BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 7th day of April, 1987, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. The Pledge of Allegiance was led by Councilman Weisbach. -000- MAYOR MEYERS: We are very fortunate as a community to have some extremely good Corporate friends in Union Pacific Railroad Company. Those who attended Sjmmit 2 had opportunity to witness words by Mr. Michael Walsh, their chairman, in support of our City. As well, the Union Pacific has a performing arts program tnat is now here in our City and will be performing at the Julie Rogers Theater. We-re very pie--.sed - that's going to be Thursday, April 9th; but 1 would like to ask Trish ..' or2arson with Union Pacific if she would come forward and introduce our guest artists who will favor us today with out national Anthem. MS. TRISH JORGANSON: Thank you. We are delighted to be here today and were asked to participate in the swearing in and we think that's just a wonderful opportunity for us. I would like to Introduce Jan Christensen who is the pianist and Elizabeth (Lisa) Braden who is a soprano. Since there Isn't a piano, she is going to be doing acappelia today. Lisa received her Masters from Juliard and Jan Christensen from Northwestern and Jan 'Lives in Denver and Lisa lives In New York when she isn't touring on behalf of Union Pacific. Oh, one thing that I might add to the performance on Thursday night, it's free to the public so you can't beat that price so pi-ease come and join us and I will turn it over to Lisa now. -131- April 7, 1987 a MAYOR MEYERS: Thank You, we had the pleasure of hearing them yesterday and we are delighted that you would come today. Ms. Braden sang the National Anthem MAYOR MEYERS: Lisa, thank you so much; Trish, thank you and Jan, we thank you. They-re heading now to West Orange where they'll perform for the students at West Orange School. Then, our thanks again to Union Pacific. Thank you very much. I think everyone will enjoy the program that they have planned for Thursday evening. It will be very diverse and I think, as Trish mentioned, the price is sure right. -000- One proclamation was issued: "Child Abuse and Neglect Prevention Month in Beaumont- - April, 1987. -000- Mayor Meyers called an Executive Session, pursuant to Section II(e) of the Texas Open Meetings Act, to consider contemplative litigation, and to be held immediately following the City Council ilv'orkshop Session. -000- The following Consent Agenda item-s were considsered: Resolution 37-71 au-1-horrizing the pledge of $503, 181.91 in securities and the release of $506,382. 25 in securities held as collateral for City Deposits by Texas Commerce Bank of Beaumont; and Resolution 87-72 authorizing execution of a license to encroach agreement with David Lake, presidlen�t of American 'ealth Services, Inc. , for a 650-foot-wide strip of unimproved section of 'Iilam Street right-of-;gay between Lots 13 and 19 of the Columbus Cartwright Addition to be used as an access drive. It's been a pleasure working for my City and although I won't I T��a on be in this seat, I will still continue to work ,, nks again. -133- April 7, 1987 COUNCILMAN LEE: I would like to add, if I might, that Mrs. Weisbach has lent a great deal of class to this august body and we really will miss you and appreciate all that you have done for us. Thank you. COUNCILMAN BRUMLEY: Two things, and -maybe this will be the appropriate time; first, to thank Nell for all that she's done for the Council the past three years. She's been a great deal of help. She's added to the Council on probably more than she'll ever know and she's been a sweet person in addition to a Council lady. She's always appreciated everyone that's a Councilmember and the Mayor and we will miss you very much and we will always think about you on Tuesdays. And, then, in response to Saturday, if this will be an appropriate time, there are some people that I would like to . . . it is a great honor to me to have here. They've never participated. They don't live in this City but I have visiting -,my . . . Mr. and Mrs. ola-mes Blake which are my wife Georgia's mother and father. They are here from Lake Charles - if you want to stand, it will make me happy. And, then, to use a good phrase because it's used all the time, two people that if it wasn't for them, I wouldn't be here. My mother and father are from T�ongview and this is the first time they've ever found an opportunity to see their son - we have a Beaumontite that 'Lives in Longview that takes the paper so they keep up with me occasionally through that line, but they've given me the start-off in my life to be able to participate in the City of Beau7nont. And, Mom and Dad, this is Burt and Eloise Brumley. They are here. Then the concrete at home, Ceorgia and Olivia and Lauren, girls . . . . . . It is a happy time for me to go and communicate and two people are here that have become sp-_c I a1 people to me, especially over the last few days, because they have been able to clean my act up on a daily basis - first Linda Sculley who was always by my side for the past couple of months. Linda . . . and Laura Assunto, who has the coldest swimming pool, in the City of R:?aurnon t There is a great spirit in the City of Beaumont and I felt it and the vaople In this City are great and you really g-at a char 5e for tne ne)CC U-40 years with what kind of communication you have during an al-ction. and I'd just like to thank the City of Beaumont. mk`fo� MEYERS: Thank you, Mike. David . . . COUNCILMAN MOORE: It's my turn, right? It's good to be back. You never know how, much you appreciate soi-tiething unless you have to work real hard to get it back and that's what happened this last couple of months, as Mike stated; but Saturday expressed to me a sincere vote of confidence by my cons ti t-Ute n ts and the many people who are not in my Vard who assisted me this past weekend to work. I don't want this City Council to sound like "Family Feud" but Mike has acknowledgad family and I - would like to acknowledge my father who took the time . . . stand up, Tja,1, so that they can se- who You are (Mr. Colton Moore). -114- April 7, 1937 MAYOR MEYERS: I had to keep getting him to take that hat off last night so that I could see the fight . . . . . . COUNCILMAN MOORE: And, also, Herman Rogers, who is not here today, was really a major, major asset to me but Dr. Marcia Green is here and the lady who is also one of My mothers, Marie Hubbard. Would you two ladies please stand. Thank you. And, also, Nell, it has been really a pleasure serving with you. You've brought dimension to this Council that's many of us learned about and many citizens never knew about and we certainly are going to miss you and you were also extremely helpful in supporting me when I was knew with your level of experience and I wish you the very best. I am fairly new at the job and this is the first Oath that I've ever administerad so I'll do the best we can here and I am sure that if I do this for -a-,ay -years, I'll never administer another oath more important. than this one and on behalf of the people of the City, I commend you for talking on this respoasibility and we-re behind you 100 percent. -135- April 7, 1987 The Oaths of Office were administered to Councilmen Smith, Brumley, Samuel and Moore. MAYOR MEYERS: Thank you, very much, Judge. We welcome you (to Councilman Smith) to our City Council. I think you will find this group to be diverse and effective whici I believe makes them effective. I mentioned earlier we will take opportunity to visit with you this week at your convenience to outline the Council responsibilities and the Manager likewise has prepared an orientation to familiarize you with the Departments and some of the goings on and I think you will also know that everyone on Council stands ready to answer any questions that they can; but, I would only make one co-aiment at this point because I think it is pertinent. A Council, to work effectively and do its job well, has to recognize that there's a right and a wrong and I think they have to C, r%acogm.7,e that the fact that we agree or disagree is of no consequence because to agree always Is certainly not right but that our responsibility is equity and I think very simply if we can always ask . . answer the question, "Are we willing to do for everyone what we would do for anyone, then you, as a Council I think are administering your responsibilities with equity and I don't think that the citizens of our City ask for anything more than that at any time and I am delighted to have you join. us. I live at 815 Willow Street in Beaumont, Texas. (Mrs. Harrington read the resolution. ) RESOLUTION 37-73 WHEREAS, in 1986 the City of Beaumont entered into a maintenance agreement with the State of Texas for an area generally bounded by U. S. 90 Business and North Street; and WHEREAS, such area was temporarily designated "Welcome to Beaum.ont Park" until such time as a more appropriate name could be chosen; and ';1HEREAS, the City has proposed a new name to the State Department of Highways and Public Transportation and the State has agraed to a name change. Larry . . . . . . -137- April 7, 1987 BEAUMONT: Well, just for the benefit of those who are in the audience today, I don't th I nk Delia Harrington needs any introducing to very many people; but since the time that the Chamber worked to put the "Welcome to Beaumont Park" in, we have just been deluged with recommendations from people that the only name that can go on that park and mean so,.,-nething in this City is Delia Harrington's name. We have approached a very receptive Mayor and Council and we are just delighted that they'd honor you, Delia. As citizens of the City, you are one of what we are most proud of. MRS. HARRINGTON: Thank you. Thank you. Bless you all. I am going to tell all of you what I said to the Rotary Club, you know. Mr. Beaumont was at that. I received a key from the Rotary Club and I wanted to say I a-in getting my flowers while I am living so when I die you don't have to bring any flowers. MAYOR. MEYERS• Right,ght, right. MR. BEN ROGERS: Will you all take your seats. I didn't plan to say anything but I am inspired. I think that's the biggest thing that you could have done for Mrs. 1 She's a beautiful 'lady and ever since I have come off that ramp, Harrington. she's out there taking care of that park before it was a park and we are so deltg'ted and pleased that we have people like this. Number two, I want to extend our congratulations to our Mlayor who is now Fir. East Texas. I presume many of you read that but that's a great honor. That's a great distinction he brought back to Beaumont. It was this loss that led to the birth of the "Welcome to Beaumont Park" and be it further resolved that I, Maurice Meyers, Mayor of the City of Beaumont, do hereby honor Delia Harrington on this 7th day of April, 1987, and proclaim for all time that the "Welcome to Beaumont Park" be called "Delia Harrington's Welcome to Beaumont Park" in honor of Delia Harrington whose dedication and initiative is preeminent and who for all time 'shall. be an example and inspiration to all. I call upon each citizen to recognize on this day to participate in this special observation and when you see Delia tell her how proud you are f or her. DR. LYNN DRAPER: Mayor, I don't have extended comments. T do just want to congratulate Delia on this wonderful day and thank you and the City Council for this honor. Any additional cost shall be borne by licensee. Such property owner shall not be liable for consequential damages. " was approved on a motion made by Councilman Lee and seconded by Couricii-man Brumley. After further dis-cussion of the Minority Business Enterprise program and the we akne s se s and strangths of the program, Councilman Ja tpl withdrew his motion to delay t%ese contracts pending further Y 3�ld Its policies. kpril 7, 1937 Council requested the criteria used in selecting.', consulting engineers. Mr. Tom Warner, Director of Public Works responded that proposals were requested of all area firms and that approximately six areas of criteria are used to determine the best firm based on particular expertise needed for particular projects. Mrs. Maree Calcote, Chairman of the Clean Community Co mission, addressed Council to report that a very large planter for a large tree was to be placed on the Pearl/Orleans Connector as part of the Beautify Beaumont efforts. Mrs. Calcote also reminded that April 25th would be the "Trash-011f Day in Beaumont" ar.d that there would be three areas designated within the City for collection of litter and trash. Mrs. Marie Hubbard, 1990 Nora, addressed Council to ask help on behalf of a former city employee who was one of those laid off and who has been unable to find other employme-nk t. Rosemarie Chlappetta Deputy City Clerk -142- April 7, 1957 EXCERPT FROM REGULAR CITY COUNCIL SESSION HELD APRIL 7, 1987 CITY MANAGER: The next item under Finance is a request that Council authorize a resolution awarding a contract to Keown Supply Company for furnishing a year's requirement of ready mix concrete for street repairs. Keown was low bidder on furnishing some three hundred cubic yards of 5-sack cement mixture with 1-1/2 inch aggregate for $50.00 a cubic yard and supplying some one hundred cubic yards of quick setting Type III high early cement mixture at an additional cost of $1.75 per cubic yard with one (1X) percent calcium content and $3.25 for two (2%) percent calcium content. We recommend approval. MAYOR MEYERS: This is item D.7. Do we have a motion? COUNCILMAN COKINOS: No, a question, Mr. Mayor. I have one question as to the low bidder. Is it State approved as far as the batching plant is concerned and the mixing truck and the material that's involved in this contract? Is it State approved? I didn't hear you. MRS.
