CITY COUNCIL - CITY OF BEAUMONT
HELD DECEMBER 19, 1989, 1:15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 19th day of December, 1989, with the
following present:

The Invocation was given by the Reverend Stuart Wright, pastor of
Bethlehem Lutheran Church.
The Pledge of Allegiance was led by Councilman Cokinos.

Mayor Meyers called an Executive Session immediately following the
Workshop Session of City Council, pursuant to Section II (e) of the Texas
Open Meetings Act, to consider pending or contemplative litigation and
Section II (g) to consider appointment, employment, evaluation,
reassignment, duties, discipline, or dismissal of a public officer or
employee.

Mayor Meyers gave Council an opportunity to extend a Christmas message
or wish.
Councilman Brumley wished everyone a Merry Christmas and Happy New Year,
especially a very healthy and safe holiday season.
Councilman Lee extended holiday greetings to everyone, noting that this
has been a highly productive year for Council and expressed a desire for
continued attendance to Council meetings by citizens in 1990.
Councilman Cokinos added wishes for a Merry Christmas, Happy Hanukkah,
and good health to citizens of Beaumont and City Council

Councilman Moore extended warm wishes for a happy holiday, said it a
pleasure serving and working for Beaumont, and asked that we all be
mindful of someone else this season and those who have, share with
someone that might not have.
Councilman Samuel expressed Christmas greetings and admonished all to be
mindful of those less fortunate, be prayerful, keep Christ in Christmas,
and extended wishes for a safe and happy holiday season.
Councilman Smith wished everyone a very Merry Christmas and Happy New
Year saying that she enjoyed working with everyone this past year and
suggested that those who will be drinking and driving have a designated
driver. Councilman Smith said that over 50% of all fatalities on the
highway are alcohol related and urged consideration be given to safety
and to be mindful of those less fortunate than we.
City Manager Riley relayed that in his opinion this has been a very fine
year and conveyed to Council and all citizens, wishes for a Merry
Christmas and Happy New Year and expectations of a great year in 1990
for even a better decade than the eighties.
Assistant City Attorney Cooper extended a Merry Christmas and wishes for
a joyous holiday season and reminded us this is the season to celebrate
the birth of Christ.
Mayor Meyers concurred with the holiday wishes of Council, directed
those same wishes to them, and said it has been a pleasure working with
them. He stated he has a tremendous amount of respect and admiration
for their efforts and ability to work together. To the community, he
wished a happy and a healthy holiday season and asked that we all pause
for a moment to count our blessings.

Mayor Meyers invited Judge John Paul Davis to address Council.
Judge Davis said that he thought it appropriate to publicly say thank
you to Council for his appointment as Chief Magistrate of the Beaumont
Municipal Court on July 8, 1980. He is leaving this position to accept
a place on the bench of County Court of Law No. 3 . He said that he
hoped Council has found the quality of his service to have been such
that Council had no regrets in appointing him to the position of judge
and stated he did his very best. He reflected on the changes and
improvements of the Court during his tenure and invited Council to
attend his swearing in ceremonies as a County Court at Law Judge on
Friday, December 22, at 10: 00 a.m.
Mayor Meyers and Council individually expressed appreciation to Judge
Davis for his service, fair judgment, and professional behavior at
Municipal Court, congratulated him for his recent appointment and

recognized him as friend as well as an employee for the City of
Beaumont.
Mayor Meyers said that Judge Wendell Radford, Beaumont's part-time
judge, will be available as needed during the interim period before
selection of a replacement is made for Judge Davis.

Citizen comment was invited on the Consent Agenda and Main Agenda Items
1 through 4.
Mr. Bob Andrews addressed Council relative to unavailability of public
transportation evenings and Sundays and a need for transportation for
wheelchair citizens to be provided the opportunity to attend church.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held
December 12, 1989 ;
Resolution No. 89-263 authorizing payment in the amount of $38,520. 00
(subject to a 2% discount discount for prompt payment within ten days
of the invoice or a net cost of $37,749. 60) to Coburn Supply Company
for emergency purchase of 4,500 feet of four-inch PVC pipe for a water
line being constructed along Highway 69 to the site of the new State
prison south of the City limits;
Resolution No. 89-264 accepting the bid of Houston Peterbuilt, Inc. , for
repairing a damaged automated garbage truck for $36,887.53 plus the cost
of any replacement parts which may be acquired (costs to be reimbursed
by Old American Mutual Fire Insurance Co. , carrier for LST Trucking Co. ,
the party responsible for damages) ;
Resolution No. 89-265 authorizing purchase and installation of 5, 625
square yards of Stratton carpet to replace the existing carpet in City
Hall from Bellard's D & C, Inc. in the amount of $79,260. 00 ($55,860. 00--
materials, $23,400. 00--labor) ; and
Resolution No. 89-266 authorizing a $7,761.45 settlement of claim for
property damages brought against the City by Edward and Loyce Fonteno.

The Consent Agenda was approved on a motion made by Councilman Moore and
seconded by Councilman Samuel.

Resolution No. 89-267 authorizing filing of an application for a
$200, 000 grant under the Local Match for Transit Providers Program
administered by the State Department of Highways and Public
Transportation in conjunction with the Governor's Energy Management
Center to pay the local share of the cost of five new buses to be
acquired for the transit system (to replace the last five of the 1977
model coaches) under an 80% matching grant from the Urban Mass
Transportation Administration was approved on a motion made by
Councilman Cokinos and seconded by Councilman Moore.

Ordinance No. 89-87 approving an amendatory $116,700. 00 budget change to
utilize an unanticipated increase in revenues from the hotel-motel room
occupancy tax by appropriating an additional $35,700. 00 for the
Convention and Visitors Bureau for staff expansion to broaden and
intensify efforts to attract conventions and meetings and increasing the
bureau' s total appropriation from $442, 300. 00 to $478, 000. 00,
appropriate an additional $56, 000. 00 to make up the difference between
revenues and expenditures in the Main Street on the Neches event held
last September, and appropriate the sum of $25, 000. 000 to a reserve for
special events to be used as necessary for the continuation of community
events such as Main Street on the Neches and the annual Fourth of July
Celebration, subject to City Council review and approval in each case,
as considered:
ORDINANCE NO. 89-87
ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 89-69 AND
THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1989;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING FOR SEVERABILITY.
Ordinance No. 89-87 was approved on a motion made by Councilman Brumley
and seconded by Councilman Smith.

Resolution No. 89-268 authorizing purchase of 14, 000 feet of C-900 PVC
water pipe from Golden Triangle Pipe and Water Supply in the amount of
$110,460. 00 for use by the Water Utilities Department for the extension
of water service to the site of the new State prison in order to meet an
April 15 target date for completion of the water line was approved on a
motion made by Councilman Moore and seconded by Councilman Smith.

Ordinance No. 89-88 adopting an updated service credit option offered by
the Texas Municipal Retirement System by updating the base to the three-
year period from January 1, 1986 through December 31, 1988 was
considered:

UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL
RETIREMENT SYSTEM, "UPDATED SERVICE CREDITS"
IN SAID SYSTEM FOR SERVICE PERFORMED BY
QUALIFYING MEMBERS OF SUCH SYSTEM WHO
PRESENTLY ARE IN THE EMPLOYMENT OF THE CITY
OF BEAUMONT; AND ESTABLISHING AN EFFECTIVE
DATE FOR SUCH ACTIONS.
Ordinance No. 89-88 was approved on a motion made by Councilman Cokinos
and seconded by Councilman Smith.

These parcels of property have been inspected and found to be in
violation of Article III, Section 14-50 of the Code of Ordinances,
notices have been sent to owners by Certified Mail and published in the
Beaumont Enterprise.
The sixty-three (63) structures listed below have been condemned by City
Council and the owners ordered to either raze or repair them within
specified time frames. Reinspection of these structures have revealed
non-compliance with the Council 's order. The Public Safety Department
is requesting authorization from City Council to demolish these
structures in accordance with the Dangerous Structure Ordinance and
charge the property owners with the cost of demolition:

Mr. Hermann Graham, owner of structures at 1466-70 Gladys, addressed
Council in defense of a request for an extension of time to complete
demolition of the buildings, stated that 1466 Gladys has already been
demolished, and said that shortly after publication of the properties,
his buildings were vandalized.
The Reverend Williams, pastor of East Mount Olive Baptist Church,
addressed Council in reference to property at 1125 Bolivar and to ask
for additional time to repair the structures under a program by his
church to use for people who do not have a home.
Council instructed Mr. Graham and the Reverend Williams to schedule an
appointment with Mr. Nick Toparcean to arrange a viable and realistic
work plan.
There being no one else to address Council regarding these structures,
the Public Hearing was declared closed.
Ordinance No. 89-89 declaring certain dilapidated structures to be
public nuisances and ordering their repair or removal by their owners
was considered:

THEIR REPAIR OR DEMOLITION; PROVIDING FOR

Ordinance No. 89-89 amended to delete the property at 1125 Bolivar and
1470 Gladys from Section I and 2695 Houston, front and rear, from
Section IV (now part of a work program) was approved on a motion made by
Councilman Cokinos and seconded by Councilman Smith.

Director, for the erection of the bus shelter on College and 8th Street.
