BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 24th day of November, 1987, with the
following present:

The Invocation was given by Mr. Jerry Fleming, Youth Minister for
Westgate Church of Christ.
The Pledge of Allegiance was led by Michael Esterline, fifth grade
student, and Keely Clark-Windham, student-body president, Regina Howell
Elementary.

The fourth and fifth grade classes of Regina Howell Elementary School
were welcomed to today's session.

One proclamation recognizing "Beverly Smythia for her determination,
dedication and doggedness in an effort to held people and their families
with Alzheimer's Disease; and urge all citizens to increase their
awareness of this progressive disorder to join in the effort to create a
more enlightened public attitude and response to this malady" was
issued.

No one wished to address the public comment portion on Agenda Items A
and C through E.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held
November 17, 1987;
Resolution 87-233 authorizing the release of $100,000 in securities held
as collateral by Texas Commerce Bank, Beaumont;
Resolution 87-234 appointing Bubba Cousou to the clean Community
Commission, term to September 30, 1989, and Harvey Smith to the Senior
Citizens Advisory Commission, term to September 30, 1990;
Resolution 87-235 cancelling a license agreement granted to Lamar
University in Resolution 87-158 on August 4, 1987 and granting a license
to Lamar University for installation and maintenance of a 2-inch
telephone data cable across Callaghan Street at Florida Avenue to
connect the Early Child Development Center (Baby Red Bird Building)
with the Personnel Office Building to the Lamar University telephone
system; and
Resolution 87-236 listing City vehicles to be licensed with regular
license plates in accordance with Vernon' s Texas Civil Statutes, Article
6701m-2.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Samuel.

An ordinance granting a specific use permit for a coin-operated car was
at 3943 Delaware (requested by Thomas Mark Lutrilck) was not considered
because opposition of eleven (11) property owners representing twenty-
nine ( 29%) percent of the property within 200-feet, requires a favorable
vote of at least six ( 6) Councilmembers for passage and two members of
Council were absent from today' s session.

Ordinance No. 87-88 granting a specific use permit for a child care
center at 2580 North Street (requested by Mellaney Guillory) with
additional conditions for issuance: operation only during school year
between 3:00 p.m. and 7: 00 p.m. each day for not more than twenty-eight
(28) children and the site to include two-way traffic access drive with
a turn-around, was considered:

Ordinance No. 87-89 providing for the reservation of metered parking
spaces adjacent to construction projects was considered:

ENTITLED AN ORDINANCE PROVIDING A WAIVER
OF RESERVED METERED PARKING SPACE FEES;
CHANGING THE DESIGNATION OF DIRECTOR OF
URBAN TRANSPORTATION TO DIRECTOR OF PUBLIC
WORKS; PROVIDING STANDARDS FOR SAID WAIVER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Cokinos and
seconded by Councilman Lee.

Resolution 87-237 authorizing a two-year contract with REM Waste Control
II for furnishing solid waste containers and collection service for
eighteen ( 18) City facilities at a monthly cost of $1,269. 50 plus
charges for additional containers and extra service for special events
at the Civic Center, the Harvest Club, the Athletic Complex and the Best
Years Center was approved on a motion made by Councilman Lee and
seconded by Councilman Samuel.

Ordinance No. 87-90 adopting ar, updated service credit option offered
by the Texas Municipal Retirement System to keep employees' pension
benefits in line with current economic conditions was considered:

ENTITLED AN ORDINANCE DETERMINING TO GRANT PROVIDING
FOR AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS
MUNICIPAL RETIREMENT SYSTEM, AN "UPDATED SERVICE
CREDIT" IN SAID SYSTEM FOR SERVICE PERFORMED BY
QUALIFYING 'MEMBERS OF SUCH SYSTEM IN THE EMPLOYMENT
OF THE CITY OF BEAUMONT AND ELECTING AND PRESCRIBING
THE EFFECTIVE DATE OF SUCH UPDATED SERVICE CREDITS.

Mr. Bruce Hamilton, 3705 Broadmoor, owner of the structure located at
790 Avenue D, addressed Council to say that he wanted to preserve the
structure for its historical value and agreed, after questions and
discussion by Council, to establish a work program through the Code
Enforcement Department for the structure' s rehabilitation.
There being no others who wished to address the Council concerning the
above-listed dilapidated (or dangerous) structures, the public hearing
was closed.

In addition, the structures listed below have been condemned by City
Council and the owners ordered to either repair or raze the structures
within specified time frames. Reinspection of these structures has
revealed non-compliance with the Council' s order. The Code Enforcement
Division of the Community Development Department is requesting
authorization from the City Council to demolish these structures in
accordance with the Dangerous Structure Ordinance and charge the
property owners with the cost of the demolitions:

Ordinance No. 87-91 declaring certain dilapidated structures to be
public nuisances and ordering their repair or removal by the owners and
authorizing the Community Development Department to cause to be removed
certain other structures whose owners have failed to comply with
previous condemnation orders was considered:

seconded by Councilman Cokinos.

COUNCILMAN LEE:
There were two individuals in the list who were property owners of one
or more of those twenty-three structures who had . . . each, I believe,
had three structures. What I would like for us to do, and follow up on
a program I think we are beginning already, is to track back those two
individuals to see how many times we have had to demolish structures
they have owned and determine whether or not we have been reimbursed for
the money that we have spent - and I 've got the names right here. I
think that you can find it pretty easily.

Councilman Brumley suggested that a new format for dilapidated
structures hearings ' be sought, possibly with the establishment of an
Advisory Commission "where there would be some vehicle available to
where, say, an individual such as Mr. Hamilton or maybe someone who was
in opposition to the idea to their structure being condemned and torn
down by the City that they would have an appeal process to the Council
to come to us to bring the individual structure and question to the
Council but the rest of the dilapidated structure program and project
could be done by this particular body of individuals (the committee)
. . . (and) would have the ability to do the same thing that we are doing
today on a review, but make a recommendation to Council. . . . . . TV City
Attorney Nichols will research State statutues for streamlining the
process and report back to City Council.

Mr. Henry Dannenbaum, 3305 Avenue A, addressed Council to wish all a
happy Thanksgiving holiday and to urge support for agencies such as Some
Other Place and many churches for their help to the indigent.
Mr. Don Smith, 1164 Sun Meadow, representing Trax Enterprises) addressed
Council to make suggestions for the economic growth of the City.

There being no further business, the meeting was recessed before
continuing with the City Council Workshop Session.
