Martin Luther King, Jr. 's birthday and
celebrations in the city, added his desire to find a peaceful means to
the crisis in the Middle East, inquired about the responsibility of
removing debris from streets in the Virginia Village Apartment Complex
after the recent hard rains, and reported that only half of Pradice
Street going into that complex is paved and asked that attention be
given the problem.
Councilman Samuel reported that the problems reported by Mrs. Spivey,
2990 Emile, Mrs. Samuel, 3990 South 5th Street, and Mr. Roy LeBlanc,
5650 Springdale, are being addressed and asked to whom a complaint
against a contractor for a housing rehabilitation project should be
addressed. Mr. Pruitt advised Councilman Samuel those complaints should
be forwarded to Scarlett Duplechain, Housing Services Administrator.
Councilman Samuel said he joins with other Councilmembers in prayers for
our servicemen in Saudi Arabia.
Councilman Smith said she has some drainage concerns to discuss with
Public Works Director Tom Warner after the meeting, and that she also
joins with everyone else in hoping our leaders can find a peaceful
solution to the problem in the Persian Gulf.
Mayor Lord concurred that Council, as well as the citizenry of Beaumont,
is in the same situation with concerns about the world situation, but in
a more up-beat, hopeful vein commended Channel 6 - KFDM TV, Dan Gresham
and Tom Wright for producing "The Gusher, " a special commemorating the
90th anniversary of the Spindletop oil discovery. She said there have
been calls from citizens who felt the production was very appropriate

and well done. In addition, Mayor Lord said last week was a very
special celebration with a good turnout to hear Paul N. "Red" Adair at
the drillers' lunch and a very good turnout for Michael Halbouty in the
evening. She said it was most inspiring to hear these men speak about a
subject in which we're all so interested. Mayor Lord shared that she
was among 20 mayors across the state who attended a luncheon Monday,
January 14th, with Govenor-elect Ann Richards that was unique because
governors in the past have not called upon mayors to share what the
problems were, vis-a-vis the city and the state, and how to be of
assistance. She said it was a very friendly, helpful meeting lasting
over two hours where mayors discussed problems such as economic
development, education, crime and drugs. Mayors asked the Governor not
to do at the state level what should be left for cities to do. In
addition, the mayors were introduced to top economic development
department officials and given telephone numbers with an invitation to
share any future problems they might have in that area of concern.

Mrs. Delia Harrington, 815 Willow Street, addressed Council regarding
slabs of loose pavement in the 4600 and 4700 blocks of Pine Street and
complained about a problem of raw sewage drainage from 800 Grand Street.
Mr. Henry Dannenbaum, 1567 Wall Street, discussed various subjects
including prayer services being conducted by St. Mark's Episcopal Church
and First United Methodist Church for the volatile situation in Iraq.
Mr. Raymond Chaison, 1130 Lamar, addressed Council to complain of trash
dumped in front of his property and questioned responsibility for
citing the offender. Mayor Lord told Mr. Chaison, the problem would be
researched and a response given him.
Mr. James Creamer, 3920 Ector, addressed Council to ask for help with
his new business, Guard Dog Security, which he would like to change to a
guard dog training center to work in conjunction with drug detection
programs. Mr. Creamer was asked to leave his telephone number with the
City Clerk's office and information regarding agencies that might be
able to assist will be communicated to him.
