CITY COUNCIL CHAMBERS
HELD DECEMBER 11, 1990 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 11th day of December, 1990, with the
following present:

The Invocation was given by the Reverend James Blackwell, South Park
Baptist Church.
The Pledge of Allegiance was led by City Clerk Rosemarie Chiappetta.

Mayor Lord announced that a Proclamation will be issued when the
recipient arrives.

Citizen comment was invited on the Consent and Main Agenda Items No. 2
through 7. No one wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the Regular Session of City Council conducted
November 27, 1990;
Resolution No. 90-266 authorizing Texas Commerce Bank to pledge
$5, 010,512 .85 and release $4,200, 000. 00 in securities held at the
Federal Reserve Bank-Dallas/Houston Branch;

Resolution No. 90-267 appointing Bill Kimbrough and Rob Clark to the
Planning Commission for terms expiring July 31, 1993, Samuel Pullig and
Mary Jane Buttrill to the Historical Landmark Commission for terms
ending October 31, 1992 and Dr. Walter Sutton, Milton Bell, Gaylyn
Cooper, and Johnny Walker to the Historical Landmark Commission for
terms expiring October 31, 1991.
The Consent Agenda was approved on a motion made by Mayor Pro Tem
Cokinos and seconded by Councilman Goodson.

An Ordinance granting a Specific Use Permit, as requested by Charles
"Bo" Falgout and Cathy Falgout, for a drinking place/nightclub to be
know as the "Oasis Club" in leased space in the Rosedale Shopping
Center, 6725 Eastex Freeway, zone GC-MD (General Commercial--Multiple
Family Dwelling) was considered:
AN ORDINANCE
ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE
PERMIT TO ALLOW A DRINKING PLACE/NIGHTCLUB
WITHIN A GC-MD (GENERAL COMMERCIAL MULTIPLE-
FAMILY DWELLING) ON PROPERTY LOCATED AT
6725 EASTEX FREEWAY (ROSEDALE SHOPPING
CENTER) , BEAUMONT, JEFFERSON COUNTY, TEXAS.
The Ordinance was denied on a motion made by Mayor Lord and seconded by
Councilman Smith.

Mayor Lord acknowledged the arrival of country and western singer Mark
Chesnutt and introduced those accompanying him: Mr. Stan Byrd, Manager
for Mark, Tony Tamburrano, Road Manager, Joe Ladd, associated with
management, Mr. Don Jacobs, Publicist for Mark, Mr. Ken Ritter, friend
and former mayor of Beaumont, Mrs. Norma Chesnutt, Mark's mother, and
his brother Bobby Chesnutt, Jr.
Mayor Lord read the following Proclamation:
WHEREAS, from the time he was five years old and his father's
guitar was as big as he was, Mark Chesnutt's life has been country
music; and,
WHEREAS, a love of country music has brought this native Beaumonter
from his first band in junior high school to sold out club dates and
opening slots for country stalwarts like George Jones, Merle Haggard,
Reba McEntire and George Strait; and,

WHEREAS, it has taken only one single--"Too Cold At Home"--to
catapult our Texas-bred baritone, Mark Chesnutt, from new act to veteran
and profitable touring artist; and,
WHEREAS, enthusiasm of fans for his popular single and video gained
the attention of national talent buyers and telescoped Mark Chesnutt Is
original touring schedule and release of his first album, also called
"Too Close At Home, " which has already sold more than 200, 000 copies;
and,
WHEREAS, the City of Beaumont is proud of the accomplishments of
Mark Chesnutt, and as a gesture of admiration and appreciation, does
hereby extend to him a warm "welcome home;" and,
WHEREAS, we applaud Mark Chesnutt for bringing positive fame and
recognition to himself, his music, and his hometown - Beaumont, Texas.
NOW, THEREFORE, I, Evelyn M. Lord, Mayor of the City of Beaumont,
do hereby recognize
"MARK CHESNUTT"
and call upon all citizens to join me in expressing pride in his career
accomplishments and in honoring our hometown country star.

In addition to presenting the Proclamation to Mark, Mayor Lord gave Mark
a City of Beaumont lapel pin.
Mark, in turn, presented Mayor Lord with an autographed, framed picture
of the two of them together wearing matching cowboy hats.
Mayor Lord expressed her appreciation and said the photo will hang on
the wall of her office. She said "this is a big day for a lot of us, "
and acknowledged the efforts and enjoyment her secretary, Barbara
Boudreaux, has had in helping to arrange this presentation.

Professor Doris Wellan, Students in Free Enterprise (SIFE) Advisor and
Assistant Professor of Management-Marketing at Lamar University, and
members of the SIFE team presented Council with the results of a survey
they conducted for the "Buy Beaumont" campaign in cooperation with the
Beaumont Chamber of Commerce. The purpose of the "Buy Beaumont" project
is to convey to citizens a better understanding of current economic
issues and a greater appreciation for the free enterprise system. The
project will be continued next semester.

Resolution No. 90-268 authorizing purchase of Parcel 3: 0. 1653 acre
out of Lot 508, Block 65, of the Beaumont Townsite, Noah Tevis Survey,
Abstract 52, in the amount of $75,000. 00 and Parcel 4: 0. 1648 acre out
of Lot 507, Block 65, of the Beaumont Townsite, Noah Tevis Survey,
Abstract 52, in the amount of $6, 102. 00 from Dr. Edward D. Pernetter for
right-of-way needed for the College-Wall Connector which will channel
westbound traffic on College through a new underpass at Wall Street to
be constructed as part of the Martin Luther King, Jr. Parkway project
was approved on a motion made by Councilman Moore and seconded by
Councilman Smith.

Public Works Director Tom Warner distributed maps to Council of the
College-Wall Connector Project and presented an progress update of the
project. Mr. Warner said the construction bids will be advertised on
January 7, 1991, opened on January 28, 1991, submitted to Council on
February 15, 1991, and construction is scheduled to begin about February
18, 1991.

Resolution No. 90-269 authorizing a five-year lease contract with the
Neches Valley Producers Association for 2 .72 acres of land to operate
the Farmers Market at 2095 St. Helena Street for a token rental of $1. 00
per year with provision for the Association to assume responsibility for
maintenance of the building, grounds and parking area and to supply
general liability insurance in the amount of $500,000. 00 was approved on
a motion made by Councilman Alter and seconded by Councilman Smith.

Resolution No. 90-270 authorizing a five-year agreement with the
Beaumont Association for Senior Citizens for its program of activities
to be conducted in the north wing of the Best Years Senior Center at 780
S. Fourth Street for a token payment of $1. 00 per year with a condition
requiring general liability insurance coverage in the amount of
$500, 000. 00 was approved on a motion made by Mayor Pro Tem. Cokinos and
seconded by Councilman Alter.

Resolution No. 90-271 authorizing purchase of a two-cubic-yard dump
truck equipped with an electric winch and lockable storage compartments
from Wickersham Ford of Orange, Texas, in the amount of $20,951. 00 for
use by the Street and Drainage Department as an after-hours standby
truck was approved on a motion made by Councilman Alter and seconded by
Councilman Smith.

Resolution No. 90-272 authorizing renewal of the City Library System's
membership in the Houston Area Library Automated Network (HALAN) , which
provides support services for operation of libraries and interlibrary
loans, for the Fiscal Year 1990-91, at a cost of $12, 357. 00 was approved
on a motion made by Councilman Samuel and seconded by Mayor Pro Tem
Cokinos.

Resolution No. 90-273 authorizing a contract for furnishing liquid
polymer flocculent for the Water Reclamation Plant with Polypure
Incorporated of Parsippany, New Jersey, at a cost of $0. 109 per pound
($6. 99 per dry ton) was approved on a motion made by Mayor Pro Tem
Cokinos and seconded by Councilman Alter.

Councilman Goodson relayed disappointment in not being able to attend
the National League of Cities Conference, but said he was happy to have
attended Mayor Lord's birthday party yesterday.
Councilman Alter congratulation the Convention and visitor's Advisory
Committee and staff for a wonderful Babe Zaharias Female Athlete of the
Year Award ceremony last week. Councilman Alter very highly
complimented this first effort.
Mayor Lord added that compliments should be added to the catering staff
and all of the personnel involved in making the evening a success.
Mayor Lord said many compliments were received on everything, including
the food.
Mayor Pro Tem Cokinos extended birthday wishes to Mayor Lord.
Councilman Moore commented that the National League of Cities Conference
conducted last week was very productive and Council has brought back
ideas to use in Beaumont, complimented the last "Sunday in the Park"
activities and the Babe Zaharias award ceremony, and asked the City
Manager to inform Louis Hiltpold, Parks Manager, that lights are out at
Liberia Park, and complimented City staff for their preparation for the
NAACP banquet at the Civic Center.
Councilman Samuel extended birthday wishes to Mayor Lord and concurred
the National League of Cities Conference was very productive and feels
some of the ideas learned can help some of the concerns in Beaumont.
Councilman Smith added birthday greeting to Mayor Lord, commented that
the problems other cities have are common to those in Beaumont and there
are many challenges, especially the rising cost of health care.

Councilman Smith congratulated the Convention and Visitors Bureau for
spearheading such a fantastic Babe Zaharias award ceremony, and reported
that at the last "Sunday in the Park" for the season, Mayor Lord read
'Twas The Night Before Christmas to the children, and the Southeast
Texas Arts Council were sponsors of the activities and entertainment.
Mayor Lord echoed the complimentary comments about the Convention and
Visitors Bureau and told Council that Mr. Mike Orcutt of Regina Howell
Elementary School personally come to the administrative offices to thank
Council for participation in the "Jump Rope for Heart" campaign.

Mr. Larry Gouthier, 5926 Greenmoor, addressed Council to express his
concern about gang formation in Beaumont and reported that his ten-year-
old son has been approached to join a gang.
Mr. Henry Dannenbaum, 1567 Wall, wished Mayor Lord a happy birthday and
McBride House is in need of donations.
Mr. and Mrs. George Bishop, 5750 Cole Road, thanked Council for denial
of an ordinance to rezone space in the Rosedale Shopping Center for a
drinking place/nightclub.
