BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 25th day of September, 1990, with the
following present:

The Invocation was given by the Reverend Michael Welborn, St. George' s
Orthodox Church.
The Pledge of Allegiance was led by Councilman Goodson.

Mayor Pro Tem Cokinos announced that Mayor Lord is in Buenos Aires,
Argentina, attending the Fourth Conference of the Great Cities of the
Americas, and that City Manager Riley is attending the International
Conference of City Managers in Fort Worth, Texas, and welcomed Chief
Pete Shelton as Acting City Manager for today's meeting.

One Proclamation was issued: "National Arts Week, " September 23-29,
1990.

Public comment was invited on the Consent Agenda and Main Agenda Items 1
through 7. No one wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the Regular Session of City Council conducted
September 18, 1990;
Resolution No. 90-206 appointing Marilyn Johnson to the Beaumont
Advisory Committee for the Prevention of Child Abuse and Neglect for a
term expiring June 30, 1992 and Sheila Stewart to the Convention and
Tourism Advisory Committee for a term expiring July 31, 1992 ;
Resolution No. 90-207 authorizing a License to Encroach Agreement with
Carlos and Eneida Arroya to allow them to encroach onto the west 85 feet
of Lot 15, Block 12 of Delaware Place, Section Two, and the east 60 feet
of a 20-foot utility easement at the rear of 4770 Littlefield where
improvements have been built for a one-time fee of $500. 00;
Resolution No. 90-208 authorizing purchase of approximately 44,000
pounds of asphalt crack sealing compound at $.31 per pound for an
estimated total of $13 , 040 from Crafco, Texas, Inc. of San Antonio; and
Resolution No. 90-209 authorizing purchase of a stabilized day-night
monocular for the Police Department (to be used in investigations
involving visual surveillance at a distance or telephoto lens
photography in either daylight or darkness) from Universal Procurement
of Tempe, Arizona, for $13, 300. 00.
The Consent Agenda was approved on a motion made by Councilman Moore and
seconded by Councilman Alter.

Resolution No. 90-210 authorizing filing an application with the State
Department of Highways and Public Transportation for a $225, 000 grant
under the Traffic Management Program (a program making grants available
for projects to increase capacity of existing roadways through
application of new technology) to finance 75% of the cost of an
estimated $300, 000 project for improvement and extension of the downtown
traffic signal system for more efficient movement of traffic was
approved on a motion made by Councilman Goodson and seconded by
Councilman Smith.

Ordinance No. 90-57 amending Sections 28-100 through 28-106 of the City
Code of Ordinances, regulating disposal of industrial waste, to comply
with EPA regulations involving standards for industrial waste discharged
into the system, industrial user's wastewater discharge permits,
operating procedures and permit requirements for haulers transporting
industrial waste, enforcement procedures and penalties was considered:

ORDINANCE NO. 90-57
ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
BY REPEALING, SECTIONS 28-200 THROUGH 28-106,
AND ENACTING NEW SECTIONS 28-100 THROUGH 28-
106, REGULATING THE DISPOSAL OF INDUSTRIAL
WASTE IN THE CITY OF BEAUMONT; THE USE OF
PUBLIC AND PRIVATE SEWERS AND DRAINS; THE
REMOVAL AND DISPOSAL OF WASTEWATER FROM
HOLDING TANKS; PROVIDING A PENALTY; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH: AND
PROVIDING FOR SEVERABILITY.
Ordinance No. 90-57 was approved on a motion made by Councilman Smith
and seconded by Councilman Moore.

Resolution No. 90-211 authorizing a one-year extension of a street
sweeping contract with Browning-Ferris Industries for 31 miles of
downtown streets once per week and 151 miles of arterial streets once
per month at $16.99 per curb mile for downtown streets (Central Business
District) and $27. 12 per curb mile for arterial streets and $93 . 00 per
hour for extra sweeping scheduled in advance and $137. 00 per hour for
unscheduled extra work, effective October 1, 1990 to September 30, 1991,
was approved on a motion made by Councilman Goodson and seconded by
Councilman Smith.

Resolution No. 90-212 authorizing purchase of computer equipment
consisting of three (3) 3477FA3 display stations, seventeen (17) 3467EA3
display stations, three (3) quickwriter printers, one remote control
unit and a five year maintenance agreement in the amount of $27,735.95
from IBM Corporation of Beaumont, and one (1) twinaxil workstation
controller, two (2) 9600 BPS digital modems and a five year maintenance
agreement from Nationwide Computer of Deerfield Beach, Florida, in the
amount of $5, 130. 00 was approved on a motion made by Councilman Alter
and seconded by Councilman Smith.

Resolution No. 90-213 authorizing purchase of 30 one-and-one-half inch
water meters in the amount of $5,400.00 ($180 each) and 30 two-inch

water meters in the amount of $7,357.50 ($245.25 each) for a total of
$12,757. 50 from Big State Utility, Inc. of Lufkin, and 100 five-eighths
X-three quarters inch meters in the amount of $2,733 . 00 ($27. 33 each)
and 100 one-inch meters in the amount of $6,807 . 00 ($98. 07 each) for a
total of $9,540. 00 from A & P Water and Sewer Supply. Inc. of Missouri
City, Texas, was approved on a motion made by Councilman Smith and
seconded by Councilman Goodson.

Resolution No. 90-214 awarding an annual contract for furnishing work
uniforms (450 men's long sleeve shirts, $7. 67 each; 50 women's long
sleeve shirts, $8. 05 each; 490 men's short sleeve shirts, $6.50 each; 50
women's short sleeve shirts, $6.85 each; 450 men' s pants/regular style
$10.40 each; 450 men's pants/jean cut style, $10.40 each; 100 ladies
pants, $11.20 each; 10 long sleeve coveralls, $17 .75 each; 10 short
sleeve coveralls, $17 .25 each; 10 long sleeve speedsuits, $17. 05 each;
10 short sleeve speedsuits, $15.95 each; 120 jackets, $18.95 each, 115
caps, $1. 55; 10 lab coats, $11. 30 each; 10 ladies smocks, $8.75 each;
and 1320 emblems, $. 60 each) for various City departments to Shepherd's
Uniform and Linen Supply Company for estimated quantities in the amount
of $21,986. 25 was approved on a motion made by Councilman Alter and
seconded by Councilman Smith.

Resolution No. 90-215 establishing the salary of the City Manager at
$90,000 annually, plus a $500 a month car allowance and all existing
benefits, the City Attorney at $68,250 annually, plus $250 a month car
allowance and all existing benefits, the City Clerk at $35, 000 annually
and all existing benefits, and the Municipal Court Magistrate at $300
for the first court session conducted in a given week, plus $100 for
each additional session conducted in the same week, up to a maximum of
$700 per week was approved on a motion made by Councilman Goodson and
seconded by Councilman Smith.

Structure Ordinance, Article III, Section 14:50:

These parcels of property have been inspected, are vacant, and found to
be in violation of Article III, Section 14-50 of the Code of Ordinances.
Notices have been sent to owners by Certified Mail and published in the
Beaumont Enterprise.
The twenty-four (24) structures listed below have been condemned by City
Council and the owners ordered to either raze or repair them within
specified time frames. Reinspection of these structures have revealed
non-compliance with the Council 's order. The Public Safety Department
is requesting authorization from City Council to demolish these
structures in accordance with the Dangerous Structure Ordinance and
charge the property owners with the cost of demolition.

There being no one to address Council, the public hearing was closed.
Ordinance No. 90-58 declaring certain dilapidated structures to be
public nuisances and ordering their repair or removal by their owners
was considered:

ENTITLED AN ORDINANCE FINDING CERTAIN
STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING
THEIR REPAIR OR DEMOLITION; PROVIDING FOR
SEVERABILITY AND PROVIDING FOR A PENALTY.
Ordinance No. 90-58 was approved on a motion made by Councilman Smith
and seconded by Councilman Moore.

Councilman Goodson reported that he was given the opportunity to address
the DAR at their monthly meeting and they expressed how much they
appreciated the City' s involvement in Constitution Week and for the
proclamation they received.
Councilman Alter encouraged everyone to attend a party at Riverfront
Park, Sunday, September 30, in support of all the military personnel at
the Port of Beaumont assisting with Operation Desert Shield.
Councilman Samuel said he attended a very enlightening function this
past weekend for the Knights of Peter Claver and thanked everyone
participating in that program. Councilman Samuel received a complaint
from Mr. Johnson at 1980 Turon regarding stray dogs and asked that that
problem be addressed.
Councilman Moore shared an idea that perhaps consideration should be
given to a parade on Veteran's Day in view of the military Port activity
and asked that appropriate personnel be approached.

Mr. Jack Tinkle, 410 North Major Drive, addressed Council regarding the
economic effect of various businesses leaving Beaumont, signs at Larry's
Antique Mall, members of his family owning businesses and prospects of
opening another bank.
Mr. Reynaldo Flores, 1235 Threadneedle, reported an incident involving
he and a youngster on a skateboard. He questioned pedestrian right-of-
way and passage of an ordinance specifically declaring right-of-way.
Mayor Pro Tem Cokinos directed Mr. Flores to speak with the City
Attorney' s office.
Mr. Forrest "Ted" Posey, 3695 Edmonds, discussed taxes and city services
and suggested public transportation for three hours in the morning and
three hours in the afternoon on Sunday for a more economical way to
attend church, due to the great price increase for gasoline.
Mr. Henry Dannenbaum, 1567 Wall, expressed his opinion regarding school

children riding the buses and expressed appreciation for the Port
activity and the Police Department.
