CITY COUNCIL - CITY OF BEAUMONT
HELD APRIL 10, 1990, 1:15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 10th day of April, 1990, with the
following present:

The Invocation was given by Captain Dale Efaw of the Salvation Army.
The Pledge of Allegiance was led by Councilman Smith.

Three Proclamations were issued: "Child Abuse and Neglect Prevention
Month, " April, 1990; "Sales and Marketing Clubs of Southeast Texas
Month, " April, 1990 (Fire Chief C. A. "Pete" Shelton will honored as
recipient of the Outstanding Citizenship Award at the seventh annual
banquet of the Sales and Marketing Clubs of Southeast Texas on April
11th at the Beaumont Hilton) ; and National Community Development Week, "
April 7-14, 1990 (Special recognition was given Community Development
Block Grant Citizen Advisory Committee members: Rick Canady, Richard
Chappell, Van Daniels, Ed Sigee, Cleveland Nisby, Fredericka Adams,
Rette Browning, Shirlene Cook, Gregory Boutte, Collis Cannon, Raymond
Chaison, Herman Rogers, Marie Hubbard, Minnie Zummo, Thomas F. Jones,
Amos Landry, Marilyn Adams, Marilyn Johnson, Beverly Nolan, Olivia
Gonzales, and David Haysley) .

Citizen comment was invited on the Consent and Main Agendas. No one
wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held April
3, 1990;
Resolution No. 90-60 authorizing acquisition of Parcel 147, 0. 167 of an
acre on the east side of Major Drive about 160 feet north of White Road
from Jack Tinkle in the amount of $12,442 .00; Parcel 149, 0. 350 of an
acre on the west side of Major about 450 feet north of White Road from
Mrs. G. F. Stagg, Mrs. Hilda Lee and Mrs. Wanda Glasscock in the amount
of $6, 980. 00; and Parcel 152, 0.103 of an acre on the northeast corner
of the intersection of Major and White Road from Thomas Joseph Saleme in
the amount of $11, 772 .00 for widening and improvement of Major Drive;
Resolution No. 90-61 designating Billy D. Lindsey, president of
GreenTree, City Manager Ray A. Riley, Controller Walter Thomas and
Treasurer Kandy Daniel as signatories for the checking account
established at Texas Commerce Bank for payment of employees' health
insurance claims by GreenTree Administrators; and
Resolution No. 90-62 authorizing an agreement with the Beaumont Housing
Finance Corporation for implementation of provisions of the Charlton
Pollard Neighborhood Housing Revitalization Plan in an effort to provide
financing for affordable housing to low and moderate income persons.
The Consent Agenda was approved on a motion made by Councilman Samuel
and seconded by Councilman Smith.

Resolution No. 90-63 authorizing acceptance of a $1,425, 000 grant for
capital and operating assistance for the Beaumont Municipal Transit
system from the Urban Mass Transportation Administration to finance
$800, 000 of the estimated $1 million cost of five new advance design 35-
foot diesel coaches and $625, 000 to fund eligible operating costs of the
bus system for the period from October 1, 1990 through September 30,
1991, was approved on a motion made by Councilman Samuel and seconded by
Councilman Brumley.

Ordinance No. 90-24 reducing the speed from 40 miles per hour to 35
miles per hour on Calder Avenue from a point 230 feet west of the
centerline of the Caldwood Cutoff bridge to a point 610 feet west of the
centerline of Arlington was considered:

ORDINANCE NO. 90-24
ENTITLED AN ORDINANCE AMENDING CHAPTER 26,
SECTION 26-23 OF THE CODE OF ORDINANCES OF,
THE CITY OF BEAUMONT TO ESTABLISH MAXIMUM AND
MINIMUM SPEEDS IN CERTAIN ZONES; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
Ordinance No. 90-24 was approved on a motion made by Councilman Brumley
and seconded by Councilman Smith.

Resolution No. 90-64 authorizing a one-year contract with Waste
Management - Golden Triangle to furnish closed container garbage
collection service for City facilities at 27 locations for $2, 025. 95 per
month or a total of $24,311.40 for the 12-month period was approved on a
motion made by Councilman Brumley and seconded by Councilman Smith.

Resolution No. 90-65 authorizing a one-year contract with Premium
Plumbing Company for providing plumbing services for City facilities
with charges at $35.50 per hour for plumbers, $8.00 per hour for
plumber' s helpers, an $18. 00 minimum charge for service calls and a
markup of 25% for materials was approved on a motion made by Councilman
Smith and seconded by Councilman Brumley.

Resolution No. 90-66 accepting the work performed by Swain Company for a
pre-engineered metal building to serve as a maintenance center at the
sewage treatment plant and authorizing final payment in the amount of
$500. 00 was approved on a motion made by Councilman Smith and seconded
by Councilman Brumley.

Councilman Smith reported an excellent turnout and program for "Sunday
in the Park" last Sunday that was co-sponsored by the City of Beaumont
employees' and Southeast Texas Society for Education of Young Children.
Mr. A. J. Judice was the story reader, and the Police Department
presented a puppet show. The next "Sunday in the Park" will be held May
131 1990. In addition, Councilman Smith reported that the community
participants of the Lamar University Academic Bowl held last Wednesday
bested the students and faculty and have been awarded a very large

trophy. She and City Manager, Ray Riley, were part of that team. She
complimented another team member, Tim Halley of the Beaumont Enterprise,
for being voted the most valuable player.
Councilman Samuel asked Nick Toparcean, Building Codes Division, to
evaluate the a vacant structure on the property at 1478 Delaware.
Councilman Brumley congratulated Councilman Smith and Mr. Riley as
winners of the Academic Bowl at Lamar and said he has received
complimentary calls regarding fast brush pickup and the implementation
of the program whereby brush is automatically picked up without a call
if one has been received in the area.

Mr. Cecil Gray, 670 Maplewood, Vidor, dealer at Larry's Antique Mall,
Mrs. Justine Tinkle, co-owner of Larry's Antique Mall, Carl B. Rush,
3715 Acorn Circle, dealer at Larry's Antique Mall, and Edgar Singer,
3215 Tyler, Nederland, dealer at Larry's Antique Mall addressed Council
to complain about recent no-parking signs being erected near the Mall,
ticketing and towing away of vehicles.
Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to pay tribute
to Channel 6 for being in Beaumont for thirty-five years.
Mr. Robert Preston, 1190 Iowa, addressed Council to complain about the
City of Beaumont's alleged violation of the Open Records Act by not
disclosing requested information.
Mr. Roberto Flores, 2425 Buchanan, and Mr. Ruben Anfoso, owner of
Rainbow Fiberglass at 444 San Jacinto, addressed Council regarding
vagrants and loiterers described as undesirable and scaring away
potential customers from the newly established business and empty houses
that need to be repaired or demolished to eliminate their use in drug
transactions.
Councilman Samuel informed Mr. Flores and Mr. Anfoso that he has been to
the building sites, visited with the neighbors, has contacted the Police
Department, and the problem is being evaluated and a solution sought.
