BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 18th day of July, 1989, with the following present: HONORABLE: Bob Lee, Jr. Mayor Pro Tem & Councilman-At-Large Andrew P. The Pledge of Allegiance was led by Councilman Samuel. -000- The following proclamations were issued: In celebration of their 100th birthday, "Salvation Army Week, " was proclaimed during July 16-23, 1989 and in honor of Vietnam Veterans of America, Chapter 292, "Volleyball Tournament Days, " were proclaimed for July 21-22, 1989, with proceeds benefiting My Wish, Inc. -000- Public Comment was called on items of the Consent Agenda and Main Agenda Items. No one wished to address these items. -000- Mayor Pro Tem Lee welcomed Commissioner Norman Troy as a visitor to Council. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council sessions held July 3, 1989 and July 11, 1989; and -178- July 18, 1989 Resolution No. 89-146 authorizing Parkdale Bank to release $200,000.00 held as securities at the Federal Reserve Bank of Dallas/Houston Branch and pledge another $100,000. 000 as securities, effective July 18, 1989. The Consent Agenda was approved on a motion made by Councilman Samuel and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- A public hearing was called to consider designation of Reinvestment Zone No. 7 for property owned by Goodyear Tire and Rubber Co. There being no one to address the subject, the public hearing was closed. Ordinance No. 89-39 designating property owned by Goodyear Tire and Rubber Co. as Reinvestment Zone No. 7 in Beaumont' s zone of extraterritorial jurisdiction to make Goodyear eligible for tax abatement was considered: ORDINANCE NO. 89-39 ENTITLED AN ORDINANCE DESIGNATING A CERTAIN AREA OF THE CITY OF BEAUMONT AS REINVESTMENT ZONE NO. 7, CITY OF BEAUMONT, TEXAS; AND OTHER MATTERS RELATING THERETO. Ordinance No. 89-39 was approved on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None Mayor Pro Tem. Lee expressed appreciation for the opportunity to offer tax abatement to Goodyear as a tool to enhance economic revitalization in our community. Councilman Samuel commented about the number of jobs created recently through tax abatement by Mobil, Trinity Industries, Helena Laboratories and now Goodyear stating he feels we' re moving in the right direction and thanked Commissioner Troy for the cooperation of the Commissioner' s Court in working with the City of Beaumont in this effort. -000- Ordinance No. 89-40 amending Ordinance No. 87-57 to allow an 18-month extension for the Pinecrest Church of Christ to complete fund raising needed for construction of a church at 3060 Dowlen Road was considered: ORDINANCE NO. 89-40 ENTITLED AN ORDINANCE AMENDING ORDINANCE 87-57 GRANTING A SPECIFIC USE PERMIT FOR A CHURCH ON PROPERTY LOCATED AT 3060 DOWLEN ROAD AND DESCRIBED AS 1100 FEET NORTH OF DELAWARE ON THE EAST SIDE OF DOWLEN ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS. -179- July 18, 1989 Ordinance No. 89-40 was approved on a motion made by Councilman Moore and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Ordinance No. 89-41 granting a variance prohibiting the sale of alcoholic beverages within 300 feet of a church or school to allow an alcoholic beverage license for wine and beer sales at Star Bowling Center, 4180 Pinkston Drive, to be reissued in the name of the new owner, Roy L. Sanders, was considered: ORDINANCE NO. 89-41 ENTITLED AN ORDINANCE GRANTING A VARIANCE TO SECTION 3-10 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ALLOW THE OFF-PREMISE SALE OF WINE AND BEER AT 4180 PINKSTON DRIVE IN BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 89-41 was approved on a motion made by Councilman Smith and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Ordinance No. 89-42 regulating the storage of junk motor vehicles to keep them from detracting from the city' s appearance was considered: ORDINANCE NO. 89-42 ENTITLED AN ORDINANCE AMENDING CHAPTER 13 , SECTION 13-15 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ADD A NEW SUB-CHAPTER 13- 15( 1) REGULATING THE STORAGE OF CERTAIN MOTOR VEHICLE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. After a lengthy discussion, Council asked that the ordinance be reworded to clarify definitions of existing fence and the term opaque and to make the effective date of "existing fences" upon passage of the ordinance. Ordinance No. 89-42, as amended, was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 89-147 authorizing a contract with APAC-Texas in the amount of $159,211. 60 for construction of the 1989 Community Development Street Program (Coleman - Lucas to Pine, Blanch - East Gill to LaSalle, Bennett - Bigner to Betsy, Bennett - Libby to Rachael, -180- July 18, 1989 Marie - Lela to Deadend, Ethel - Elinor to Glenwood, Valentine - Caldwell to Concord, St. Helena - Concord to Plum, St. Helena - Cottonwood to IH-10, Anita - St. James to Waverly, Anita - Edmonds to Glenwood, Euclid - 11th to South 8th, and LaSalle - Pine to Jeanette) was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. The twelve ( 12) structures listed below have been condemned by City Council and the owners order to either raze or repair them within specified times frames. Reinspection of these structures have revealed non-compliance with the Council' s order. The Public Safety Department/Code Enforcement Division is requesting authorization from City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of the demolition: 376 FREDERICK, 883 GLADYS, 1462 SABINE PASS, 1466 SABINE PASS, 828 LONG, 848 LONG, 850 LONG, 856 MILLER, 1025 WILLOW, 1027-29 WILLOW, 1031- 33 WILLOW, AND 1093 WILLOW. There being no one to address Council, the public hearing was closed. Ordinance No. 89-43 declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by the owners was considered: ORDINANCE NO. 89-43 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. Ordinance No. 89-43 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Smith reported a good "Concert on the Move" last Thursday at Klein Park lasting until about 10: 00 p.m. with a great finale involving young people in the audience. Councilman Samuel added positive remarks about the concert with Vince Vance and the Valients and announced the next "Concert on the Move" will be at Magnolia Park with Stereo performing. -183- July 18, 1989 Councilman Moore thanked the Parks Division staff for their assistance in providing the Space Walk at Virginia Village and said that "Sunday in the Park" sponsored by Crazy Jose' was very enjoyable, the children were provided good refreshment and the robot was very entertaining. Councilman Brumley said he had received good comments on "Concerts on the Move" and expressed appreciation to the Parks Division personnel for their efforts in converting the park appropriately for the concert. Mayor Pro Tem Lee congratulated Councilman Brumley for a very successful "Concert on the Move, " added belated congratulations for an excellent 4th of July celebration, and announced that next week' s "Sunday in the Park" will be hosted by Friends of Sunday in the Park. -000- Mr. Brian Carpenter, P. O. Box 8415, Lumberton, Texas 77711, addressed Council again to express his concern about hiring practices for the Police Department and stated there is discrimination against white males. Mr. J. S. Casey Jones, 255 East Elgie, accompanied by Mr. Frankie Harris, address Council requesting that Sulphur Drive be repaired and submitted a petition containing approximately 169 signatures of residents and 49 businesses.
