BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 26th day of July, 1988, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Cokinos Councilman At Large Lulu L. Smith Councilman, Ward I Mike Brumley Councilman, Ward II Audwin Samuel Mayor Pro-Tem Councilman, Ward III David W. Moore Councilman, Ward IV -000- The Invocation was given by Father Sinclair, St. Anne Tri-Parrish. The Pledge of Allegiance was led by Boy Scout Ricky Daleo. -000- Visiting Council from DeQuincy, Louisiana, Mr. Hershel Frazier played a tape of a song he wrote as a neighborly gesture to Southeast Texas entitled "The Triangle Will Return To Gold Again. " In Country Music style, the song spoke of the good economic times of the Golden Triangle created by the seaports, shipyards and chemical row, and that by the grace of God and the good people of Texas good economic times will return again. -000- Mayor Meyers announced that an Executive Session will be held following the Workshop Session in accordance with Section 2(g) of the Open Meetings Act of the State of Texas to discuss appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee. -000- Miss Leslie Little, a sponsor of the U. M. Army presented Mayor Meyers a commemorative cap and cup to remember their visit to Beaumont. The U. M. Army is a group of young people and adult sponsors from Methodist churches throughout the State that rebuild and repair homes for the elderly. Miss Little stated that 100 youth and adults are in the Beaumont area. -000- -194- July 26, 1988 Mr. Haines called forward Amy Barton, Budget Officer, to receive for the Budget Committee consisting of Kandy Daniels, Walter Thomas, Carol Toups, Sue Brubaker, and Les Turner the "Award for Distinguished Budget Presentation" given by the Government Finance Officers ' Association. Quality in budget development and submission and budget activities are criteria used for giving the award. Particular tribute was paid to Beaumont for clarity of the budget and the narrative presentation. It is considered an exceptional document and will be available to other cities throughout the nation as a model to showcase. -000- Mr. Jim Stokes, Chamber of Commerce President, called upon Councilman Lulu Smith and Mr. Charles Glass, Vice-Chairman of the Economic Development Council to assist in presenting the Monthly Progress Report of the Economic Development Council. Councilman Smith reported that on July 14th the Small Business Council and she conducted a special workshop for Old Town businesses. There were 60 participants with 35 joining committees. Five areas of concern are parking, code enforcement, security, historical district, and marketing. Another general meeting is planned for August 25th. Mr. Glass reported a trip by 20 Beaumonters to Austin is scheduled for August 3rd and 4th to visit agencies that will give more of a Beaumont presence in Austin. Mr. Glass also gave an update of the follow-up of the plastics trade show in Chicago and a summary of prospect statistics. -000- Citizen comment was invited on Agenda Items A, B, C-6 and D. No one wished to comment on these items. -000- The following Consent Agenda items were considered: Approval of the Minutes of the Regular City Council Session held July 19, 1988; Resolution No. 88-155 appointing William Leonard, Amy Dase, Bonnie Cokinos, and Martha Reed to the Convention & Tourism Advisory Commission with terms expiring July 31, 1990, M. L. "Buddy" Lefler to the Planning Commission for a term expiring July 31, 1990, Elbert DuBose, Jr. to the Transit Advisory Commission for a term expiring June 30, 1990, Roy M. Philp, Jr. to the Parks & Recreation Advisory Commission for a term expiring June 30, 1990, and the Reverend Beauregard Brown, III and H. B. "Buddy" Arnoult to the Beaumont Advisory Commission for Prevention of Child Abuse and Neglect with terms expiring June 30, 1990; Resolution No. 88-156 accepting the water, sanitary sewer, storm sewer and street improvements of Bellechase Addition, Section II, Phase I as part of the City systems subject to the filing of a final plat and dedication of all right-of-way and easements required. The Consent Agenda was approved on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None -195- July 26, 1988 Resolution No. 88-157 authorizing the sale of four parcels of surplus City property (Parcel 1: Lot 7, Block 14, Van Wormer Second Addition, next to 290 12th Street, Burt Walker in the amount of $500; Parcel 3: 0. 1206 of an acre tract out of Lot 1, Block 3, Rosemont Addition, 4300 Pradice Street, Evander Cade, Jr. in the amount of $100; Parcel 9: Lot 10, Block 2, University Place Second Addition, 795 Caston, William McCullough in the amount of $1,530; and Parcel 12: Tract 103 out of the C. Williams League, Abstract No. 59, east of 685 Pinchback Road, Robert Flowers in the amount of $2,000) was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution No. 88-158 establishing a statement of mission known as "Citizen Friendly" to be adopted and incorporated by employees of the City of Beaumont pledging the best in state-of-the-art customer services delivered in a convenient, courteous, considerate and pleasant manner was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Mr. Haines informed Council that Agenda Items C-6 (An ordinance amending the Historic Tax Abatement Ordinance, Section 25-57. ) and 7 (An ordinance granting historic tax abatement for the Bruce Irvine Building at 446 Orleans. ) have been pulled from today' s agenda. -000- Kirt Andersen, Director of Planning, presented to Council the Comprehensive Master Plan for Riverfront Park, Phase II improvements which include site preparation, development of a pier and dock, a multipurpose sidewalk system with a bridge, benches, lights, observation terrace, picnic facilities, open and natural areas, a creative playground, fencing, landscaping, and observation tower, and utilities. A Public Hearing was opened to consider application for a grant from the Texas Parks and Wildlife Department for Riverfront Park Phase II. With no one wishing to address the subject, Mayor Meyers closed the Public Hearing. Resolution No. 88-159 authorizing filing of an application for a grant from the Texas Parks and Wildlife Department for matching funds for Riverfront Park Phase II, authorizing the City Manager as representatives in this regard, and designating the Finance Officer as the official to receive grant funds was considered. After a lengthy discussion regarding the creative playground, observation deck, docks, liability, and submission date of application for the grant, Councilman Lee made a motion, seconded by Councilman Samuel, to approve Resolution No. 88-159 for submission of the grant application on the basis there would be opportunity to amend -the grant with respect to the specifications of the observation tower. Question: Ayes: All Nayes: None -196- July 26, 1988 Councilman Samuel made a motion, seconded by Councilman Cokinos, that Staff be directed upon making grant applications that Council receive those applications three weeks prior to the filing deadline or at least be given notice or some type of awareness before the request for the application filing request is brought to Council. Question: Ayes: All Nayes: None -000- Ordinance No. 88-66 changing the zoning from RM-H (Residential Multiple Family Dwelling--Highest Density) to RCR (Residential Conservation and Revitalization) for an 8. 026 acre tract of land owned by B. D. Orgain on the north side of Sarah Street for 887 feet extending north along the west side of Fatima Street for 409.75 feet was considered: ORDINANCE NO. 88-66 ENTITLED AN ORDINANCE REPEALING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONINGION DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING- HIGHEST DENSITY DISTRICT) TO RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION DISTRICT) ON PROPERTY LOCATED AT 3510 SARAH STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 88-66 was approved on a motion made by Councilman Moore and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Ordinance No. 88-67 granting a specific use permit for a fraternal lodge to be used by the Knights of Peter Claver Council and Court #64 on the northwest corner of Sarah and Fatima, 3510 Sarah Street, was considered: ORDINANCE NO. 88-67 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A FRATERNAL ORGANIZATION ON PROPERTY LOCATED AT 3510 SARAH STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-67 was approved on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- -197- July 26, 1988 Ordinance No. 88-68 changing the zoning from RS (Residential Single Family) to NC (Neighborhood Commercial) for two lots on the southeast corner of Delaware and Briarcliff as requested by Joseph Clevens E. Reed to operate a retail jewelry store and lease space for a beauty shop was considered: ORDINANCE NO. 88-68 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY DWELLING) TO NC (NEIGHBORHOOD COMMERCIAL DISTRICT) ON PROPERTY DESCRIBED AS TWO LOTS LOCATED AT THE SOUTHEAST CORNER OF DELAWARE AND BRIARCLIFF, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The Planning Commission voted 3-2 to recommend approval and the Planning Commission staff recommended denial. Councilman Brumley made a motion seconded by Councilman Lee for denial of the zoning change. Question: Ayes: Councilman Lee Nayes: Mayor Meyers Councilman Councilman Smith Cokinos Councilman Councilman Brumley Samuel Councilman Moore Councilmembers Smith and Brumley expressed concerns regarding adherence to the comprehensive plan and lasting effects of spot zoning. Ordinance No. 88-68 was approved on a motion made by Councilman Samuel and seconded by Councilman Moore. Question: Ayes: Mayor Meyers Nayes: Councilman Lee Councilman Councilman Cokinos Smith Councilman Councilman Samuel Brumley Councilman Moore -000- Ordinance No. 88-69 granting a specific use permit to the Presbyterian Children' s Home and Service Agency of Austin for a "Latch Key" program consisting of an after school, summer and holiday "enrichment program" for 25 sixth, seventh and eighth grade students of Crockett Middle School in an existing residence at 1490 Avenue F was considered: -198- July 26, 1988 ORDINANCE NO. 88-69 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW AN AFTER SCHOOL, SUMMER AND HOLIDAY ENRICHMENT PROGRAM ON PROPERTY LOCATED AT 1490 AVENUE F, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-69 was approved on a motion made by Councilman Samuel and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 88-160 authorizing purchase of three modules from the Genesis V CASE Module System for use by the Management Information Systems Division in designing new software programs from Help/38 Systems (Generator, $14,950; Training, $400; and Maintenance/Update, $1,495) for a total amount of $16,845.00 was approved on a motion made by Councilman Lee and seconded by Councilman Smith. Question: Ayes: All Nayes: None • -000- Councilman Brumley announced that because of inclement weather the "Concert on the Move" scheduled for Klein Park in Ward I has been rescheduled for September 15, 1988, and that another "Concert on the Move" has been scheduled for August 25, 1988, in Ward III at Magnolia Park. Councilman Lee reported his pleasure in attending a meeting with Kingsville officials along with Mayor Meyers and Sandra Stenzel of the Bid Resource Center to share economic development ideas used in Beaumont, announced "Sunday in the Park" on July 31st will be hosted by the West End Optimist Club, and pointed out that City vehicles are not covered when hauling trash as required by private vehicles and reported a specific incident today on Eastex Freeway suggesting that we not only enforce vehicle coverage by individuals, but City vehicles. Councilman Cokinos stated that excluding the July 4th celebration, the biggest crowd for "Sunday in the Park" was last week and expressed appreciation to Lamar for the opportunity to present a proclamation at YOU Day. Councilman Smith explained that YOU stands for Youth Opportunity Unlimited, a Federally funded two month program for underachievers that attend four hours in class and work four hours each day on campus endeavoring to improve their self image. Councilman Smith also restated that she is seriously concerned about the liability of accidents with children at the dock in Riverfront Park. Councilman Moore said that he attended his 15-year high school reunion and was especially pleased to hear good comments about Beaumont's progress from former classmates and asked Tom Warner, Public Works Director to check the -199- July 26, 1988 construction repairs on Bob Street for top off. Councilman Moore also requested of Staff that information be compiled regarding cost of a covered pavilion and the point rating relative to grant application for Riverfront Park improvements. Councilman Samuel asked Code Enforcement for a report of the status of the situation with Mr. Wright on Maida Road and requested that by next week he be updated on the amount and placement of fill dirt on Magnolia Park since September of 1987. Mayor Meyers stated that residents on Broadway south to Laurel have received new garbage containers, but have not received information regarding when usage is to begin and requested that Mr. Warner investigate the problem. Mayor Meyers also reported a successful trip to Kingsville and appreciation for the opportunity to reinforce facets of creating an atmosphere conducive to economic development. Many ideas were shared including clips of "Sunday in the Park" with Councilman Samuel reading David and Goliath to the children and footage of TV commercials of the General "kicking some attitude," highlighting the fact that timing is an important factor in promotion regardless of the worthiness of a program. -000- Mr. Ben Rogers, 2030 Thomas Road, addressed Council in appreciation for completing the City' s portion of work at the old King Edward Hotel and in opposition to the increased fee of $. 25 for garbage collection on holidays stating that sanitation workers are entitled to the holiday also. A general discussion was held between Council and Staff concerning holiday residential garbage collection. Mr. Wayne Sherman, 325 Bradford Drive, addressed Council in opposition to the $ . 25 garbage collection fee. Mr. Henry Dannenbaum, 1567 Wall, addressed Council regarding many subjects. Mr. Larry Gauthier, 5925 Greenwood, addressed Council regarding an increase in water and sewage fees and suggested individual reading of meters to decrease departmental costs.
