BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 17th day of April, 1990, with the following present; HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Mayor Pro Tem Councilman At Large Andrew P. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Dwight Benoit, Saint Paul Baptist Church in China, Texas. The Pledge of Allegiance was led by Valencia Winfree, an Odom Middle School student participating in the Ben Rogers ' "I Have A Dream" program, whose mentor is Mrs. Evelyn Lord. -000- Five Proclamations were issued: "Community Crusade Volunteer Days, " April 26-28, 1990 (North Jefferson County American Cancer Society) ; "Cancer Survivors Day, " April 21, 1990; "Earth Day 190, " April 22, 1990; (As part of the celebration for "Earth Day, " a formal dedication of the Rose Garden at Tyrrell Park, planted and maintained by the Beaumont Rose Society, will be conducted at 2 : 00 p.m. ) "Walk America Day, " April 21, 1990 (March of Dimes for Birth Defects) ; and 1142nd Neches River Festival Week, " April 28-May 6, 1990. -000- ACADEMIC BOWL PRESENTATION MAYOR MEYERS• In pursuit of educational excellence, I am now going to turn the program over to David Moore and recognize some scholars that we have in our midst. -92- April 17, 1990 COUNCILMAN MOORE• . . .As the forecast was given, predictions were made, and few people gave them a chance, but unbeknown to most people in this community, there was a draft. An outstanding draft. A draft that found the likes of City Manager Ray Riley, Dr. Lulu Smith, the likes of Alice Womack from the Westbrook Senior High School campus, Tim Halley from the Beaumont Enterprise, Nick Lampson from the County Tax Assessor's office, Jim Stokes from the Chamber of Commerce, Stephanie Gerac from the Beaumont Hilton, and their coach, whoever the individual was. They did not give them a chance. In fact, we heard some young man very boastfully say, "we're gonna win this year. " I say they've made some technological changes. They gave them faster buttons to press this year, and members of our City Council brought pride back to City Hall and the community's leaders brought pride back to the older generation, and, therefore, we get to the point that the Academic Bowl at Lamar University was won by whom--the Community Team. (applause) . . . Councilman Moore asked Anthony Holmes, President of the Lamar University Student Government Association to make a presentation. Anthony Holmes explained that the Academic Bowl is a competition between four teams comprised of members of the community, the faculty at Lamar, Lamar students, and Lamar University administration. This year the Community Team scored 29 points and gained the championship trophy. Tim Halley became the "Most Valuable Player" by scoring the most points. Mr. Holmes presented a very large traveling trophy to the Community Team and said it would be displayed this year in the Executive offices at City Hall. Proceeds received from this competition are donated to various charitable or worthy organizations. -000- Citizen comment was invited on the Consent and Main Agendas. (AGENDA ITEM NO. 3--ART MUSEUM LEASES, DELAWARE STREET PROPERTY FORMER SITE OF TB HOSPITAL) Mr. Richard Evans, 1220 Sandwood Lane, Mrs. Violet Newton, 3230 Ashwood Lane, and Mrs. Susan Bushman, 285 East Circuit, addressed Council in opposition to the Art Museum selling the assignment of the remainder of its lease on a 20-acre tract at Delaware and French Road and expressed a desire for the property to maintained as a park. Mr. Ben Rogers, 2030 Thomas Road, addressed Council to commend Mayor Meyers and Councilman Moore for their noticeable leadership shown in the recent survey conducted by "A World of Difference" year-long program, to question the City's ability to maintain the 20-acre tract at Delaware and French Road as a park if $300, 000 was paid to the Art Museum for their assets, expressed his desire that the property be used as meditation park and his intention to work toward that goal if the City -93- April 17, 1990 would approve using the property as a park, and commended the City for recent action providing financing for affordable housing to low and moderate income persons. Mrs. Joanne Polk, 4420 Calder, President of the Board of Trustees of the Art Museum of Southeast Texas, addressed Council to convey the Museum's intention is to recover their assets of $300,000 in the land at Delaware and French Road to subsidize their latch-key programs, handicapped, seniors programs, career day, protege' , children's newsletters and other services the museum provides the community. Dr. Bruce Drury, 3555 Long, President of the Parks and Recreation Advisory Commission, addressed Council in support of making the Delaware Street property a passive park and said it could be accomplished with little cost to the City for maintenance. Dr. Drury said that citizens in the community have indicated a desire to maintain the park as a passive park and he feels that through the "Adopt A Park" program, volunteers would take care of much of the day-to-day maintenance. Mrs. Tootsie Crutchfield, 5965 Honeysuckle, a Trustee, Treasurer, and Committee Member of the Art Museum, addressed Council to explain the Museum's need to recover the $300, 000 to keep their present programs active and encouraged "anyone who wants to make a tangible community asset out of the Delaware property to please come forth. " Mr. Ben Rogers, 2030 Thomas Road, addressed Council and Mrs. Crutchfield, Spokesperson for the Art Museum, to commit $300, 000 to the Art Museum for the Delaware Street property, in honor of his wife, Julie, if the City of Beaumont will maintain it as a park. (audience applause) MAYOR MEYERS• Thank you, Ben. We' ll move on to that agenda, so everyone please stay seated, and then we' ll have the appropriate discussion at that time. We thank you for your comments, and we thank you once again for your generosity. It. . .almost reaches a point where you don't think you can say. . .thank you again, but you seem to always have something to top what you did last week. (AGENDA ITEM 4--LITTER CONTAINER PROGRAM) Mr. Barry Long, Executive Director for BUILD, Inc. , addressed Council to state the three objectives of encouraging sponsoring the litter containers in the city, i.e. increase number and available of litter containers, standardization of container design, and increase and enhance the amenities Beaumont can offer. -000- The following Consent Agenda Items were considered: -94- April 17, 1990 Approval of the Minutes of the regular City Council session held April 10, 1990; Resolution No. 90-67 appointing Mr. M. L. "Buddy" Lefler, Jr. to the Historical Landmark Commission with a term expiring October 31, 1991; and Resolution No. 90-68 authorizing eminent domain proceedings to acquire a parcel of property identified as Parcel No. 400, consisting of 6. 033 square feet out of Lots 5 and 6, Block 20, of the Calder Addition on the southeast corner of Mariposa Street and Liberty Avenue, (Schlett, Inc. , owner) needed for the Martin Luther King, Jr. Parkway/Spur 380 Project. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- No action was taken on Agenda Item No. 3 for approval on the proposal by the Art Museum of Southeast Texas to assign the remainder of its lease on a 20-acre tract at Delaware and French Road for use of some type development. After a brief short discussion concerning maintenance cost per year to maintain the property as a park, Mr. Rogers' generosity in solving an emotional situation for the City, and compliments extended to Mr. Rogers by Council for his generous and philanthropic gesture, a motion made by Councilman Smith and seconded by Councilman Cokinos was approved to accept Mr. Ben Rogers' offer to pay $300, 000 to the Art Museum for the leases of the property located at Delaware Street and French Road for City maintenance of the property as a passive park. A legal resolution will be presented to Council for official action at a later date. Question: Ayes: All Nayes: None -000- (Councilman Samuel left the Council Chambers at 2 :25 p.m. ) Resolution No. 90-69 authorizing filing of an application for Rental Rehabilitation funds to finance continuation of the City's program for making no-interest loans available for rehabilitation of rental housing in the CDBG Strategy Area for Fiscal Year 1990 from the Department of Housing and Urban Development was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 90-70 awarding a contract to Contel Corporation for maintenance of the City's telephone system in the amount of $2, 009.00 -95- April 17, 1990 per month ($24, 108. 00 per year) was approved on a motion made by Councilman Brumley and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 90-71 authorizing City participation in a uniform litter container program proposed by BUILD, Inc. and the Clean Community Commission with the City to purchase the first 88 litter containers at a cost of $13 ,200. 00, plus estimated shipping charges of $264. 00 and installation hardware for an additional $264 . 00, in Phase I of the project with the City to be reimbursed from sponsorships sold by BUILD, Inc. and the Clean Community Commission was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- The third and final reading of Ordinance No. 90-25 granting an amended franchise to Browning Ferris Industries, Inc. for a commercial garbage collection service was held: ORDINANCE NO. 90-25 ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO BROWNING FERRIS INDUSTRIES TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. Ordinance No. 90-25 was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- The third and final reading of Ordinance No. 90-26 granting an amended franchise to REM Waste Control, Inc. for a commercial garbage collection service was held: -96- April 17, 1990 ORDINANCE NO. 90-26 ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO REM WASTE CONTROL, INC. TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. Ordinance No. 90-26 was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- The third and final reading of Ordinance 90-27 granting an amended franchise to Waste Management - Golden Triangle for a commercial garbage collection service was held: ORDINANCE NO. 90-27 ENTITLED AN ORDINANCE GRANTING A FRANCHISE TO WASTE MANAGEMENT - GOLDEN TRIANGLE TO OPERATE A SOLID WASTE COLLECTION AND TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT; PROVIDING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATION OF SUCH SERVICE; PROVIDING INDEMNITY TO THE CITY; RETAINING AUTHORITY TO REGULATE RATES; PROVIDING FOR FRANCHISE PAYMENTS AND PROVIDING FOR SEVERABILITY. Ordinance No. 90-27 was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Councilman Brumley reminded everyone to remember "Earth Day, " Sunday, April 22, 1980. -000- Henry Dannenbaum, 1567 Wall Street, addressed Council to express appreciation to the young people who are dedicated to serving sack lunches at the Nutrition Center and applauded Fire Chief Pete Shelton for recently receiving the "Outstanding Citizenship Award.
