BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 28th day of March, 1989, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman-At-Large Andrew P. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Glenn Budewig, Redeemer Lutheran Church. The Pledge of Allegiance was led by Craig Segura, son of Brenda Segura, an elementary student attending City Council. -000- - moment of silent prayer was observed on behalf of Councilman Samuel' s family in the death of his father last night. -000- Councilman Lee announced that the "Sunday in the Park" will begin its new season, April 2nd, and continue for a 30-week series. Miss Ruth Chaffin, 12, a seventh-grade student at Austin Middle School and the daughter of Mr. and Mr. P. H. Chaffin, Jr. , was introduced as the winner of the annual Sunday in the Park Poster Contest. Miss Chaffin was among 200 school-age entrants in the contest. Her winning poster will be reproduced and displayed throughout Beaumont and on a 12 'x48 'billboard that circulates through the city. Councilman Cokinos announced that Beaumont Bank will award a savings bond to Ruth on Thursday, March 30th, during a press conference at Riverfront Park. Ruth will be available to autograph poster, and Councilman Lee said that a brand new activity will be unveiled for use during the 1989 "Sunday in the Park" season. Councilman Lee also expressed appreciation for the corporate support this program receives and especially recognized St. Elizabeth Hospital for their continuing support as a sponsor and financial commitment of $3,500.00. -72- March 28, 1989 The following Proclamations were issued: 1989 proclaimed as "Year of the Young Reader. " Mrs. Dora Nisby, Director of Library Services for the Beaumont Independent School District and member of the Library Commission for the City of Beaumont, and a group of young people accepted the proclamation and challenged Council to read 30 minutes per day and presented them with a book tote bag and bookmarks. "National Community Development Week," March 24-31, 1989. Mr. Herman Rogers, Chairman, introduced Ms. Dolores Lawless, Mrs. Marie Hubbard, Mrs. Marilyn Adams, Mr. Raymond Chaison and Mr. Rick Canady, members of the Community Development Block Grant Citizen' s Advisory Commission. Support of the Small Business Revolving Loan Fund, which has fueled Beaumont' s economic recovery by opening businesses in the community, was proclaimed and citizens urged to pledge their support in assisting small businesses to flourish and make a unified effort to attract and create new jobs and retain existing ones. Finance Director Betty Dunkerley presented copies of the proclamation to 11 businesses participating in the Community Development Block Grant Small Business Revolving Loan Fund and creating new jobs in Beaumont: The Waffle House ( 30 jobs) , The Fitness Connection Health Club ( 5 jobs) , Puttin' Around ( 4 jobs) , U. S. A. Baby ( 6 jobs) , C & I Computer Retail Services ( 5 jobs) , Munro' s Cleaners ( 8 jobs) , B & N Mail Services ( 2 jobs) , Wayne Parker Collector Cars ( 1 job) , Pumpkin Patch Day School ( 6 jobs) , Hoffbrau Restaurant ( 6 jobs) , and I . M. I . , Inc. ( 45 jobs to be increased up to 85 during 1989) . Mrs. Dunkerley announced an open house for the Emergency Shelter for the Homeless, 875 College Street, on Thursday, March 30th, from 3: 00 - 5: 00 p.m. The Housing Rehab Loan Advisory Board Chairman, Gaylynn Cooper, was introduced and also recognized as Vice-Chairman of the Innovative Housing Board. The Small Business Revolving Loan Board members, Chairman George Hudseth, Rick Canady and Herman Rogers were introduced. -000- Miss Tina Halcomb, the 18-year-old daughter of the Reverend and Mrs. Harold Halcomb, pastor of North End Baptist Church, was introduced as the recently crowned Miss Beaumont-Jefferson County winner. Miss Halcomb received her new title, Saturday, March 25th, at the Julie Rogers Theater and will compete at the State level on July 8th in Fort Worth. -000- Mrs. Maree Calcote, Chairman of the Clean Community Commission, announced Spring Sweep 189 will be conducted in various areas of the city on Saturday, April 1st. Participants are asked to meet at the Civic Center at 8:00 a.m. for a continental breakfast and then divide into groups in a volunteer effort to help clean up our city. Ms. Janet Thomas has served as Chairman for this event. Litter sticks were presented to each Council member by Mrs. Calcote. -73- March 28, 1989 Mrs. Pat Henderson presented Mr. Gene Robler to Mayor Meyers and Councilman Samuel to sign an "Adopt-A-Park" contract. Mr. Robler, the management, and employees of Po' Folks Restaurant have consented to adopt Tyrrell Prk. Mrs. Henderson said, "not only have these people agreed to do the cleanup out there, but he' s also involved the young men at Boys ' Haven in this project. And it gives those young men a chance to get out in the clean fresh air and do something to improve Beaumont, and then Gene feeds them after they get out there and work. So, it' s a reciprocal program for both groups. . .Gene also works with a Sr. Citizen group that comes out occasionally to enjoy Tyrrell Park. . . " Mr. Robler is on the Board for Tyrrell Park Coalition and has been very active in planning and promoting Tyrrell Park Alive 189 to be held April 29th at Tyrrell Park. MAYOR MEYERS• Gene, we would welcome your comments. MR. ROBLER• We just enjoy Boy' s Haven out there at Tyrrell Park. . .and the opportunity came about with Boys' Haven and Po' Folks cleaning it up with Tyrrell Park Alive, and it' s been fun. We've been out there twice, we' re going back out there this Saturday as part of the cleanup. We' re painting, we' re redoing the woodwork. . . it takes about eight hours for the work. This time we' re going to use 31 boys out there this coming Saturday. So, we have paint furnished by the City, and we furnish all the manual labor, and just have at it. COUNCILMAN SAMUEL: . . .We've seen you throughout the community and greatly appreciate it. Not only do you all serve good food, but you' re doing an excellent job in the community, and I think it' s very significant to note that Tyrrell Park is one of the largest parks in our city, and, therefore, means that there is a great amount of work to be done out there. I think it' s truly exemplary that you and Boys ' Haven adopt that particular park. We appreciate it, and we' ll be with you. If Boys' Haven esthetics out there is any indication of the way that Tyrrell Park will look I think we' re in for a great treat! MAYOR MEYERS• Gene, just a small way to thank you, this is an engraved "Adopt-A-Park" pen to put in your pocket. It' s with the City of Beaumont seal. The volunteers who come forward like you continuously really don' t expect anything. You do it because you enjoy it. And, so this is just a symbol that says that we appreciate what you' re doing. I don' t think there' s hardly a month goes by where my secretary isn' t telling me about some place that you' re taking Seniors, bringing them here, bringing them to the park, feeding them. These aren' t things that are normal and average that people do everyday, and we commend you for it, and we thank you very much for this act today. -74- March 28, 1989 Ms. Dolores Lawless addressed Council to announce that Mrs. Delia Harrington will be honored and presented an award tonight at 7: 00 p.m. at Moncla' s Restaurant by the Business and Professional Women' s Club for her community service throughout the years. -000- The following Consent Agenda Items were considered: Approval of the Minutes of the regular City Council session held March 21, 1989; Resolution No. 89-59 authorizing Texas Commerce Bank to release $50,000 .00 held as securities with the Federal Reserve Bank - Dallas/Houston Branch, effective March 28, 1989; Resolution No. 89-60 appointing Pat Henderson to the Parks and Recreation Advisory Committee with a term expiring June 30, 1989; Resolution No. 89-61 accepting the $27,856.00 bid of Barrett White GMC of Tyler for supply a diesel, eight-cubic-yard dump truck for the Sewer Maintenance Department and providing a standard 12-month parts and labor warranty covering the entire unit, including the dump body as well as the truck chassis and cab; Resolution No. 89-62 authorizing eminent domain proceedings to acquire part of the Coca-Cola Bottling Co. property at 1075 Martin Luther King Parkway described as Parcel 432-A, all of Lots 1 and 14 and part of a closed alley in Block 22 of the Jirou Addition, for right-of-way for the parkway construction project, after refusal of the State' s appraised value in the amount of $151, 000. 00; Resolution No. 89-63 authorizing conveyance of Parcel 291 ( 6,103 square feet of land on the northeast side of Railroad Avenue between Milam and Gilbert) , Parcel 322 ( 28, 212 square feet of land on the southeast corner of Victoria and Wall) , and Parcel 344 (consisting of 70, 437 square feet of land on the southwest corner of Railroad and Forsythe) acquired from the Kansas City Southern Railway Co. for Martin Luther King, Jr. Parkway right-of-way to the State; Resolution No. 89-64 authorizing acquisition of a Clear Zone Easement on Lots 1 and 2, Block 40, Gulf Terrace Addition from Mr. and Mrs. John David Bridges for the appraised value of $7,700. 00 to insure an unobstructed approach for planes coming in for a landing and comply with Federal Aviation Administration grant requirements for Municipal Airport; Resolution No. 89-65 authorizing settlement of a claim filed by Marlena Hudson for property damages resulting from the incident of February 14, 1989 in the amount of $2,707.13 as discussed in Executive Session on February 28 , 1989. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -75- March 28, 1989 Resolution No. 89-66 scheduling a public hearing for the April 11 City Council meeting to consider Gulf States Utilities Company' s rate increase which would net the company an additional $67. 5 million in annual revenues ( $65 million base rate increase and $2. 5 million net increase in fuel costs--an increase of about $5.83 for a typical 1,000 kilowatt hour monthly residential bill) , effective April 25 unless Council acts to suspend it for a period of up to 90 days was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 89-67 authorizing a contract with AAA Siding and Windows of Beaumont for installing siding and replacing windows at the Henry Homburg Golf Course Clubhouse in the amount of $16,980 plus $ . 50 per board foot for replacement of lumber was approved on a motion made by Councilman Lee and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Resolution No. 89-68 accepting the work performed by Doty Construction Co. , Inc. for construction of the Comstock Relief Ditch Project of the Comprehensive Drainage Program (original contract bid of $54,804. 00 increased to $82,426. 65 due to four Change Orders changing design modifications, working days, and need for additional riprap) and authorizing final payment in the amount of $4,735. 55 was approved on a motion made by Councilman Smith and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution No. 89-69 authorizing an increase in City cost participation with Drainage District 6 as authorized by Resolution No. 88-174 for construction of the Sherwood Drive Bridge Project where an inadequate culvert crossing has been a cause of flooding in the Woodlands area (the original estimate was $139,425. 00, but the lowest bid received was $187,416 . 50) was approved on a motion made by Councilman Smith and seconded by Councilman Lee. Mrs. Frank Johnson, 1830 Brooklyn, owner of the property at 890 Jackson addressed Council to complain about the condemnation process and requested consideration for her property. Councilman Cokinos stated that Mr. Frank Weathington, owner of the property at 2225 Wilson, requested his property be deleted from today' s action and he be granted additional time to bring the structure in compliance with the Code. There being no one else to address Council, the Public Hearing was closed. Removal of the structures at 2225 Wilson and 890 Jackson from the ordinance for consideration today to allow an extension of time for repair was approved on a motion made by Councilman Samuel and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None The City Manager requested approval of the ordinance with deletion of the portion in Section 3 that gives the City the authority to cause demolition of the referenced property, if the owner does not adhere to the raze or repair order within thirty ( 30) days, with costs assessed gainst the property. This deletion will avoid building up a large inventory of structures to be razed at City expense and possibly creating another environmental health problem with high weeds and an unsightly environment. Mr. Riley would like to schedule a Work Session or present a report to Council with a plan of action to proceed with demolition of structures on a one-to-one basis requesting specific authority for demolition as owners fail to comply. -78- March 28, 1989 Ordinance No. 89-17 declaring certain dilapidated structures to be public nuisances and ordering their repair or removal by their owners was considered: ORDINANCE NO. 89-17 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Ordinance No. 89-17 with the amendment in Section 3, as requested by Mr. Riley, was approved on a motion made by Councilman Samuel and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- - motion to put the owners of the property at 2225 Wilson and 890 Jackson on notice regarding the need for adherence to rehabilitating these structures was approved on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Councilman Samuel expressed his appreciation to Council and others who have offered their gestures of condolence in the death of his father. Councilman Lee announced that the Southeast Texas Association for the Education of Young Children will host the first "Sunday in the Park" on April 2, 1989. Mayor Meyers extended a special invitation to everyone to attend the first "Sunday in the Park" for the 1989 season when he will be reading to the children. He announced that the State Comptroller' s office is scheduling seminars for new taxpayers on Tuesday, April 11, 1989 at 2: 00 p.m. , at the Comptroller of Public Accounts Field Office at 6440 Concord. -000- Mr. Henry Dannenbaum, 1567 Wall, addressed Council regarding an empty house in the 1600 block on Port Street and possible related problems. -000- There being no further business, the regular City Council meeting was adjourned. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held March 28, 1989.
