CITY COUNCIL - CITY OF BEAUMONT
HELD JUNE 30, 1992 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 30th day of June, 1992, with the
following present:

The Invocation was given by the Reverend James Blackwell of South Park
Baptist Church.
The Pledge of Allegiance was led by Councilman Cokinos and Mr. Tom
Harken.

Two Proclamations were issued: "Picture Perfect Weather Day, " July 4,
1992 (recognizing parade and planned patriotic activities) ; and a
Proclamation declaring Beaumont as the "Flag Waving Capitol of Texas. "
(Mr. Tom Harken has donated over 300 flags for the 4th of July parade
and special tee shirts have been designed for the occasion by Jeremy
Shawn, a Westbrook High School student. Mr. Harken and Mr. Ted
Blanton, Parade Chairman, presented flags, tee shirts and caps to
Council. )

Citizen comment was invited on the Consent and Main agendas. No one
wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held June
16, 1992 ;
Resolution No. 92-171 appointing Marva Provo to the Planning
Commission for a term expiring July 31, 1993 ;
Resolution No. 92-172 authorizing purchase of sixteen (16) IBM 3477
color display stations for use by the Police Department from IBM
Corporation in the amount of $19, 072 . 00;
Resolution No. 92-173 authorizing payment in the amount of $11, 132 . 26
to HiWay Equipment Company for repairs of unforeseen damage to Unit
5032, a 1980 Gradall excavator used by the Streets and Drainage
Department for excavating ditches; and
Resolution No. 92-174 authorizing purchase of an estimated annual
supply of green bar computer paper for use by the Management
Information Systems Department and other City departments from Moore
Business Forms in the amount of $7.50 per thousand sheets for a total
cost of $16,200. 00.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Moore.

Resolution No. 92-175 authorizing purchase of a 1993 Chevrolet HD 3500
truck mounted with an Arm Lift Aerial device for use by the Public
Works Department from Wickersham Ford of Orange in the amount of
$37,234. 00 was approved on a motion made by Councilman Cokinos and
seconded by Councilman Goodson.

Resolution No. 92-176 authorizing an annual contract with Best Pak dba
Rem Waste Control of Nederland for solid waste disposal collection for
twenty-eight (28) City facilities:
1, 10 cyd container, collected 3 times per week for $167 . 50/month
1, 10 cyd container, collected 2 times per week for $111. 00/month
1, 10 cyd container, collected 1 time per week for $55.50/month
3, 10 cyd containers, collected 3 times per week for $502 .50/month

Resolution No. 92-177 authorizing an annual contract with Premium
Plumbing to provide plumbing services for City facilities at $34 . 00
per hour for a plumber, $6. 00 per hour for a plumber's helper, a
$15. 00 minimum service call and a 25% rate added to materials cost was
approved on a motion made by Councilman Goodson and seconded by
Councilman Cokinos.

Resolution No. 92-178 authorizing annual contracts to purchase
estimated quantities of traffic marking materials, on an as needed
basis, for use by the Public Works, Transportation Division, in
maintenance and installation of traffic directional marking devices
with: Vulcan Signs--500, 2 3/8/"x13 yellow sign posts at $8, 495. 00;
Cataphote, Inc.--3, 000 pounds of glass beads at $563 .40; Transtex
Transportation--500 gallons each of yellow and white traffic paint at
$6, 620. 00; Renco Supply, Inc.--5, 000 pounds of bitumen adhesive, 5, 000
each of 3/4" yellow and 3/4" white crown ceramic raised pavement
markers, 5, 000 two-way yellow acrylic reflective raise pavement
markers and 5, 000 one-way white acrylic reflective markers for a total
of $16, 190; Volare, Ltd. --8, 000 feet of pavement marking tape and
adhesive at $12, 359. 00; Signs & Blanks--2, 320 aluminum sign blanks at
$9,849.70; 3M--85 rolls of reflective and non reflective sheeting at
$16,740. 00 and U. S. Standard Sign--1, 625 sign faces at $7, 604 . 50; was
considered:
Councilman Samuel questioned type of materials, relating to
reflectivity, used for signs by the City of Beaumont. Public Works
Director Tom Warner explained there is an engineering grade and a
higher intensity grade. Both grades meet State standards, but
Beaumont uses the higher intensity and higher reflectivity grade for
regulatory signs.
Resolution No. 92-178 was approved on a motion made by Councilman
Cokinos and seconded by Councilman Samuel.

Ordinance No. 92-48 amending Chapter 13, Article IV, Section 13-50
through 13-53 of the Code of Ordinances relating to enforcement,
notification and assessment of costs for weed control was considered:

CHAPTER 13 OF THE CODE OF ORDINANCES
OF THE CITY OF BEAUMONT WITH
REFERENCE TO WEED CONTROL TO
PROVIDE FOR A DESIGNATED
ENFORCEMENT OFFICER; PROVIDE FOR
NOTICE BY REGULAR MAIL; REDUCING THE
ADMINISTRATIVE COSTS TO BE ASSESSED;
AND AMENDING THE PENALTY PROVISION;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR REPEAL.
Ordinance No. 92-48 was approved on a motion made by Councilman
Goodson and seconded by Councilman Cokinos.

Ordinance No. 92-49 amending Chapter 13, Article VII, Section 13-72
and 13-73 of the Code of Ordinances related to fines and penalties and
assessment of cost for litter control was considered:

AND PROVIDING A PENALTY.
Ordinance No. 92-49 was approved on a motion made by Councilman
Cokinos and seconded by Councilman Smith.

Ordinance No. 92-50 amending Chapter 14, Article III, Section 14-52 of
the Code of Ordinances related to standards and assessment of
demolition costs for dangerous structures was considered:

Ordinance No. 92-50 was approved on a motion made by Councilman Smith
and seconded by Councilman Goodson.

Councilman Smith reported attending a Human Development Committee
Meeting in Detroit this past weekend. She said discussion included
problems with health care, violence and education, with some fairly
good ideas presented for addressing these concerns, if funding was
available. In addition, she said there was dialogue regarding Federal
mandates without revenue funds and suggested the City compile a public
information report of the cost of these unfunded mandates. Councilman
Smith said she looks forward to a delightful 4th of July weekend of
activities.
Councilman Samuel commended the College Street (Concerned Citizens)
Association for the successful events of this past weekend (a ribbon-
cutting ceremony and block party in appreciation to the City and in
celebration of the completion of rebuilding College Street) , said
this is another example of community and organizations working
together with the City for the betterment of everyone, and Councilman
Samuel asked Public Works Director Tom Warner to have someone
investigate a tree that has fallen, or is growing across a fence,
almost into the street in the 2000 block of Magnolia Street.
Councilman Moore congratulated Mayor Lord for her recent appointment
to the Advisory Board of the U. . S. Conference of Mayors, said it is a
strong group that affects a lot of policies, expressed apologies for
having to miss the 4th of July celebrations in Beaumont because of a
meeting he will be attending in the "earthquake area" (California) .
Mayor Lord added commendation to the College Street merchants and said
this is proof that open dialogue accomplishes favorable solutions.
She said the U. S. Conference of Mayors was four and a half days of
very hard work and that a good mark was made for Beaumont. To
emphasize using ethnic heritage for eco-tourism, Beaumont served a
sampling of crawfish dishes, and Mayor Lord said that California
mayors were the most impressed because they do not have crawfish in
that "earthquake soil! "

Mr. Preston Green, 3045 Herbert Street, addressed Council to complain
about the condition of his street caused by excessive, heavy traffic
and asked for assistance.
Mr. C. L. Sherman, Jr. , 585 Belvedere Drive, distributed results of a
survey he conducted showing tax rate comparisons for 1991 of twenty
(20) major Texas cities, indicating Beaumont's tax rate to be number
ten (10) without the street user fee and number three (3) with the
street user fee included. He requested that Council adopt a budget
that can continue to be sustained by the $.59 per $100 valuation.
Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council to announce
that First Baptist Church is sponsoring a contemporary Christian music
concert featuring Be-Be and Ce-Ce Winans, Thursday evening at the
Montagne Center, said the College Street celebration was tremendous
and congratulated Mayor Lord and Tom Harken for their civic
activities.

There being no other business, the Regular Session of City Council was
recessed to reconvene in Workshop Session.
