CITY COUNCIL - CITY OF BEAUMONT
HELD NOVEMBER 10, 1987 - 1: 15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 10th day of November, 1987 , with the
following present:

The Invocation was given by Mr. Max Dawson of the Pinecrest Church of
Christ.
The Pledge of Allegiance was led by Mayor Meyers.

One proclamation was issued: "American Education Week," November 15-21 ,
1987.

Mayor Meyers asked Council to make note that on Monday, November 23, at
10: 00 a.m. a quorum will need to be present at the Jefferson County
Commissioners Court when the Commissioners for the Navigation District
will be appointed in a joint meeting with the Beaumont City Council and
the Jefferson County Commissioners Court.

Mayor Meyers called forward Mr. Kirby Richards of the Public Works
Department, Councilman Audwin Samuel ( liaison to the Parks and
Recreation Advisory Commission) , and Mr. Bernard Perricone representing
The Travelers Protective Association of America to sign an "Adopt a
Park" agreement to perform the tasks of clearing litter, trash, debris,
and brush pickup, looking out for vandalism, be responsible for damage
reporting, and support activities such as "Concert on the Move" at
Perlstein Park on Phelan Blvd. The Travelers Protective Association of
America is the second participant in this program.

we really do continue to see a growing spirit of enthusiasm for
volunteer efforts like this, and please convey to all of those in your
organization, Mr. Perricone, Council' s appreciation for coming forward
and accepting Perlstein Park. If each group, club, organization,
neighborhood continues to come forward and take just another piece, just
another park, just another street, I think we' ll look around in a few
years and be pleased with what we achieve. Thank you very much.

Mayor Meyers introduced Mrs. Peggy Hickman and Mrs. Leona Rush, members
of Alpha Omega of First United Methodist Church. Mrs. Hickman invited
Council to be guests at the 47th non-profit fashion show conducted by
Alpha Omega at the Julie Rogers Theater on November 12th at 8: 00 p.m.
Fashions will be presented by The White House, and proceeds will provide
scholarships for Lamar students and help" other organizations.

Public comment on Consent Agenda items and Item B-1 was called. No
citizens wished to address Council on these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the Regular City Council Session held
November 3 , 1987;
Resolution 87-226 authorizing Texas Commerce Bank - Beaumont to pledge
securities in the amount of $1,200,000 with Texas Commerce Bank -
Houston and release these securities effective November 13 , 1987 ;
Resolution 87-227 appointing Dr. William S. Nantz, represeanting Health
Care Provider, to the Health Advisory Board with a term expiring July
311 1989; and
Resolution 87-228 authorizing purchase of Parcel 20 : a portion of Lot
181, Block 16 of the B. D. Crary Addition, D. Brown Abstract #5 from
Isaac Moses and Najeeb Moses d/b/a Moses Gun and Lock Smith in the
amount of $31,000 for the College Street T. I .P. Project and authorize an
agreement with Isaac Moses and Najeeb Moses for removal of the building
from the right-of-way at the agreed sum of $8 , 000 totaling $39 , 000.
The Consent Agenda was approved on a motion made by Councilman Lee and
seconded by Councilman Brumley.

An ordinance granting a specific use permit to Latexco International of
Alexandria, Louisiana, for a wastepaper and recycling plant (postponed
from the October 27th agenda and delayed for action from the November
3rd meeting for more information to be developed by the Planning Dept. )
at 3540-50 South Eleventh Street with stipulations that no truck traffic
be permitted or machinery be operated between 7:00 p.m. and 7: 00 a.m. , a
pit baler shall be enclosed with a roof and solid walls, storage
materials no higher than an eight-foot fence, noise level not to exceed
65D.P. , no vehicular access from Westmoreland and Anita, a landscaped
buffer zone be provided, with an eight-foot solid wood fence maintained
on the north, west and south side of the property was considered:

USE PERMIT FOR A WASTEPAPER AND RECYCLING
PLANT ON PROPERTY LOCATED AT 3540-50 S.
ELEVENTH STREET, BEAUMONT, JEFFERSON
COUNTY, TEXAS.
Councilman Lee raised questions concerning verification that school bus
routes did not pick up children on Eleventh Street, that there would be
no access from Anita or Westmoreland Streets into the plant, and that
the Health Department feels comfortable with the facility concerning a
rodent problem. Mr. Anderson of the Planning Department verified these
assumptions were correct.
Mayor Meyers asked how many jobs would be provided by this endeavor.
Mr. Anderson stated the applicant estimated six with a possibility of
eight if the business was extremely successful.
Councilman Moore questioned their plan of rodent control. Mr. Anderson
reported that the Health Department' s statement is related to the
turnover of the bundles of paper. The rodent problem grows with
longtime storage of materials that creates a shelter for them. There is
a quick turn-over of these materials. Councilman Moore asked if
consideration had been given to 18-wheelers causing deterioration to
streets and entering the surrounding residential district, and if there
were damages to the streets, who would be responsible for the repairs?
Mr. Anderson stated that 18-wheelers from this particular plant would
not be entering any adjacent streets. They would travel only on
Eleventh Street which is designed as a major arterial street that can
handle that type of traffic, and if sufficient evidence could prove a
particular carrier responsible, they would be responsible for the repair
costs.
Councilman Brumley made a motion, seconded by Councilman Lee to approve
the ordinance.

Mayor Meyers announced that he has been challenged by Disc Jockey Al
Caldwell of Radio Station KLVI to a "Joke-Off" at 2 :00 p.m. , Sunday,
November 15, during the final "Sunday in the Park" program. There will
be an Olympic-type judging system (using score cards with 0, 3 , 5, 8 or
10 points) with City Council members as Official Judges. An appropriate
prize will be presented to the winner.
Councilman Brumley thanked everyone that participated in the Elissa
project and wished Councilman Lee Happy 1140th" Birthday!
Councilman Lee reported that almost 18,000 people toured the Elissa
during the week long stay at Riverfront Park and was a great success in
terms of creating enthusiasm in the community and also thanked everyone,
including Council, for being supportive and involved in the project. He
also reported that sponsors for the Grand Finale of the "Sunday in the
Park" activities would be a combined effort of former hosts of the past
thirty Sundays.
Councilman Cokinos expressed congratulations to Mayor Meyers for another
success in promoting the Elissa project.
Councilman Moore requested that City Attorney Lane Nichols supply
Council information regarding tort reform that exempts governmental
bodies from any level of reimbursement to citizens for damages done,
announced that the Fire Department will soon begin their Holiday Food
Drive and asking citizens to bring their donations to the local fire
station, thanked the Southeast Texas Historical Society for an excellent
program in bringing the Morehouse Glee Club to perform in Beaumont, and
thanked the media and the constituents of Ward IV for attending the Ward
Meeting last Tuesday. The second of these meetings will be tonight at
Blessed Sacrament Educational Building on Porter Street.
Councilman Smith stated that she and the City Manager just returned from
a very impressive two and one-half hour tour of the construction of BISD
and congratulated them for accomplishing this without a tax increase or
floating bonds.
Mayor Meyers reminded Council that the Summit II Planning Dinner is
scheduled for Thursday evening when the action plans for Summit II will
be developed. Dr. Jack Gill, former Lamar graduate who is now a venture
capitalist in California and around the world, and former astronaut
Walter Cunningham, and investment businessman in Houston.

Mrs. Delia Harrington, 815 Willow, addressed Council to compliment the
Sesquicentennial activities and bringing the Elissa to Beaumont, to
express disappointment in not passing the ordinance that would allow new
business to make Beaumont grow, and to complain about the sprinkler
system at "Welcome to Beaumont Park. " Mr. Kirby Richards of the Public
Works Department responded that the repairman had been contacted and
will make the proper repairs.

Mr. Louis Vaughn, 2475 Ranier, addressed Council as a representative of
the West Oakland Addition residents to thank them for the consideration
given to their concerns about the recycling plant, thanked Councilman
Moore for conducting the Ward IV Meeting and the ongoing meetings
scheduled that give opportunity for citizens to discuss their concerns,
and thanked Staff members that attended this meeting.
