BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 3rd day of October, 1989, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Mayor Pro Tem Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Michael Brumley Councilman, Ward II Audwin Samuel Councilman, Ward III David W. Moore Councilman, Ward IV Ray A. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Walter J. Proctor of the Paradise Missionary Baptist Church and Chairman of the Board of Directors for the Trinity Valley Baptist District Association who conducts the business for the Emergency Shelter for the Homeless. The Pledge of Allegiance was led by Councilman Smith. -000- Mayor Meyers announced an Executive Session will be conducted in accordance with Section 2(e) of the Texas Open Meetings Act to discuss pending or contemplated litigation following Work Session. -000- Mrs. Beverly Hatcher was recognized as Chairman of the Ethnic Festival, an integral part of "Main Street on the Neches, " and complimented for her leadership. Mrs. Hatcher acknowledged the strong leadership of many other volunteers and introduced those present today: Mrs. Marilyn Adams (worked with the Ethnic Heritage Parade) , Jerry Chandler (Parade Chairman, Queen Selection Chairman, and in other capacities as needed) , Mr. Henry Moujaes and Colonel Jack Nahas (advisor and operator of the Syrian/Lebanese food booth) and Mr. Robert Broussard (advisor and operator of a Mexican food booth) . Mrs. Hatcher explained that the theme used in planning the festival has been and will continue to be "making people feel special" and said there were over 1,000 volunteers involved with this year' s festival. Mrs. Adams expressed appreciation for not only volunteers, but City staff support, especially Mr. Jef -270- October 3, 1989 q. Russell, Manager of the Convention and Tourism Division, Ms. Claudie Hawkins, Manager of the Conventions Facilities Division, and Police Officers Dave Sample and J. R. Smith. Mayor Meyers and Council conveyed their appreciation for the efforts of all the volunteers in making "Main Street on the Neches" a pleasurable and memorable experience for the citizens of Beaumont and expressed anticipation for next year' s clelebration. -000- Mayor Meyers stated there has been much publicity about the volunteerism efforts in Beaumont being rewarded by our city receiving commendation and an award from Keep Texas Beautiful as being the number one city in the State of Texas. Mrs. Maree Calcote, Chairman of the Clean Commission, primarily responsible for that award has a group of Kelly High School students who today want to participate in another area of volunteerism. Miss Jennifer Watters, representing the National Honor Society at Kelly High School, signed an "Operation Clean Street" contract with Mayor Meyers and Councilman Bob Lee to maintain Wendelin Road from College Street, Kelly Drive to Langham Road, and Langham Road back to College Street. The students were thanked by Council for their sense of responsibility and example. -000- Six Proclamations were issued: "Professional Purchasing Week, " October 1-7, 1989; "National Disability Employment Awareness Month, " October, 1989;* "Beaumont-Port Arthur Restaurant Month, " October, 1989; "National Mental Illness Awareness Week," October 1-7, 1989; "Respiratory Care Week, " October 1-7, 1989; and "Physical Therapy Week, " October 1-7, 1989. (*The Mayor' s Committee for Employment of the Handicapped has been selected as the number one committee in the State of Texas and Governor Clements will make a _public presentation to them on October 27, 1989. That committee has provided the ways and means to send Mr. Todd Freeland to Oita, Japan to compete in the Japanese Wheelchair Marathon in November to represent both Beaumont and the State of Texas. -000- Citizen comment was invited on the Consent and Main Agenda items. Mr. Paul Loden, addressed Council regarding Consent Agenda Item D (purchase of utility billing forms and envelopes) and in opposition to making purchases from vendors outside Beaumont. -000- The following Consent Agenda items were considered: -271- October 3, 1989 Approval of the Minutes of the regular City Council session held September 26, 1989; Resolution No. 89-202 authorizing Texas Commerce Bank to release $4,000,000 held as securities at the Federal Reserve Bank - Dallas/Houston Branch; Resolution No. 89-203 appointing Ron Switzer to the Convention and Tourism Advisory Commission and Jerry Nathan to the Planning Commission for terms expiring July 31, 1990; Resolution No. 89-204 granting a 6-by-8-foot surface easement to Gulf States Utilities Company for a padmounted transformer and switchgear and a 6-by-10-foot underground easement necessary in the relocation and burial underground of overhead electric power lines in the Crockett Connector project near the intersection of Laurel, Crockett, and Orleans; and Resolution No. 89-205 authorizing purchase of 456,000 water bill forms at $11. 47 per thousand and 26,000 delinquent billing forms at $16. 27 per thousand from Texas Printing Company of Beaumont and 560,000 mailing envelopes at $11. 34 per thousand and an equal number of courtesy return envelopes at $9. 69 per thousand from Mail-Well of Houston. The Consent Agenda was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- Resolution No. 89-206 authorizing filing of an application for a $65,000 Traffic Light Synchronization grant from the Texas Department of Highways and Public Transportation to finance part of the cost of a $104,400 project to link the traffic lights at 30 intersections into six interconnected signal systems was approved on a motion made by Councilman Moore and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 89-207 authorizing filing of an application for a $25,000 grant in Community Development Block Grant Funds from the Department of Housing and Urban Development to finance part of the cost for a Youth Sports Club Program at the Magnolia Gardens, Neches Park and Concord Homes housing projects in an effort to combat substance abuse by the substitution of sports activities and drug awareness programs was approved on a motion made by Councilman Moore and seconded by Councilman Samuel. Question: Ayes: All Nayes: None -000- -272- October 3 , 1989 Resolution No. 89-208 accepting the work performed under a contract for construction of the Crockett Connector off-street passenger loading facility for the transit system at 299 Liberty Avenue and authorizing final payment in the amount of $14,500. 94 to APAC-Texas, Inc. was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution No. 89-209 supporting the passage of Proposition No. 8 on the November 7, 1989 General Election ballot (which proposes an amendment to the Texas Constitution providing for bond issue financing for acquiring, constructing, or equipping of corrections institutions, youth corrections institutions, statewide law enforcement facilities and mental health and mental retardation institutions) , encouraging citizens to vote "yes" for the proposition on November 7, 1989, and encouraging other municipalities in Texas to support efforts in favor of Proposition No. 8 and to resolve in support of passage of Proposition No. 8 was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 89-210 authorizing the execution of a contract and all other documents necessary to receive a $149,500 grant under Title 11-A of the Job Training Partnership Act for a Remedial Education Literacy Training Program to be conducted in the Beaumont Public Library and offering training in reading and basic math to qualified persons referred through the Texas Employment Commission office and resulting in job placement was approved on a motion made by Councilman Brumley and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Mayor Meyers asked City Manager Riley to convey a message of sympathy and condolences to Mrs. Riley in the recent death of her father. -000- Councilman Smith reported a great "Sunday in the Park" hosted by the Junior League last week with lots of entertainment to keep the children' s attention. Councilman Moore announced that the Executive Committee for S.C.U.P. (Southend Community Uplift Program) has scheduled November 11th as the clean-up date for the Southend area. Councilman Cokinos extended an invitation to "Sunday in the Park, " October 8th, sponsored by the Best Year' s Center with additional -273- October 3, 1989 entertainment provided by an international folk dance group, the Sounds of Silence, and games for the children. -000- Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council in appreciation for their endorsement of Proposition No. 8 to be voted upon at the November 7, 1989 General Election. Mr. Gerald David Loden, operator of Gerald-Jean Distributing Company, addressed Council regarding a grocery business he is attempting to establish at 3540 South 11th Street. Mr. Loden complained about alleged building inspection procedures required of him in meeting compliance for this business being unfair and discriminatory. Mr. Paul Loden, brother of G. David Loden, addressed Council to complain of alleged contradictory requirements by the Code Enforcement Division for a fire alarm system at the proposed grocery store site. Mr. Gerald D. Loden addressed Council again, citing the example of the Library on Avenue A allegedly not required to install a fire alarm system, but one required for his 30 ' x 30 ' grocery store. -000- There being no further business, the meeting was recessed before continuing with City Council Workshop Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the Regular City Council Session held October 3, 1989.
