BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 8th day of September, 1987, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Haines City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation °,:gas given by the Reverend Dudley Wilson, pastor of Calder Baptist Church. The Pledge of Allegiance was led by Councilman Samuel. -000- 00 proclamation was issued proclaiming September 12, 1987, "Aviation Appreciation Day. " The Beaumont Aviation Association is sponsoring an "Aviation Appreciation Day" to be held on September 12th at the Municipal Airport, and this celebration is listed on the Sesquicentennial Commission's Official Event Calendar to celebrate Beaumont's sesquicenterniai ana provide the public with a greateL awareness of aviation. -000- MAYOR MEYERS I would like to take a moment now and wish a few people well and at the same time congratulate them. First, I'd like to ask Carl Stewart to come forward, if he would. Carl is the man running the show with the Our Mother of Mercy Choir that I think everyone knows is really a forceful, wonderful group to listen to and enjoy, and Carl, how many groups did you compete with? CARL STEWART Ah, I think there were a total of 78 that made application. MAYOR MEYERS There were 78 groups of which 12 were selected to provide entainment for the Pope's visit to San Antonio, and today, we'll have in our Council Chamber two of the twelve -321- September 8, 1987 coming from our City of Beaumont who have selected from, I guess just about everywhere, to provide entertainment for the Pope. First, Carl's group could not come today, but we're glad that you did, and Council wishes you well. We're very proud of you. I think that the Our Mother of Mercy Choir is becoming pretty well known. Not only in the City of Beaumont and it's limits, but throughtou t the State, the Region, and the United States, and we're extremely proud that you'll be performing in San Antonio, and we wish you well and offer you opportunity to make any comments you'd like to today. MR. STEWART Thank you. I'm just very honored that we have the opportunity and that we were blessed with the type of personnel that it took to present the music and the talent to be accepted. It's quite an honor for myself, and I speak on behalf of all of our choir members and the parrish, Our Mother of Mercy Catholic Church and Community. And, I want to thank the Council for giving me the opportunity to be present here today. Thank you very much. MAYOR MEYERS Thank you and good luck, Carl. The young lady that you see standing in front of the group know as The Sounds of Silence is Deidre Ward. First, I'd like to thank them for yesterday's entertainment at "Sunday in the Park. " Those who were present, I know, enjoyed the entire group, and I would mention to you that the second group of twelve that will be performing for the Pope is The Sounds of Silence, and Deidre, I think you have a number prepared for us today. Fine, I'm gonna let you take over. The group consisting of Loren Grady, Justin Robinson, Brian Taylor, Dorothy Henry, Cindy Heiz, Jocylyn Taylor, Patty Henson, Debra Robinson, Connie Killebrew and Deidre Ward performed the song "Reach Out and Touch Somebody's Hand" in sign language. A GROUP MEMBER (signs interpreted by Deidre Ward) We, all of us, from the Sounds of Silence would like to give a gift to you, Mayor, right now from the hearing impaired. We really enjoyed our singing, we enjoyed, .and: we.,- are very proud. God is really with us, and we now have a gift for you. MAYOR MEYERS Thank you. You just provided a gift. Thank you very much. Open it, I have to open it if I kiss you. Oh, my, that's beautiful. GROUP MEMBER That means be friends. MAYOR MEYERS Okay, I'll buy that. . .Deidre, we thank you. I think there perhaps are some others that are not here today. I think there are a few more in the group. Yesterday, you had everybody at the park just spellbound, and it was most enjoyable, and as we wish Carl and the Choir great success in San Antonio, we're very proud of you and we know you will do equally as well in representing Our Mother of Mercy Church, the Sounds of Silence, and the City of Beaumont, and quite frankly we couldn't think of any better -322- September 8, 1987 representative to send than you, and I thank you very much for your thoughtful gift, and we wish you good luck on your trip to San Antonio to appear before the Pope. Thank you.. . -000- No one wished to address Council concerning Agenda Items A through C-4. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held September 1, 1987; Resolution 87-182 authorizing eminent domain proceedings to clear the title to a parcel of land designated at Parcel No. 104 needed for Martin Luther King, Jr. Parkway/Spur 380 right-of-way on the north side of Lyle between Park and Pennsylvania; and Resolution 87-183 authorizing an agreement with Southern Pacific Transportation Co. for a railroad crossing permit for an 18" sanitary sewer outfall line under construction for the Gulf Terrace/Westfield Terrace subdivision for a one-time fee of $300. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Resolution 87-184 adopting the proposed Program for Mass Transportation Services for Handicapped persons was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- ^rdir�ance No. 87-69 reducing the Special Trans w :rvice fare for non-handicapped adults to $1. 50 was considered: ORDINANCE NO. 87-59 ENTITLED AN ORDINANCE AMENDING CHAPTER 28, SECTION 28-6(C)(3)(1) OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT PERTAINING TO THE REDUCTION OF FARES FOR SPECIAL TRANSIT SERVICE NON-HANDICAPPED ADULT FARES; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Ordinance No. 87-69 was approved on a motion made by Councilman Cokinos and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- -323- September 8, 1987 Ordinance No. 87-70 lengthening the reduced speed school zone on Corley Avenue in the vicinity of Eighth Street by moving the eastern limit of the zone 125 feet further east to prevent school zone signs being obscured by railroad crossing signals was considered: ORDINANCE NO. 87-70 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH SCHOOL SPEED ZONES; PROVIDING FOR SEVER- ABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 87-70 was approved on a motion made by Councilman Brumley and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- A resolution awarding a contract to TX TX, Asphalt Division for furnishing asphaltic concrete for street work due to default by Keown Supply (Keown Supply was awarded the contract by Resolution 86-364; Keown notified the City their operations furnishing this material has been closed in Beaumont and cannot supply this item. Keown has been notified of their obligation to reimburse the City for any additional expense which may be involved in purchasing materials from a different supplier.) was considered. Councilman Cokinos inquired if there would be any affect on the redirecting of the contract for ready mix concrete by default of Keown Supply to American Builder's Concrete Company with the redirecting of this contract, again by default, from Keown Supply to TX TX, Asphalt Division. Public Works Director Tom Warner affirmed that for each product the remainder of the contract will go to the second low bidder and neither will affect the other. Resolution No. 87-185 awarding a contract to TX TX, Asphalt Divison for furnishing asphaltic concrete for street work at $25.50 per ton for hot mix asphalt and $26 per Lon for hot tuiw, ;.old laid asphalt was approved on a motion made by Council-tan Brumley and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -oCo- A Public Hearing was called concerning the Proposed Budget for Fiscal Year 1987-1983. City Manager Haines announced there will be present-year encumbrances that will need to be carried over, therefore, requiring a second Public Hearing to be conducted on September 22, 1987, the last regular Council meeting at which Council may adopt the budget with or without amendments prior to the deadline for adoption, three days prior to the end of the Fiscal Year. Mr. C. L. Sherman, 585 Belvedere Drive, addressed Council to oppose increased garbage fees or increased taxes being incorporated into the new budget. Mr. Rick Warchol, 1155 IH 10 South, addressed Council in opposition of rate increases for garbage pickup, in support of privatization of residential garbage pickup, and solicitated a contract for garbage pickup through Waste Management at a proposed lower fee than charged by the City. -324- September 8, 1987 Mrs. Maree Calcote, 5615 Duff, addressed Council in opposition to privatization of sanitation because of unseen limits and problems that do not appear on the surface. There being no other citizens to address Council concerning the proposed 1987-88 budget, the Public Hearing was closed. -000- Councilman Brumley reminded everyone that September 24th will be the finale of "Concert on the Move" for this season. The hosts will be Councilman Cokinos, Councilman Lee, and the Parks and Recreation Advisory Commission beginning at 7:00 p.m. in Tyrrell Park. Councilman Lee reported that last week's "Sunday in the Park" hosted by the Mayor's Commission for the Employment of the Disabled was highly successful. Sunday, September 13 th, the Downtown YMCA will host "Sunday in the Park" and have a wonderful afternoon of activities planned from 2:00 to 4:00 P.M. Mayor Meyers requested that Public Works Director Tom Warner investigate a complaint made by Becky Werner concerning the timing of the "walk light" on Highland and Woodrow not being long enough for children to cross the street and requested that some kind of alteration be given to the breaks in the concrete walkways near the covered area in Riverfront Park that create an unsafe path for those in wheelchairs. Councilman Cokinos expressed appreciation to Tom Warner for the quick response in installing four-way stops signs at intersections on Usan and Houston Streets. Councilman Smith reminded citizens that there will be an evening Town Meeting at the Beaumont Independent School District Administration Office on September 29, 1987, on Harrison Street at the IH-10 access road. -000- Mrs. Maree Calcote, 5615 Duff, representing the Clean Community Commission and Beautify, Inc. addressed Council to show a slide of the Pearl-Orleans Connector Project that Beautify, Inc. has undertaken. They have placed five large, blooming Crepe Myrtle trees, an Oak tree and a planter in the area, cleaned the weeds and litter plus repair the mural on a building. The area is now being maintained by the Beaumont Housing Authority as part of Operation Clean Street. Fifty-seven businesses and people donated time with an inkind service of $10,000 to the City for this project. On September 23, 1987 there will be a dedication of this area at 4:30 p.m. Mrs. Calcote later introduced Mr. Lynn M£lam as Chairman of Beautify, Inc. Mrs. Patty Henson, 630 Dewey Street, addressed Council regarding parking problems created by Lamar students on Dewey Street and two adjacent streets. Parking is restricted to one side of the street, but students are violating the parking restrictions making it impossible for an emergency vehicle to enter the street in case of fire. Henry Dannenbaum, 3305 Avenue A, addressed Council regarding consideration of an ordinance prohibiting beer sales until 4:00 p.m. on Sundays, the unemployment of -325- September 8, 1987 our area and the feeding program of St. Mark's Episcopal Church and Some Other Place, complimented Channel 6 personnel for reporting the Muscular Dystrophy Association Drive, and complimented the Mass Transportation Services for Handicapped Persons program. -000- Mayor Meyers called an Executive Session, pursuant to Section IIe of the Texas Open Meetings Act, to discuss contemplative litigation. -000- There being no further business, the meeting was recessed before continuing with the City Council Workshop Session. -000- 2, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the regular City Council session held September 8, 1987.
