HELD FEBRUARY 27, 1990, 1:15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 27th day of February, 1990, with the
following present:

The Invocation was given by the Reverend June Fulton, Associate Pastor at
Northwood Christian Church.
The Pledge of Allegiance was led by Kandyle Renee Brown, daughter of Mrs.
Walterine Brown, a secretary in the Executive Offices. Kandyle attended
Council along with about sixty (60) fellow students from the West
Tabernacle Church Day Care.

Three Proclamations were issued: "Women's History Month, " March, 1990;
"Top Ladies of Distinction Week, " February 26, 1990 - March 4, 1990; and
"Family Entertainment Week, " February 26, 1990 - March 4, 1990. (The
Sesame Street "Cookie Monster" and children from West Tabernacle Church
Day Care received the proclamation for "Family Entertainment Week, " and
presented cookies to Council. The children sang, WHO TOOK THE COOKIE
FROM THE COOKIE JAR? for Council. )

Citizen comment was invited on the Consent Agenda and Items 6 and 7 on
the Main Agenda. No one wished to address these items.

The following Consent Agenda items were considered:

Approval of the Minutes of the regular City Council session held February
20, 1990;
Resolution No. 90-34 appointing Lettie Lanza to the Clean Community
Commission with a term expiring September 30, 1990; and
Resolution No. 90-35 authorizing purchase of nine (9) encrypted two-way
radios (two (2) Motorola Syntor X9000 Securenet mobile radios and seven
(7) Motorola Saber Securenet hand-held portable radios) and an encryption
loader for programming the radios for use in confidential communications
by the Police Department's Special Services Detail from Motorola
Communications and Electronics, Inc. in the amount of $23, 358. 18.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Moore.

Ordinance No. 90-9 granting a specific use permit for an emergency
shelter for abused women and their children at 2125 Victoria in an area
zoned RM-H (Residential Multiple Family Dwelling -- Highest Density) as
requested by the Family Services Association was considered:

PERMIT TO ALLOW THE OPERATION OF A WOMEN'S AND

Ordinance No. 90-10 granting a specific use permit for construction of a
church on the southeast corner of the intersection of North Major Drive
and Bluebonnet Lane in an area zoned RM-H (Residential Multiple Family --
Highest Density) and R-S (Residential Single Family) as requested by the
pastor and trustees of Bible Baptist Church, a non-denominational church,
presently located at 1245 Chamberlain Drive was considered:

Ordinance No. 90-11 granting a specific use permit for a church in an
existing building at 790 Jeny Lane in an area zoned RS (Residential
Single Family) as requested by the pastor of Fair Haven Church, subject
to an existing 70-foot-wide shell surfaced drive to be narrowed to 35
feet with the section of the 35-foot-wide drive between the parking area
and the street to be graded and replaced with topsoil and grass or
landscaping mulch and installation of a 10-foot-wide landscaped buffer
zone on the north side of the property was considered:

Ordinance No. 90-12 granting a specific use permit for a machine shop at
985 Dixie Drive in an existing sheet metal building with 1,545 feet of
floor space in an area zoned GC-MD (General Commercial -- Multiple Family
Dwelling) to be known as A-1 Machine Shop as requested by Grady Stevens
and James E. Wright was considered:

Ordinance No. 90-13 approving a recommendation from the Planning
Commission for rezoning of six tracts of land covered by the R-3 Rezoning
Study--1990 (Area 1, consisting of six lots fronting on State Highway 105
in the 5100 block and extending southward about 320 feet to Tolivar Road,
reclassified from R-3 and RS (Residential Single Family) to RM-H
(Residential Multiple Family -- Highest Density) ; Area 2, a three-acre

tract fronting State Highway 105 about 300 feet east of Major Drive,
reclassified from R-3 to GC-MD (General Commercial--Multiple Family
Dwelling) ; Area 3, a one-third acre tract at the southwest corner of
Perlstein Park east of the Kroger Shopping Center, reclassified from R-3
to GC-MD; Area 4, a .75 acre tract at the northeast corner of the
intersection of Blanchette and South Seventh Street, reclassified from R-
3 to GC-MD; Area 5, a .30 acre tract at the southwest corner of the
intersection of Alabama and Cochran, reclassified from R-3 to GC-MD; and
Area 6, consisting of several individual tracts, totaling about 3 .08
acres on the south side of Cardinal Drive east of Avenue A, reclassified
from R-3 to L-I (Light Industrial) was considered:

ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE
BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON
THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE
ZONING FROM R-3 (MODIFIED TWO-FAMILY AND MULTIPLE
DWELLING) AND RS (RESIDENTIAL SINGLE-FAMILY DWELLING
DISTRICT) TO RM-H (RESIDENTIAL MULTIPLE-FAMILY DWELLING
- HIGHEST DENSITY DISTRICT) , GC-MC (GENERAL COMMERCIAL
MULTIPLE-FAMILY DWELLING DISTRICT AND LI (LIGHT

and seconded by Councilman Lee.

MAYOR MEYERS TO KIRT ANDERSON PLANNING DIRECTOR:
I would want to add something that I mentioned that day. And, for the
benefit of Council and the record, I want . to, particularly as
Councilmembers who were present, commend you and the staff for what I see
as important, and Council did as well, and that's the initiating effort
that you took to take the message out--and go out and see the people and
talk to them. I think that's really the way to end up having the kind of
satisfied citizens that you had as opposed to the past, and I think
that's great, Kirt. I think the fruits of your effort showed in the
understanding on the part of the people affected. I think that's great.

Ordinance No. 90-14 approving definition of City records as all
documents, papers, letters, books, maps, photographs, sound or video
recordings, microfilm, magnetic tape, electronic media, or other
information recording media, regardless of physical form or
characteristic or if it is open or restricted record, declaring the City

records to be public property, and designating the City Clerk as Records
Management Officer as required by the Local Government Records Act of the
71st Legislature was considered:

ENTITLED AN ORDINANCE DEFINING CITY RECORDS,
DECLARING CITY RECORDS PUBLIC PROPERTY
DESIGNATING A RECORDS MANAGEMENT OFFICER;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR
REPEAL.
Ordinance No. 90-14 was approved on a motion made by Councilman Samuel
and seconded by Councilman Cokinos.

Resolution No. 90-36 awarding a contract to W. B. Construction, Inc. for
construction of playground improvements on Pipkin Park which include
installation of playground equipment, including a climber, swings and
rides, sitework, and construction of a shelter, two picnic tables with
benches, sidewalks and a drinking fountain for a base bid of $17,500 and
Alternate 3 in the amount of $1,400 (drinking fountain) for a total of
$18,900 was approved on a motion made by Councilman Samuel and seconded
by Councilman Cokinos.

A public hearing was called to consider the seven (7) below listed
structures found to be in violation of the City of Beaumont's Dangerous
Structure Ordinance, Article III, Section 14-50:
552 Alma (rear) - Richard A. , McClain, owner (19 violations) , Staff
recommendation to raze or repair within 30 days; 1805 Bolivar - Lloyd
Shawl, owner (14 violations) , Staff recommendation to raze or repair
within 30 days; 1805 Bolivar (rear) - Lloyd Shawl, owner (6 violations) ,
Staff recommendation to raze within 30 days; 3955 Inez - Anderson
Williams, owner (21 violations) , Staff recommendation to raze or repair
within 30 days; 3145 Brenham - Robert Trim, owner (17 violations) , Staff
recommendation to raze within 30 days; 765 Trinity - Eugene Jackson (13
violations) , Staff recommendation to raze within 30 days; and 701 Prince -
Virginia Small, owner (24 violations) , Staff recommendation to raze
within 30 days.
These parcels of property have been inspected, are vacant, and found to
be in violation of Article III, Section 14-50 of the Code of Ordinances,
notices have been sent to owners by Certified Mail and published in the
Beaumont Enterprise.

The forty-three (43) structures listed below have been condemned by City
Council and the owners ordered to either raze or repair them within
specified time frames. Reinspection of these structures have revealed
non-compliance with the Council 's order. The Public Safety Department is
requesting authorization from City Council to demolish these structures
in accordance with the Dangerous Structure Ordinance and charge the
property owners with the cost of demolition.

nuisances and ordering their repair or removal by their owners was
considered:

until a later time.

Mr. Dwayne Hunt, 7850 Lawrence Drive, addressed Council to complain about
paying parking fees on City parking lots while attending Civic Center
events.
Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council regarding
various subjects.
