REGULAR SESSION
CITY COUNCIL - CITY OF BEAUMONT
HELD NOVEMBER 24, 1992 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 24th day of November, 1992, with the
following present:

The Invocation was given by Father Richard Destefano, Saint Jude's
Thaddeus Catholic Church.
The Pledge of Allegiance was led by Councilman Goodson.

Two Proclamations were issued: "National Home Health Care Week, "
November 29 - December 5, 1992 ; and "World AIDS Day, " December 1, 1992 .

Mr. Chad Haddock, Manager of Human Resources for HEB Pantry Foods,
extended an invitation to Council to attend their first annual Holiday
Dinner in the Golden Triangle on December 18th at the Civic Center from
12 : 00 p.m. to 5: 00 p.m. Mr. Haddock explained that the dinner will be
sponsored by the City of Beaumont and HEB Pantry Foods, and the purpose
is to serve the elderly, disabled, and less fortunate in Hardin,
Jefferson and Orange Counties. He said that no one will be turned away,
and they anticipate 5, 000 participants. Mr. Haddock said this program
was established many years ago and has been a great success in various
cities. They have already served nearly 15, 000 people at two of nine
planned dinners for this year and have 1, 000 homebound meals scheduled
for delivery throughout Beaumont, Port Arthur, and Orange. Mr. Haddock
solicited Council support as "celebrity waiters" for the event.

Mayor Lord expressed appreciation to HEB Pantry Foods for their
contribution to the community and Council confirmed their participation
in the Holiday Dinner.

Citizen comment was invited on the Consent Agenda and Main Agenda Items
1-3 and 6-8. No one wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held
November 10, 1992 ;
Resolution No. 92-320 appointing Rhoda Carmen to the Commission for
Prevention of Child Abuse and Neglect for a term expiring June 30, 1994;
the Reverend Oveal Walker to the Community Development Advisory
Committee for a term expiring May 31, 1994; Fareedah Abdul-Jabbar to the
Senior Citizens Advisory Committee for a term expiring September 30,
1994 ; Sheryl Faulk to the Sister City Commission for a term expiring
December 31, 1994; Sheila Stewart to the Convention and Tourism Advisory
Committee for a term expiring September 30, 1994; and Brock Brentlinger

Resolution No. 92-322 accepting settlement of weed lien charges for
property located at 2537 and 2577 Pine Street in the amount of $407. 04
from Williams Memorial Church of God in Christ;
Resolution No. 92-323 authorizing purchase of folding tables for the
convention Facilities Department from Mity-Lite, Inc. in the amount of
$22,200. 00 (50, 60" round tables--$150. 00 @; 100, 30x96 rectangular
tables--$133 . 00 @; and 7 carts--$200. 00 @) ; and

Resolution No. 92-324 authorizing Change Order No. 4 (provide new 1/4"
smoke safety glass and repaint interior and exterior on all four doors
of Foyer 152) in the amount of $1,428. 00 to the contract with Cleveland
Building Systems, Inc. for renovations to the Best Years Center.
The Consent Agenda was approved on a motion made by Councilman Samuel
and seconded by Councilman Smith.

Resolution No. 92-325 authorizing submission of a request for a 1993
Certified Local Government (CLG) grant in the amount of $32,895. 00
($14, 540 State's share and $18, 355, City's share) to the Texas
Historical Commission to assist the Historical Landmark Commission with
four of their objectives: CLG Conference attendance, Phase V of the
SPARE Beaumont Survey, Nomination Work for the National Register, and
Educational Program development was approved on a motion made by
Councilman Smith and seconded by Councilman Goodson.

Resolution No. 92-326 authorizing a ten-year historical tax abatement
(estimated improvements at $300,000) at the present value of $96,500. 00
on the Santa Fe Depot Building (built about 1897 with a second floor
added in 1910) located at 601 Neches at Crockett Street at the request
of Michael D. Matthews was approved on a motion made by Councilman
Cokinos and seconded by Councilman Goodson.

Resolution No. 92-327 authorizing Change Order No. 2 in the amount of
$23, 294.57 for an additional 7,479 square yards of block sod at $3 .50
per square yard and an adjustment to reflect actual quantities used for
a revised contract amount of $588, 670.90 and authorizing final payment
in the amount of $226,254.23 to APAC-Texas, Inc. for reconstruction of
East Caldwood Street was approved on a motion made by Mayor Pro Tem.
Alter and seconded by Councilman Smith.

Ordinance No. 92-79 issuing a Specific Use Permit and a general land use
and density plan for Glen Meadow Townhomes, Section Two, in an area
described as the north 224.42 feet of Lot 3 , Block 5, Park Meadows
Addition, Unit V, zoned Planned Unit Development District (PUD) ,
requested by Schaumburg & Polk for The Nichols Company to construct
four, one-story buildings, each containing four, single-family

condominium units, was considered:

An Ordinance authorizing a Specific Use Permit at 2350 Pecos Boulevard,
described at Lots 11 and 12, Block 7, Oaks Addition, at the request of
Mr. Paul Tinsley, to convert an existing 4,288 sq. ft. residence in an
area zoned RS (Residential Single Family Dwelling) into a residence for
two-family use with a 6. 2 recommendation from the Planning Commission
for denial and 20 responses from property owners in opposition to the
request, thereby, invoking the 20% rule for approval, was considered:

A motion to approve the Ordinance was made by Councilman Samuel, but
died for lack of a second.
The Ordinance was denied on a motion made by Councilman Smith and
seconded by Councilman Goodson.

Resolution No. 92-328 authorizing purchase of a 1993 Ford, F350 mounted

with a Wheeled Coach ambulance body for use by the Emergency Medical
Service (EMS) Division in the amount of $67, 215.00, plus a 30
($2, 016.45) administration fee for a total cost of $69,231.45, through
the Houston-Galveston Area Council Cooperative Purchasing (H-GAC)
program was approved on a motion made by Councilman Cokinos and
seconded by Councilman Alter.

Resolution No. 92-329 authorizing purchase of a Caterpillar D6H track
dozer for use by the Solid Waste Management Department from Mustang
Tractor and Equipment Company in the amount of $136, 366. 00 with a six-
month warranty with unlimited hours was approved on a motion made by
Councilman Cokinos and seconded by Councilman Smith.

Ordinance No. 92-80 amending Chapter 6-171 of the Code of Ordinances to
add an exception to the Standard Mechanical Code, Section 308.2.2,
relating to ventilation systems for residential dwellings was
considered:

THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
TO AMEND THE STANDARD MECHANICAL CODE TO
ALLOW THE VENTILATION OF BATHROOM EXHAUSTS
FROM ONE AND TWO FAMILY DWELLINGS INTO A
VENTILATED ATTIC OR CRAWL SPACE; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL.
Ordinance No. 92-80 was approved on a motion made by Councilman Moore
and seconded by Councilman Goodson.

Councilman Cokinos commented that the Thanksgiving breakfast sponsored
by the YMCA this morning was very nice and well attended.
Mayor Pro Tem Alter added that the YMCA Thanksgiving breakfast was
followed by an excellent breakfast/lunch at Goodwill Industries, said he
was privileged to visit with the Roberts Avenue Methodist Church at a
function and extended Thanksgiving greetings to everyone.
Councilman Samuel added Thanksgiving wishes and reported that he went to
Austin to receive a $400, 000 check for the City of Beaumont from the

Water Commission, Beaumont's Clean City award. He said Beaumont
received the largest check, was one of the most recognized cities, and
that he was very proud of Beaumont citizens and City Staff.
Councilman Moore wished everyone a good Thanksgiving and said he enjoyed
visiting the Southerland Head Start Program this morning, had the
opportunity to read to two classes and recommended The Mouse Who Wanted
a Cookie for good, interesting reading.
Councilman Smith said she visited Dunbar Elementary where they read
Don't Be the Leaf, Be the Tree--Don't be a raindrop, be a sea; Don't be
anything, but everything that you can be. . . to four-year old children.
In addition, Councilman Smith said that a fundraiser was held for the
Garth House, an advocacy center for children, where interviews are
conducted with sexually and physically abused children. She said they
work closely with the protective services of three counties, have been
open since July, 1991, interviewed almost 400 children, and encouraged
anyone who wishes to donate to an excellent cause to consider the Garth
House.
Mayor Lord thanked Mayor Pro Tem Alter for presiding at the last Council
meeting in her absence while she attended a meeting in Atlanta, Georgia
with the U. S. Conference of Mayors to draft an agenda relative to their
concerns for American cities, preparatory to meeting with President-
Elect Clinton. She also reported being involved with the Great American
Smokeout at Montagne Center, an impressive review of the ROTC at a
local high school, the DEP (Delayed Entry Program) for the Army and said
they are doing a f ine job with a lot of our young people and are to be
commended. Mayor Lord announced that tonight is the Community
Thanksgiving Celebration at the Julie Rogers Theatre. She said there
will be several choirs participating--West Brook and Central High School
Choirs, West Tabernacle Baptist Children's Choir, other church choirs,
and the St. Romanos Choral from the Eastern Orthodox Church Regional
Choir singing a cappella in Slavonic, Russian and Greek; there will be
four residents (Tom Harken, who owns Casa Ole and Crazy Jose's
restaurants and recipient of the Horatio Alger Award, Beaumont
firefighter Jerry May who recently helped in a hurricane relief effort,
Janice Reynolds who went from the welfare rolls to become a Lamar
graduate working for the Beaumont Independent School District, and
Eloise Milam, founder of the Melody Maids) who will tell why they
appreciate living in Beaumont and being Americans. Special music will
begin at 6:30 p.m. and the program start at 7:00 p.m.

Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to express
thanks for the blessings in his life and to promote various community
holiday activities for those in need.

appreciation for denial of Agenda Item No. 5 authorizing a Specific Use
Permit to establish a two-family residence at 2350 Pecos Boulevard, said
the Old Town Association has been given rebirth, and one of their main
objectives will be to get Old Town designated as a historical district.
Mr. Preston Hall, 5695 Sunbird, addressed Council to request
installation of an additional street light at the cul-de-sac. It was
reported that minimum requirements for street lights have been met by
the developers of Park North Addition, and that installation of a new
street light with underground wiring would cost about $2, 300 and could
possibly be shared by Mr. Hall and his neighbors or individuals might
consider installation of a security light.

recessed to reconvene in Workshop Session.
