CITY COUNCIL - CITY OF BEAUMONT
HELD FEBRUARY 18, 1986 -- 1 :15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 18th day of February, 1986, with the following
present:

No one wished to address Council during the public comment on Agenda Items 2
through 9 portion of the session.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held February 11 ,
1986 as corrected by changing the vote to reflect Councilman Moore voting Nay
on Ordinance No. 86-7;
Resolution 86-56 authorizing the Jefferson County Mosquito Control Distsrict
to operate airplanes over the City of Beaumont;
Resolution 86-57 authorizing emergency repairs to a 15" pump at the College
and Railroad Avenue Underpass by REB Industrial of Nederland, Texas, in an
amount of $2,767.00;

Resolution 86-58 authorizing purchase of 17 1986 Criss Cross Directories from
Cole Publications at $1,360.00;
Resolution 86-59 authorizing execution of an agreement with the State
Department of Highways and Public Transportation to install a traffic signal
at IH-10 West Frontage Road and Laurel Street; and
Resolution 86-60 authorizing execution of a license agreement with the Thomas
Park Homeowners Association for installation of a subdivision identification
wall at the west side entrance of the subdivision The Park on Thomas Road at a
one-time license fee of $500.00.
The Consent Agenda was approved on a motion made Councilman Brumley and
seconded by Councilman Weisbach.

Ordinance No. 86-8 changing the zoning from RS (Residential Single Family) to
RM-H (Residential Multiple Fammily Dwelling-Highest Density) on a tract of
property along the north side of the southern boundary line of Westgate Place
Addition was considered:

CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN
PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS
AS INDICATED UPON THE ZONING MAP OF BEAUMONT,
TEXAS, BY CHANGING THE ZONING FROM RS
(RESIDENTIAL SINGLE FAMILY DISTRICT) TO RM-H
(RESIDENTIAL MULTIPLE DWELLING-HIGH DENSITY
DISTRICT) FOR PROPERTY LOCATED ALONG THE NORTH
SIDE OF THE SOUTHERN BOUNDARY LINE OF WESTGATE
PLACE ADDITION, BEAUMONT, JEFFERSON COUNTY,
TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Samuel and seconded
by Councilman Brumley.

property in the 8200 to 8300 Blocks of Westgate Drive was considered:

Ordinance No. 86-10 reducing the current electric rates charged by Gulf States
Utilities Company was considered:

ENTITLED AN ORDINANCE REDUCING THE RATES
CURRENTLY BEING CHARGED BY GULF STATES
UTILITIES COMPANY WITHIN THE CITY OF
BEAUMONT.
The ordinance was approved on a motion made by Councilman Turner and seconded
by Councilman Deshotel.

Ordinance No. 86-11 amending Chapter 18, Section 18-20, of the Code of
Ordinances dealing with prostitution loitering to include the words "any
person" was considered:

ENTITLED AN ORDINANCE AMENDING SECTION 18-20
OF CHAPTER 18 OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT DEALING WITH "PROSTITUTION
LOITERING;" PROVIDING FOR SEVSERABILITY;
PROVIDING FOR REPEAL; AND PROVIDING AN
EFFECTIVE DATE.
The ordinance was approved on a motion made by Councilman Brumley and seconded
by Councilman Turner.

Resolution 86-61 accepting bids for property casualty insurance from Home
Insurance Company of Illinois for primary coverage with a $5,000,000 loss
limit and a $250,000 deductible for a total premium of $140,872 and from
National Surety Corporation for $45,000,000 excess coverage over $5,000,000
primary coverage for a total premium of $59,000 was approved on a motion made
by Councilman Moore and seconded by Councilman Weisbach.

Resolution 86-62 authorizing change Order No. 2 to the contract with Baytown
Construction Company for Contract 14A, Washington Boulevard Interceptor
sanitary sewer improvements, to adjust actual quantities of pipe and
materials and completion time at a decrease of $2,627.15, accepting the
improvements as complete and authorizing final payment to the contractor in
the amount of $53,265.71 (total project - $1 ,053,028.85) was approved on a
motion made by Councilman Turner and seconded by Councilman Deshotel.

Resolution 86-63 authorizing annual contracts for the purchase of asphaltic
oil for use by the Street Division from Texaco, Inc. for MC30 at $0.75, RC-250
at $0.75 and AC-Open at $0.6553 and Texas Emulsions for EA-Open at $0.75 was
approved on a motion made by Councilman Brumley and seconded by Councilman
Deshotel.

A resolution authorizing the City to participate in the State Purchasing and
General Services Commission Purchasing Program under Contract Class No. 205,
Data Processing tapes and accessories - IBM and IBM compatible personal
computers, was deferred two weeks on a motion made by Councilman Turner and
seconded by Councilman Deshotel.

Resolution 86-64 authorizing purchase of a truck mounted hydraulic sewer
cleaner for use by the Sewer Maintenance Division from Naylor Supply at
$53,495 was approved on a motion made by Councilman Deshotel and seconded by
Councilman Samuel.

A resolution authorizing execution of fiber optic cable licenses with MCI
Telecommunications Corp. and U. S. Telecom, Inc. at $0.60 per linear foot was
deferred for one week on a motion made by Councilman Deshotel and seconded by
Councilman Turner.

Ordinance No. 86-12 amending the 1985 - 1986 budget providing for payment for
scshool crossing guards by transferring $5,850 from fund 08, "Kitty for the
City" donations to General Fund was considered:

ENTITLED AN ORDINANCE AMENDING THE BUDGET OF
THE CITY OF BEAUMONT FOR THE FISCAL PERIOD
COMMENCING OCTOBER 1, 1985 AND ENDING SEPTEMBER
30, 1986 BY TRANSFERRING MONIES TO B-390 TRAFFIC
AND STREET LIGHTING FOR A SCHOOL CROSSING GUARD
PROGRAM; PROVIDING FOR SEVERABILITY AND
PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Brumley and seconded
by Councilman Deshotel.

Mr. Buddy Lonon, 4325 Park, addressed Council to complain about a junk yard
located at 4375 Park.

Mayor Neild called an Executive Session pursuant to Section II of the Texas
Open Meetings Act to consider personnel and litigation to be held before
reconvening for the City Council Workshop Session.

There being no further business, the meeting was recessed before holding the
Executive Session.
