Consider a request for amendments to Section 30-23.1, Major/Dowlen/Gladys/ Highway 105 Sign Overlay District Regulations - Ordinance 04-043 The Planning Manager recommended approval of the suggested changes to Sec. 30.23.1 as recommended by the Planning Commission on June 21, 2004. 1) Definitions (30-23 Sec. 1(b)): Definitions for attention getting devices, frontage, advertising sign,banner sign,owner identification sign and pennant sign were added for clarification purposes. (Pages 1-3) 2) Prohibited Signs (30-23 Sec. 1(f)2):The words"In addition to the prohibited signs listed in 30-28(f)" were added to cross-reference the overlay regulations with the overall city regulations. (Page 6) Page 2 of 15 Minutes-June 29,2004 3)Prohibited Signs(30-23 Sec. 1(f)2):The words"off premise"were deleted to make the section consistent with the rest of the Zoning Ordinance. (Page 6) 4)Prohibited Signs(30-23 Sec. 1(f)2):The visible after-hour parking of vehicles with owner identification signs on them would be allowed. Therefore,they are being struck from the prohibited sign section. (Page 7) 5)Single Tenant Signs(30-23 Sec. 1(f)5):To allow business establishments the ability to adequately identify themselves to the traveling public,wording was added to allow developments with 80,000 sq. ft. or greater or developments with 600'of frontage an additional sign per street frontage. (Page 10) 7)Exemptions(30-23 Sec. 1(g)):The words"These vehicles shall not be parked after hours so as to be seen from the street."have been struck. This would allow a vehicle with the businesses name printed on it to be visibly parked after hours. (Page 12) 8) Exemptions (30-23 Sec. 1(g)): The words "or runoff election, if applicable" have been added to allow runoff election signs to remain until 10 days afterthe final election. (Page 13) 9)Exemptions(30-23 Sec. 1(g)):Banner signs attachedto a building will be permitted without permits and with no size ortime limitations. Currently,attached banners are limited to size and display time. Detached banner signs would be permitted for longer time periods. These longer periods of time would allow an establishment to advertise promotionals more efficiently. Detached banner signs would be allowed to be displayed five(5)times per calendar yearforthirty(30)consecutive days at a time with one thirty(30)day extension allowed for a total of sixty(60)days. For each permit,a fifty(50)dollar fee will be charged. No banner sign shall be placed on city right-of-way. Banner signs shall be supported y non-permanent supports that are not permanently set in the ground. The supports shall be removed with the sign atthe expiration of each allowed time period. (Page 13) 10)Exemptions(30-23 Sec. 1(g)):Wording was added to allow attached advertising signs that are located on non-profit recreational facilities. (Page 14) At a Joint Public Hearing held June 21,2004,the Planning Commission voted 9:0 to approve the recommended changes to Sec. 30-23.1. COuncilmemberCokinos moved to ADOPT ORDINANCE NO.04-043 AMENDING CHAPTER 30, SECTION 30-23.1 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO AMEND REGULATIONS FOR THE MAJOR/DOWLEN/GLADYS/HWY. 105 SIGN OVERLAY DISTRICT. Consider a request for a specific use permit to allow guest quarters in an RS (Residential Single Family Dwelling) District at 60121 st Street-Ordinance 04-044 Administration recommended approval of a specific use permit to allowguest quarters in an RS (Residential Single Family Dwelling) District at 601 21St Street with modifications as recommended by the Planning Committee. Dave and Bonnie Faul,the property owners,wish to construct a new double car garage with a second story guest quarters on the rear of their property at 60121 st Street. The upper level will include one bedroom and one bath. At a Joint Public Hearing held on June 21,2004,the Planning Commission voted 9:0 to approve a specific use permit to allow guest quarters in an RS (Residential Single Family Dwelling) District at 601 21St Street subject to: 1. No rental of the guest quarters; 2. Moving the structure 1.5'to the south or get a variance to the side setback from the Board of Adjustment; 3. A modification of the structure size from 28' x 28' to 28' x 30'. Councilmember Smith moved to ADOPT ORDINANCE 04-044 GRANTING ASPECIFIC USE PERMIT TO ALLOW GUEST QUARTERS IN AN RS(RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT LOCATED AT 601 21ST STREET IN THE CITY OF BEAUMONT. Consider a request for a specific use permit to allow an indoor shooting range and retail store in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District located approximately 1,000 feet south of the southeast corner of Major Drive and the Folsom Extension - Ordinance 04-045 Administration recommended approval of a specific use permit to allow an indoor shooting range and retail store in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2)District located approximately 1,000 feet south of the southeast corner of Page 4 of 15 Minutes-June 29,2004 Major Drive and the Folsom Extension with modifications as recommended by the Planning Committee. RCSS Properties, Ltd.,the applicant, is buying a 2 acre tract of land on the east side of N. Major Drive, in order to build and operate an indoor shooting range. The applicant states that the retail area and the shooting range will be separated by a solid masonry wall with 1/4"bullet resistant glass to facilitate viewing of the shooting area. The shooting range will consist of solid masonry walls with heavy gauge steel plating overhead so no bullets can escape to the outside. In February, 2004, City Council approved an amendment to the City Code of Ordinances, Sec. 18-7, to allow for indoor firearm ranges. At a Joint Public Hearing held on June 21,2004,the Planning Commission voted 9:0 to approve a specific use permit to allow an indoor shooting range and retail store in a GC-MD-2 District subject to: 1. Providing an 8"tall wood screening fence and a minimum 10' landscape strip along the east property line; 2. Providing a 6" wide landscape strip along the parking lot frontage; and with a modification to the landscaping/screening requirements along the south property line. Councilmember Smith moved tO ADOPTORDINANCE 04-045 GRANTING ASPECIFIC USE PERMIT TO ALLOW AN INDOOR SHOOTING RANGE AND RETAIL STORE IN A GC-MD2 (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-2) DISTRICT LOCATED AT APPROXIMATELY 1,000 FEET SOUTH OF THE SOUTHEAST CORNER OF MAJOR DRIVE AND THE FOLSOM EXTENSION. Consider a request for a specific use permit to allow a two-family residence in an RS (Residential Single Family Dwelling)District at 4460 Diamond Street-Ordinance 04- 046 Administration recommended approval of a specific use permit to allow a two-family residence in an RS (Residential Single Family Dwelling) District at 4460 Diamond Street subject to neither being used as a rental property. Timmy Singleton is seeking a specific use permit to allow the construction of an attached addition to his mother's home at4460 Diamond. The two story addition will be attached at the rear of the existing house and will have a common wall but a Page 5 of 15 Minutes-June 29,2004 separate entrance. A two family residence is permitted in an RS District with a specific use permit. At a Joint Public Hearing held on June 21,2004,the Planning Commission voted 9:0 to approve a specific use permit to allow a two-family residence in an RS(Residential Single Family Dwelling)District at 4460 Diamond Street subject to neither unit being used as a rental property. Councilmember Beaulieu moved to APPROVE ORDINANCE 04-046 GRANTING ASPECIFIC USE PERMIT TO ALLOW AN ATTACHED TWO-FAMILY RESIDENCE IN AN RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT LOCATED AT 4460 DIAMOND STREET. Councilmember Smith seconded the motion. AYES: MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 5. Consider a request for a specific use permit to allow a re-upholstery and furniture repair business in an RCR(Residential Conservation and Revitalization) District at 1801 North Street - Ordinance 04-047 Administration recommended approval of a specific use permitto allow a re-upholstery and furniture repair in an RCR(Residential Conservation and Revitalization)District at 1801 North Street with a modification to the landscaping/screening requirements along the north and west sides of the property. There is an existing commercial building on the subject property. There is an existing 6' tall wood screening fence along the west side of the property and a 4' tall wood screening fence along the north side of the property. Gonzalo Estrada,the applicant, is requesting modification to the landscaping/screening requirements along these boundaries. At a Joint Public Hearing held on June 21,2004,the Planning Commission voted 9:0 to approve a specific use permit to allow a re-upholstery and furniture repair business in an RCR(Residential Conservation and Revitalization)District at 1801 North Street with a modification to the landscaping/screening requirements along the north and west sides of the property. Councilmember Smith moved to APPROVE ORDINANCE 04-047 GRANTING ASPECIFIC USE PERMIT TO ALLOW A RE-UPHOLSTERY AND FURNITURE REPAIR SHOP IN AN RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION)DISTRICT LOCATED AT 1801 NORTH STREET. Consider a request for a specific use permit to allow a rooming house in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 2135 Victoria - Ordinance 04-048 Administration recommended approval of a specific use permit to allow a rooming house in an RM-H (Residential Multiple Family Dwelling-Highest Density)District at 2135 Victoria. Betty Tucker and Tom Clark are the property owners. The property is the former site of the Women and Children's Shelter. The Women and Children's Shelter moved from this location approximately two years ago. After the Planning Division received a complaint,an inspection was made by the staff. It was determined that the property was being illegally used as a rooming house. A rooming house requires a specific use permit in an RM-H District. At a Joint Public Hearing held on June 21,2004,the Planning Commission voted 7:2 to approve a specific use permit to allow a rooming house in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 2135 Victoria. Council member Cokinos moved to APPROVE ORDINANCE 04-048 GRANTING ASPECIFIC USE PERMIT TO ALLOW A ROOMING HOUSE IN AN RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT LOCATED AT 2135 VICTORIA. Councilmember Smith seconded the motion. AYES: MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 7. Consider a request for an amended specific use permit to allow a gymnastics/cheerleading instruction and a family entertainment center in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 7575 and 7595 Highway 105 - Ordinance 04-049 Administration recommended approval of an amended specific use permit to allow a gymnastics/cheering instruction and a family entertainment center in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 7575 and 7595 Highway 105. Marlon Quibodeaux was granted a specific use permit for expansion of the facility onto the adjacent property at 7575 Highway 105 in 2002. Mr. Quibodeaux states that Phase I would involve converting the larger of the two existing buildings into a family Page 7 of 15 Minutes-June 29,2004 entertainment center. The smaller building would continue to be used for gymnastics and cheerleading. Phase 2 would include converting the smaller building into a"Ball Zone." Phase 3 would include tearing down the house at 7575 Highway 105 and using the property for outdoor events/competitions and parking. At a Joint Public Hearing held on June 21,2004,the Planning Commission voted 9:0 to approve an amended specific use permit to allow a gymnastics/cheerleading instruction and a family entertainment center in an RM-H(Residential Multiple Family Dwelling-Highest Density) District at 7575 and 7595 Highway 105 with a stipulation that the existing detached sign be replaced with a conforming sign. Councilmember Beaulieu moved to APPROVE ORDINANCE 04-049 GRANTING ASPECIFIC USE PERMIT TO ALLOW A GYMNASTICS/CHEERING INSTRUCTION AND A FAMILY CENTER IN AN RH-M(RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY)DISTRICTAT 7575 AND 7595 HIGHWAY 105. Consider a request to abandon a 30'utility easement at the rear of 1945 Westchase Drive - Ordinance 04-050 Administration recommended approval of the request to abandon a 30' foot utility easement at the rear of 1945 Westchase Drive. Sam Parigi, managing partner of Westchase Development is requesting the abandonment of a 30'x 50'easement along the rearof 1945 Westchase Drive. There is a DD#6 drainage ditch along a portion of the east side of the Westchase Addition. The south end of this easement ends on the subject property. This abandonment was sent to all interested parties. No negative responses were received. DD#6 has agreed to the abandonment of the easement on this lot. At a Regular Meeting held on June 21,2004,the Planning Commission voted 9:0 to approve the request to abandon a 30'utility easement at the rearof 1945 Westchase Drive. Councilmember Cokinos moved to APPROVE ORDINANCE 04-050 VACATING A 30' EASEMENT AT THE REAR OF 1945 WESTCHASE DRIVE. Councilmember Smith seconded the motion. Consider a request to abandon a 600' undeveloped portion of Birmingham Street between Taylor and Fillmore Streets - Ordinance 04-051 Administration recommended approval of the request to abandon a 600'undeveloped portion of Birmingham Street between Taylor and Fillmore Streets subject to the maintaining the abandoned right-of-way as a drainage/utility easement. Roy Gorman,the applicant, would like to place a six foot fence,running east and west, in the middle of this right-of-way between Taylor and Wilson to eliminate egress. This item was sent to all interested parties. No objections have been received. However, DD#6 and a number of utility companies wished to maintain easements. At a Regular Meeting held on June 21, 2004,the Planning Commission voted 9:0 to approve the request to abandon a 600' undeveloped portion of Birmingham Street between Taylorand Fillmore Streets subjectto maintaining the abandoned right-of-way as a drainage/utility easement. Councilmember Smith moved TO ADOPT ORDINANCE 04-051 VACATING AND ABANDONING A 600'UNDEVELOPED PORTION OF BIRMINGHAM STREET BETWEEN TAYLOR AND FILLMORE STREET. Councilmember Beaulieu seconded the motion. AYES: MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 10. Consider authorizing the City Manager to increase the Water Treatment Plant 14 Million Gallons per Day(MGD)Expansion and Miscellaneous Improvements Project amount for "extra work" - Resolution 04-143 Administration recommended approval of a resolution authorizing the City Manager to increase the Water Treatment Plant 14MGD Expansion and Miscellaneous Improvements Project by$1,377,912.01 to install two additional filter units with all the related appurtenances fora complete operational system,modifythe fill beneath the chemical storage,clean debris in the chemical storage area and change the existing piping in the chemical building. On December 6, 2003, City Council awarded the contract for the Water Treatment Plant 14MGD Expansion and Miscellaneous Improvements Project in the amount of $10,290,000. Construction began in February, 2004, and at the end of May was Page 9 of 15 Minutes-June 29,2004 approximately 12 percent complete. The expansion of the plant is necessary to meet the TCEQ regulations requiring a minimum operating capacity of 40mgd. The future installation of two filter units will increase the maximum operating capacity of the plant of 50mgd. The increase in plant capacity to 50mgd will meet the projected demands of the City for the next twenty years. It has been determined that a substantial cost savings could be achieved if the two filters were installed as part of the plant expansion. Funds for this project are available in the Water Utilities Improvement Program. Councilmember Cokinos moved TO APPROVE RESOLUTION 04-143 AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE WATER TREATMENT PLANT 14 MILLION GALLONS PER DAY EXPANSION AND MISCELLANEOUS IMPROVEMENT PROJECT AMOUNT BY$1,377,912.01 FOR EXTRAWORK TO INSTALL TWO ADDITIONAL FILTER UNITS WITH RELATED APPURTENANCES. Consider approving one (1) year contracts for the purchase of water treatment chemicals - Resolution 04-144 Administration recommended award of one(1)year contracts to four(4)vendors for purchasing watertreatment chemicals at the unit cost per bid with an estimated total annual expenditure of$174,755. Bids were requested for an annual contract for water treatment chemicals for use by the Public Works Department, Water Utilities Division. The chemicals are used to disinfect and purify the water supply. The contract provides vendors to furnish water treatment chemical at the following fixed unit prices. Vendor Chemical Est. Exp. PUBLIC HEARING: Receive comments on a proposal to reallocate $13,500 from the 2000 Consolidated Block Grant Program, Charlton-Pollard Park line item, to expand swimming pool hours of operation at Alice Keith Park and Magnolia Park Public Hearing convened at 1:53 p.m. Public Hearing was conducted by City Manager Kyle Hayes. Public Comments: Allen Lee 5095 Maddox Street Beaumont TX Spoke in support of expanding the hours of the public pools Public Hearing ended at 1:58 p.m. Consider reallocating funds from the 2000 Consolidated Block Grant Program to expand swimming pool hours of operation at Alice Keith Park and Magnolia Park- Resolution 04-145 Following the Public Hearing, Councilmember Samuel moved TO APPROVE RESOLUTION 04-145 TO REALLOCATE FUNDS FROM THE 2000 CONSOLIDATED BLOCK GRANT PROGRAM TO EXPAND SWIMMING POOL HOURS OF OPERATION AT ALICE KEITH PARK AND MAGNOLIA PARK.
