CITY COUNCIL - CITY OF BEAUMONT
HELD JULY 1, 1986 - 1:15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 1st day of July, 1986, with the following present:

The Invocation was given by the Reverend James LeBlanc, pastor of Miracle
Deliverance Tabernacle.
The Pledge of Allegiance was led by Councilman Weisbach.

MAYOR MEYERS:
I would like, on behalf of Council, to just make a very brief statement for
Council, and I think it reflects the feeling of all of our citizens. We
suffered no direct loss of life in our City as .a result of Hurricane Bonnie
and I think we can be appreciative of that and I think we all responded very
well to the emergency life-saving needs of our City and we offer our
compliments and thanks to the EMS, Police and Fire and a special thanks has to
go to GSU and their crews from within and outside the City for the magnificent
job they did in their efforts and to our City department heads and employees
who worked round the clock doing much more than their job descriptions ever
called for responding to the human side of needs. We offer a very sincere
thank you. And you're all here and you've all have been a part of it but it
extends beyond you to so many others. And, to our City Manager, Al, we'd like
to thank you very much for the leadership that you've displayed. To Judge
LeBlanc and the County and Drainage District 6, Sam Smith, we offer them a
thank you for their coming forward and a willingness to offer their help and
to the Media, those of you who are present and others who are not, for the
responsible and sincere desire to cooperate and assist. And, finally, I know
that there are many other agencies and groups and individuals who wanted to
help just to help and to them we say thank you.

MAYOR MEYERS continued:
I would also just want to reclarify one thing that I think remains as a very
important issue that needs to be clearly understood and that's as the Manager
moves through his program today for trash removal from the Hurricane, it is
very important that everybody understand that we shall address the entire
community and if we do well, we will do well equitably. If we do poorly, we
will do poorly equitably. So, equity is the issue here and we will be good or
bad to everybody - there will be no favoritism displayed in any section of
this City. And, I would just like to, I think, follow by a quote that was in
today's "Wall Street Journal" - a comment by former Coach John Wooden from
UCLA who said, "Why do so many people dread adversity, when it is only through
adversity that we grow stronger" - and, I think that's a very appropriate
statement to the days that we've passed through. But, on behalf of Council, I
do want to thank so many people.

Two proclamations were issued: one recognizing Richard Carroll, General
Manager of KHYS-98, for his contributions to BUILD's efforts to provide
downtown activities for the enjoyment of all Beaumont residents, to the
success of Beaumont Pest Events' Concerts in the Park and to the recognition
of downtown as the community's neighborhood; and one recognizing the American
Red Cross as the agency to meet the immediate human needs of individuals and
families affected by the disaster (Hurricane Bonnie).

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held June 24,
1986;
and
Resolution 86-198 authorizing purchase of Parcel 93, 8,675 square feet out of
the Gentz Addition from L. W. Basco dba Basco Lumber Company at $22,500;
Parcel 95, 8,675 square feet out of the Gentz Addition from Betty Jean Epps at
$24,000; Parcel 103, 5,833 square feet out of the David Brown League, Abstract
5, from Mrs. Dora Venza Santangelo, et al, at $17,000; and Parcel 109, 14,753
square feet out of the David Brown League, Abstract at $14,015, Parcel 110,
1.0,115 square feet out of the David Brown League, Abstract 5, at $38,000, and
Parcel 111, 13,508 square feet out of the David Brown League, Abstract 5, at
$81,625 from John A. Waits, Jr. , and wife, Kathryn R. Waits; authorizing the
execution of easements to Kansas City Southern Railroad Company for relocation
of their railroad facilities and deeds to the State on Parcels 103, 109, 110,
and 111 for the M. L. King, Jr. , Parkway/Spur 380 Project.
The Consent Agenda was approved on a motion made by Councilman Brumley and
seconded by Councilman Samuel.

No citizens wished to address City Council during the public comment on Agenda
Items 1 through 4.

Resolution 86-199 authorizing Change Order No. 2 at $43,060 to the contract
with Sterling Utility Construction Company for Contract 17D, installation of
sanitary sewers, for extra work required to extend and connect to the new
sewer system an existing 12-inch sewer line that was overlooked during th
original design phase (revised contract amount to $2,650,101.27) was approved
on a motion made by Councilman Brumley and seconded by Councilman Weisbach.

Resolution 86-200 authorizing execution of a contract with Norman Materials
Company at $1,530,335.28 for construction of a portion of the College Street
TIP Project from 11th Street to Goliad Street was approved on a motion made by
Councilman Lee and seconded by Councilman Weisbach.

Resolution 86-201 authorizing execution of a 5-year lease/purchase agreement
with Security Pacific Leasing Corporation of Houston at an interest rate of
7.65% for acquisition of two (2) 20-cubic yard automatic packer bodies to be
maintained on City chassis and 1,700 100 gallon-sized containers for
residential refuse collection pilot program was approved on a motion made by
Councilman Samuel and seconded by Councilman Weisbach.

Ordinance No. 86-70 appropriating $1. 1 million from the FY 85 budget as
revenue from E.S.M. Bankruptcy and appropriating $805,000 to Account No. B795,
Hurricane Bonnie Disaster Account was considered:

ENTITLED AN ORDINANCE AMENDING THE BUDGET
OF THE CITY OF BEAUMONT FOR THE FISCAL
PERIOD COMMENCING OCTOBER 1, 1985, AND
ENDING SEPTEMBER 30, 1986, BY APPROPRIATING
$1,100,000 AS REVENUE FROM THE DISTRIBUTION
OF THE E.S.M. BANKRUPTCY AND APPROPRIATING
$805,000 FROM UNAPPROPRIATED AND UNRESERVED
BALANCE TO ACCOUNT NO. B795, HURRICANE BONNIE
DISASTER ACCOUNT; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Lee and seconded by
Councilman Brumley.

Mrs. Maree Calcote, 5615 Duff, chairman of the Clean Community Commission,
addressed Council to compliment the City for the clean-up efforts as a result
of Hurricane Bonnie and encouraged citizens to continue their own clean-up and
offered tips to citizens to help City crews in their work.
Mr. Lindsey Walker, 8125 Evangeline, addressed Council to express his concern
for electronic equipment purchased by the City that might not be compatible
with other electronic equipment already in place.
Mrs. Mary Sibert, Better Business Bureau, addressed Council in appreciation of
recent Council action in providing for the revocation of contractor's bonds
for noncompliance with or continued poor work under with the City's building
code standards.
Mr. Forrest F. Posey, 3695 Edmonds Street, addressed Council to remind
citizens of the 4th of July celebrations and to call for continued unity in
the community.
Mr. Larry Gouthia, 5956 Greenwood, addressed Council to suggest that prisoners
be used in some of the storm clean-up efforts and also to. speak of the
expenses incurred by Gulf States Utilties Company.

There being no further business, the meeting was recessed before continuing
with the City Council Workshop Session.
