CITY COUNCIL - CITY OF BEAUMONT
HELD JANUARY 28, 1992 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 28th day of January, 1992, with the
following present:

The Invocation was given by the Reverend Timothy Green, Associate Pastor
at Ebenezer Baptist Church.
The Pledge of Allegiance was led by Mr. Henry Dannenbaum.

- gift basket filled with items from Bando's (local caterers and
specialty restaurant) was presented to Mayor Lord and City Council from
Student Body President Brian Weaver and Vice-President Michael Maloney
on behalf of Kelly High School 's celebration of Catholic Schools Week.
Brian Weaver said that during this week, it is the custom of Kelly High
School to present tokens of appreciation to supporters of Kelly High
School and the community.

Citizen comment was invited on the Consent and Main Agenda items. No
one wished to address these subjects.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held

January 21, 1992 ; and
Resolution No. 92-30 authorizing a License to Encroach to Stephen D. and
Leila M. Hughes, through application of Attorney Michael A. Boyd, for a
164-foot section of sidewalk extending 3 .5 feet onto the street right-of-
way at 3385 Fannin Street, described as a 1. 374 acre tract of land out
of the David Brown Survey, Abstract 5, for a one-time fee of $500. 00 and
subject to a 30-day cancellation clause.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Mayor Pro Tem Smith.

Ordinance No. 92-6 abandoning the east 3 feet of a 20-foot-wide general
utility easement lying along the rear line of Lots 30-35, Block 3,
Meadowlands Addition, Section One, at the request of the Home Builders
Association of the Sabine Area, to remove the encroachment of a garage
extending 2 .4 feet onto the easement in the rear of the residence at
6325 Durango (Lot 32) at the southwest corner of Durango and Sierra
Circle, was considered:

Ordinance No. 92-6 was approved on a motion made by Mayor Pro Tem Smith
and seconded by Councilman Cokinos.

Ordinance No. 92-7 amending the City code to reflect the new solid waste
management plan including citywide curbside recycling collections to be
implemented February 3, 1992, with three separate collections provided
every household once a week on the same day: collection of garbage and
trash in 90-gallon containers, collection of recyclable materials in
23 .5 gallon bins, and collection of yard waste in bags or boxes;
maintaining the standard service fee at $10.89 per month with providing
certain discounts; a monthly fee for one additional container at $2.50 ;
and an additional $3.25 monthly fee for twice-a-week garbage and trash
collection was considered:

ENTITLED AN ORDINANCE AMENDING
SOLID WASTE COLLECTION DEFINITIONS,
REGULATIONS AND FEES TO PROVIDE FOR
CITY-WIDE RECYCLING; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL;
AND PROVIDING A PENALTY.
There was a discussion of Sec. 28-20. 15 Scavenging of recyclable
materials. . . , charges filed and fines imposed upon conviction and
questions were raised about recycling preparation and availability of
additional recycling containers.
Ordinance No. 92-7 was approved on a motion made by Mayor Pro Tem Smith
and seconded by Councilman Samuel.

Resolution No. 92-31 accepting the donation of Kenneth E. Ruddy of the
property located between Forrest and Cable, bordered by Caldwell and
Spruce, Lots 1-12, Block 55 of the North Addition, for construction of
new homes for low-to-moderate income families by the Beaumont Innovative
Housing Development Corporation was approved on a motion made by Mayor
Pro Tem Smith and seconded by Councilman Samuel.

Resolution No. 92-32 authorizing filing an application for a $41,000
matching grant for Fiscal 1992 from the Emergency Shelter Grants
Program to be used at the Emergency Shelter for the Homeless operated
for the City by Trinity Valley Baptist Association at 875 College
Street, for operations, maintenance and repairs to the building under
the Stewart B. McKinney Homeless Assistance Act of 1987, was considered.
Councilman Moore requested a statistical report of the number of people
utilizing the shelter by age and sex and the number that acquire
employment while a resident of the shelter to use to measure the
effectiveness of the services provided in addition to serving meals.
Resolution .No. 92-32 was approved on a motion made by Councilman Cokinos
and seconded by Mayor Pro Tem Smith.

Resolution No. 92-33 authorizing purchase of general ledger, accounts
payable, budget, purchasing, inventory and asset management software
from HTE, Inc. , of Orlando, Florida, in the amount of $63, 000 plus
$85. 00 per hour for training costs ($11,560 for an estimated 136 hours)
and approximately $7,766 in travel expenses for an estimated total cost
of $82, 326. 00 was approved on a motion made by Councilman Moore and
seconded by Mayor Pro Tem. Smith.

Councilman Moore reported the South Park Neighborhood Association
elected officers and had an interesting meeting last week with an
exchange of ideas and interaction with State Representative Al Price.
Councilman Moore said the Association continues to progress, and wants
to convey their thanks for Council and City staff assistance.
Councilman Cokinos congratulated Beaumont Police Officers Gerald
LeChance and David Froman for being selected as the 1992 Law Enforcement
Officers of the Year by the 100 Club. Also, Councilman Cokinos
congratulated Mark Arrington of Community Facilities for receiving the
Doris Johnson Service Award for the City of Beaumont and also
congratulated runners-up Dorothy Hayes of the Fire Department and Martha
Woods of the Police Department.
Mayor Pro Tem Smith added congratulations to all City employees and said
the first annual City of Beaumont Employee Service Awards Banquet was
very well done. She reminded Council that the 1992 season of "Sunday in
the Park" will probably begin in April and said she will keep them
informed.
Mayor Lord echoed all the previous congratulations, expressed gratitude
for those responsible for planning the Employees Service Awards Banquet
and said the banquet was a lot of fun. Mayor Lord reported that she
attended the U. S. Conference of Mayors in Washington, D.C. last week,
and it was a rewarding and interesting meeting that provided opportunity
to learn what's new. The Democratic presidential hopefuls appeared
before a panel of mayors for two hours and expressed their views on
subjects such as urban issues. Mayor Lord said it was a pleasure to be
one of the mayors invited to meet Vice-President Dan Quale for a chat,
and that she also had opportunity to meet with Washington Assistant
Carolyn Chaney and to stop in with her at HHS at a very gratuitous time
because of plans in the area of crime and juvenile gang violence
programs coming up. Mayor Lord expressed a desire to have Mrs. Chaney
come to Beaumont soon to provide Council with a Washington update.

Mr. Henry Dannenbaum, 1567 Wall Street, addressed Council in support of

the Police and Fire Departments, the recycling program, drug and gang
programs, and possessing a friendly attitude.

Mayor Lord announced that an Executive session will be conducted
following Workshop Session in accordance with Section 2 (e) of the Texas
Open Meetings Act to discuss the claim of Municipal Administrative
services.

There being no other business, the Regular Session of City Council was
adjourned to reconvene in Workshop Session.
