CITY COUNCIL - CITY OF BEAUMONT
HELD OCTOBER 6, 1992 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 6th day of October, 1992, with the
following present:

The Invocation was given by the Reverend J. C. Segura, West Oakland
Baptist Church.
The Pledge of Allegiance was led by Assistant City Attorney Tyrone
Cooper.

Four Proclamations were issued: A Proclamation honoring "Paul Moore"
(nephew of Jefferson County Commissioner Ed Moore) for his achievements
in the field of golf and as an outstanding citizen of Beaumont;
"National Physical Therapy Month, " October, 1992 ; "Restaurant Month, "
October, 1992; and a Proclamation declaring D. J. 's Boudain "bites" as
Mayor Lord's official Cajun favorite.

Citizen comment was invited on the Consent and Main agendas. No one
wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held
September 29, 1992 ;

Resolution No. 92-277 appointing Martin Bernard for a term expiring May
31, 1994 and Scarlett Duplechain, Chairman, for a term expiring May 31,
1993 to the Community Development Advisory Committee;
Resolution No. 92-278 authorizing purchase of a 1993 Chevrolet twelve
(12) passenger van for use by the Parks and recreation Department from
Knapp Chevrolet of Houston in the amount of $14, 687. 00;
Resolution No. 92-279 authorizing an annual contract with Callaway
Chemical Company to furnish liquid polymer to be used by the Water
Production Division in the treatment of municipal drinking water in the
amount of $.82 per pound;
Resolution No. 92-280 authorizing acceptance of donation of a 50 '
drainage easement out of the A. Savery Survey for a distance of 4, 665
feet adjacent to the westerly property line of the Beaumont Municipal
Airport to Jefferson County Drainage District No. 6; and
Resolution No. 92-281 authorizing a three percent (3%) increase to the
base pay of the City Clerk, Rosemarie Chiappetta, with other presently
existing benefits remaining the same.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Goodson.

Resolution No. 92-282 authorizing a revision to the Beaumont Municipal
Transit grant application (Project Budget and Standard Form 424) with
the Federal Transportation Administration (approved by R-92-189 on July
28, 1992) to reflect 800/20%--Federal/City funding, an increase of
$18,915 for the City share of capital costs associated with the
paratransit van, was approved on a motion made by Councilman Cokinos and
seconded by Mayor Pro Tem Alter.

Resolution No. 92-283 authorizing acceptance of an EPA grant in the
amount of $110, 000. 00 from the U. S. Environmental Protection Agency for
the study of methods for controlling pollutants contained in stormwater
runoff from the site of construction of Public Works projects for
compliance with the mandate by the National Pollutant Discharge
Elimination System (NPDES) as part of the Clean Water ACT (CWA) was
introduced.
Public Works Director Tom Warner explained that under the Clean Water
Act, a law was passed concerning the National Pollutant Discharge
Elimination System that requires three (3) different types of permits.

The first permit requires the City of Beaumont to permit the entire
storm sewer system and any outfall in which they contribute. The cost
will be evenly with Drainage District 6. Mr. Warner said this is a two-
part permit with the first part filed and approved and the second part
in process. The second type of permit involves industrial facilities
such as the wastewater treatment plant, the landfill, airport and bus
vehicle maintenance facility. The City is working with TML to obtain a
group application with all cities in the state that are required to file
permits. The third permit required is a construction and NPDES permit
for development of more than five acres to insure there is no
contamination of storm waters as a result of construction activities.
Mr. Warner said this "is an area where we have applied for the grant and
have been notified upon Council approval, we will receive a grant to
study and determine best practices to reduce or eliminate pollution of
the stormwaters as a result of construction activities. " He said we are
very fortunate to receive the grant. Only about eight cities in Region
6, a five or 6 state area, to receive a grant.
Resolution No. 92-283 was approved on a motion made by Councilman Smith
and seconded by Councilman Moore.

Resolution No. 92-284 authorizing a contract in the amount of
$264, 000. 00 (a portion of the $840, 000 grant received from the U. S.
Department of Housing and Urban Development for the Home Investment
Partnership Program) with the Innovative Housing Development
Corporation to continue the Homebuyer Assistance Program with
anticipation of assisting approximately 40 families with home ownership
was approved on a motion made by Councilman Moore and seconded by
Councilman Smith.

Mr. Riley said that significant strides and accomplishments have been
made under the leadership of MIS Director Phyllis Boudreaux in our MIS
program. He said there have been upgrades in our equipment and software
that expand City computer capabilities and efficiency. He complimented
Ms. Boudreaux and asked her to explain the improvement requests.
Ms. Boudreaux explained that the requests in the next three agenda items
are for computer upgrades in various City departments, purchase of
software for the Fire and Police Departments, and annual maintenance
agreements for software. Her review included the scope of services the
MIS Department will be able to offer, increased speed in backup
processes and dispatching, and interaction of the AS400 by the Fire and
Police Department and serving as backup for each other.

Resolution No. 92-285 authorizing purchase of computer hardware and
system software (will reduce backup time by 75%, AS/400 WordPerfect will
provide ability to originate memos, reports, etc. through the mainframe
and send documents electronically to outlying locations) from IBM
Corporation in the amount of $128,909. 00 for the MIS Department central
computer and the Police Department computer system was approved on a
motion made by Councilman Goodson and seconded by Councilman Moore.

Resolution No. 92-286 authorizing purchase of the balance of software
system equipment from A. L. Roark and Associates, Inc. totalling
$119,500.00 which will include a Backup System, a Communication System,
and Personnel Module for the Police Department ($93 ,000) and a Fire/EMS
Records Module($26,500) with option for additional conversions priced at
$95. 00 per hour for the Police Department's Computer Aided Dispatch
(CAD) and Records Management Software was approved on a motion made by
Mayor Pro Tem Alter and seconded by Councilman Moore.

Resolution No. 92-287 authorizing software maintenance contracts for
software that was designed and written specifically for the AS/400
computer system from Compu-Tech, Inc. for a total amount of $23,535. 00
(Sanitation, $787. 00; Utility Billing, $4,875. 00; Landfill, $1, 600. 00;
Municipal Court, $5,250. 00; EMS, $1,597. 50; Food Permits, $615. 00;
Central Collections, $7,287.50; Rehab Housing Loans, $1, 473 . 00) and with
HTE, Inc. for a total amount of $11, 325. 00 (GMBA, $4, 300. 00; Purchasing
and Inventory, $3,200. 00; Fixed Assets, $900. 00; Payroll/Personnel,
$1, 800. 00; Applicant Tracking, $1, 125. 00) was approved on a motion made
by Mayor Pro Tem Alter and seconded by Councilman Moore.

Councilman Goodson reminded everyone of "Sunday in the Park" activities.
Councilman Cokinos congratulated Kelly High School for completion of a
very fine science building and commented it was good to see Bishop
Bernard Gantor (recovering from surgery) ; said that with the opening of
Fire Station No. 14 on Chinn Lane, response time should be reduced to
four to five minutes for that area of town and complimented the City
Manager on the opening ceremonies.
Mayor Pro Tem Alter added congratulations for the opening of the fire
station, announced that a "Fall Clean Sweep" will be held Saturday,
beginning at 7: 00 a.m. at City Hall, and invited everyone to bring their
work gloves and join the effort to clean a section of our city.

Councilman Samuel lauded the Police Department and Chief Schuldt for
their assistance this past weekend at the Neches River boat ramps. He
said they attended to crowd control and averted possible situations in a
very positive and friendly manner that did not provoke any animosity,
and said he hopes the media will pick up on these positive aspects of
our community. Also, he asked Staff to investigate the complaint of Ms.
Orelia Samuel, 2675 Santa Fe, regarding overgrown weeds and rat
infestation in the alley-way next to her house, and said a portion of
Pine Street across from the Park that has been patched with asphalt is
separating and needs attention.
Public Works Director said that area has already been marked for
patching.
Councilman Moore echoed Councilman Samuel 's request for media attention
for the good interaction in our city; reminded Council of the
"Rediscover South Park Day" at Alice Keith Park from 11: 00 a.m. to 4 : 00
p.m. , Saturday; and said he is bothered by discontent that is brewing in
a nearby area with a public housing project and hopes that we can
counteract a potentially serious situation with some positive actions or
solutions because if there is racial eruption, Beaumont will be
affected. (The Klu Klux Klan's recent visit to Orange County in
opposition to Black families moving into Vidor was reported on the front
page of the newspaper and on television channels. )
Mayor Lord said she has been in contact with Vidor's mayor and that it
does behoove Beaumont, as an area, to be as positive and upbeat as
possible. She agreed that the celebrations at Kelly High School and
Fire Station No. 14 were great and formally asked for a report on the
parking lots in the downtown area and their compliance with the green
area landscaping requirements.
Councilman Smith said that everyone who was not able to attend the
Heritage Society "Octoberfest" held Saturday missed a great party and a
fine time with a German Band and a Country/Western Band providing
music. She added her thoughts that if the media and residents would
ignore groups coming into our area to stir up strife, they would not
receive the recognition they feed upon and would probably stay away.
Councilman Samuel agreed with Councilman Smith's thought, but said the
media has to report what is newsworthy, but had hoped they would come
together and agree not to cover this situation.
Councilman Smith commented that if this kind of activity has to be
covered, bury it on the back page and not consider it front page news.

There being no further business, the Regular Session of City Council was
recessed to reconvene in Workshop Session.
