CITY COUNCIL - CITY OF BEAUMONT
HELD JANUARY 30, 1990, 1:15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 30th day of January, 1990, with the
following present:

The Invocation was given by Sister Rose Mary Cousins, Superintendent of
Catholic Schools.
The Pledge of Allegiance was led by Councilman Moore.

Three Proclamations were issued: "Volunteer Income Tax Assistance Day, "
January 30, 1990; "Catholic Schools Week, " February 4-10, 1990; and
"Voter Registration Week, " February 5-11, 1990.

Mayor Meyers announced that an Executive Session will be held in
accordance with Section 2 (g) of the Texas Open Meetings Act to interview
applicants for the position of Chief Magistrate of the Municipal Court
following the regular session of City Council.

Citizen comment was invited on the Consent Agenda and Main Agenda Items
1 and 2 . No one wished to address these items.

The following Consent Agenda items were considered:

Approval of the Minutes of the regular City Council session held January
23, 1990; and
Resolution No. 90-17 appointing Nancy Neild for a term expiring December
31, 1990, Victoria Price, Dr. Robert Swerdlow, and Larry Beaulieu for
terms expiring December 31, 1991 to the Sister City Commission.
The Consent Agenda was approved on a motion made by Councilman Moore and
seconded by Councilman Samuel.

Mr. Riley presented the Comprehensive Annual Financial Report for the
1988-89 Fiscal Year to Council and introduced Mr. Joe Koshkin, a partner
of Coopers and Lybrand, the independent auditors, and Ms. Cynthia
Rawson, the Audit Manager. Mr. Riley said that in preparing this
document a great deal of effort is expended by City personnel in
organizing and completing the financial statements; then the auditors
review all the statements for their form and reliability. The end
result presents a fair, responsible, and good report on the financial
condition of the City.
Chief Financial Officer Betty Dunkerley explained that the Comprehensive
Annual Financial Report is a reflection of how well the annual budget
operating plan has been followed. The report is divided into three
sections: the Introduction (transmittal letter, the organizational
chart, list of city officials, and previous award) , the Financial
Section (Coopers and Lybrand audit report, statements and schedules
required by generally accepted accounting principles) , and the
Statistical Section (charts and demographic information) . Implemented
into this year's Financial Section is a Statement of Cash Flow. For
this report, daytime scenes of the Neches River have been used for the
cover, and a night scene is depicted on each section divider. Mrs.
Dunkerley thanked all her staff for their contribution to finalization
of this report, particularly Carol Toups for the cover design and
compilation of the report, Walter Thomas, the controller, and Tom
Lowrance, who worked both with the external and internal audit teams.
Also, Mrs. Dunkerley acknowledged the support of the City Manager and
City Council in providing the resources needed to employ a good
accounting staff and prepare a good report.
Mr. Joe Koshkin introduced Mr. Greg Boutte, sub-contractor for Coopers
and Lybrand for this audit, and thanked him for his assistance. Mr.
Koshkin pointed out that in this Comprehensive Annual Financial Report,
there is included a "clean audit opinion, " not shared by all cities.
This opinion is considered a plus in the financial community in
conducting a bond sale.
Mayor Meyers thanked the Finance Department, Coopers and Lybrand, and
Greg Boutte and his firm for the report, the volunteers who participated

in the photography, and expressed delight for the inclusion of the
"clean audit opinion" in the report.
The Comprehensive Annual Financial Report was acknowledged as received
on a motion made by Councilman Brumley and seconded by Councilman
Cokinos.

Ordinance No. 90-6 amending Section 6-111 (b) of the Code or Ordinances
to provide for automatic adoption of updated versions of the National
Electrical Code as approved by the National Fire Protection Association
and becoming effective on January 1 of the year following approval by
the association was considered:

THE CITY OF BEAUMONT CONCERNING ADOPTION OF A

PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
Ordinance No. 90-6 was approved on a motion made by Councilman Moore and
seconded by Councilman Cokinos.

A public hearing was called to consider the eighteen (18) below listed
structures found to be in violation of the City of Beaumont's Dangerous
Structure Ordinance, Article III, Section 14-50:

recommendation to raze or repair within 30 days; 4481 Ector (garage) -
Chester Williams, owner (6 violations) , Staff recommendation to raze or
repair within 30 days; 3526 St. James (23 violations) and 3526 St. James
rear - (15 violations) - Joe Davis, owner, Staff recommendation to
raze both structures within 30 days; 760 Van Buren - James Sterling,
owner (24 violations) , Staff recommendation to raze within 30 days; 1794

violations) , Staff recommendation to raze within 30 days.
These parcels of property have been inspected, are vacant, and found to
be in violation of Article III, Section 14-50 of the Code of Ordinances,
notices have been sent to owners by Certified Mail and published in the
Beaumont Enterprise.
The thirty-nine (39) structures listed below have been condemned by City
Council and the owners ordered to either raze or repair them within
specified time frames. Reinspection of these structures have revealed
non-compliance with the Council 's order. The Public Safety Department
is requesting authorization from City Council to demolish these
structures in accordance with the Dangerous Structure Ordinance and
charge the property owners with the cost of demolition.

Mr. Raymond Egland, 4460 Fortune Lane, owner of the structure at 1801
011ie, addressed Council to explain he is in the process of a divorce
and if he is declared owner of the structure in the divorce decree
(Court date 1/31/90) he will begin rehabilitation procedures. Mayor
Meyers advised Mr. Egland to contact Mr. Nick Toparcean of the Building
Codes Division of the Public Safety Department regarding ownership and
rehabilitation work plan for the structure.
There being no one else to address Council, the public hearing was
closed.
Ordinance No. 90-7 declaring certain dilapidated structures to be public
nuisances and ordering their repair or removal by their owners was
considered:

Mr. Houston Wilridge, Sr. , 3225 Sarah Street, questioned Council about
procedures for reopening of a day-care or similar business in a building
he owns at 1945 Sarah. The day care has been closed about two years.
Mr. Wilridge was instructed to contact Planning Director Kirt Anderson
regarding specific regulations.
Mr. Raymond Egland, 4460 Fortune Lane, addressed Council to state his
tax appraisals on various properties is about 36% higher than appraisals
for resale. Mayor Meyers informed Mr. Egland that he may contact the
Jefferson County Appraisal District in Groves to request a hearing
regarding these appraisals and to ask questions pertaining to the
matter.
Mr. Henry Dannenbaum, 1567 Wall, addressed Council in support of sixteen
half-way houses located in Beaumont.

There being no further business, the meeting was recessed before
continuing with the Executive Session in the third-floor conference
room.
