Moore Councilman, Ward IV Karl Nollenberger City Manager Hugh Earnest Asst. City Manager Tyrone Cooper Asst. City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend D. A. Smith, pastor of St. Paul's AME Church. The Pledge of Allegiance was led by Mayor Neild. -000- Three proclamations were issued: "Catholic Schools Week in Beaumont" - February 3-9, 1985; "American History Month in Beaumont" - February, 1985; and "Gerilyn Ann Williams Day in Beaumont" - January 29, 1985. -000- The following items of the Consent Agenda were considered: Resolution 85-27 authorizing purchase of a desk top model copier for use at the Water Production Plant from Office Development Systems at $1,850.00; Resolution 85-28 authorizing removal of conditions attached to conveyance of land to the Cerebral Palsy Foundation to allow them to sell surplus property in an unrestricted market; Resolution 85-29 authorizing acceptance of an assignment of a lease between Lamb's Printing & Stationery Company and the Jefferson County Adult Probation to the City of Beaumont; and Resolution 85-30 authorizing purchase of a digital potentiometer for use in the Water Department from Rawson and Company at $1,050.00. -16- January 29, 1985 Resolutions 85-28 through 85-30 were approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes: All Nayes: None Resolution 85-27 was approved on a motion made by Councilman Deshotel and seconded by Councilman Brumley. Question: Ayes: Mayor Neild Abstained: Councilman Councilman Samuel Deshotel Councilman Councilman Turner Moore Councilman Weisbach Councilman Brumley -000- Ordinance No. 85-9 authorizing a rate increase for Entex, Inc. was considered: ORDINANCE NO. 85-9 AN ORDINANCE OF THE CITY OF BEAUMONT, TEXAS, FIXING AND ORDERING THE RATES TO BE CHARGED BY ENTER, INC. , FOR GAS AND GAS SERVICE TO RESIDENTIAL AND SMALL COMMERCIAL CUSTOMERS WITHIN THE CITY OF BEAUMONT, TEXAS, ESTABLISHING THE EFFECTIVE DATE, MAKING MISCELLANEOUS PROVISIONS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Weisbach. Question: Ayes: All Nayes: None -000- Ordinance 85-10 appropriating funds and authorizing employment of Brady, Taylor and Associates (BT & A) for a tele-communications study at a total cost not to exceed $55,500.00 was considered: ORDINANCE NO. 85-10 ENTITLED AN ORDINANCE AMENDING THE FISCAL BUDGET OF THE CITY OF BEAUMONT COMMENCING OCTOBER 1, 1984 BY APPROPRIATING 55,500 FROM THE UNAPPROPRIATED FUND BALANCE TO AN ACCOUNT TO PAY FOR A TELECOMMUNICATIONS STUDY; PROVIDING THE EMPLOYMENT OF BRADY, TAYLOR AND ASSOCIATES FOR SUCH TELECOMMUNICATIONS STUDY; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. -17- January 29, 1985 The ordinance was approved on a motion made by Councilman Moore and seconded by Councilman Weisbach. Question: Ayes: All Nayes: None -000- Resolution 85-31 authorizing execution of a labor agreement with the Beaumont Police Officers Association for 1985 was approved on a motion made by Councilman Moore and seconded by Councilman Turner. Question: Ayes: All Nayes: None -000- Resolution 85-32 accepting the 1984 Community Development Block Grant Street Rehabilitation Program as complete and authorizing final payment to A. W. Busby Contracting, Inc. , at $6,441.39 (total project cost - $128,827.78) was approved on a motion made by Councilman Turner and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 85-33 accepting the recommendations of the Airport Advisory Committee for a policy on service recognition for a Beaumont Aviation Award was approved on a motion made by Councilman Turner and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Councilman Turner reported that the asphalt surface on Conrad between Royal and Craig had been torn up during a sanitary sewer and storm sewer separation project over four months ago and the street still has not been resurfaced. He requested that the matter be addressed soon. After a discussion resulting from a question by Councilman Turner relative to the public notification requirement for planning and zoning cases, the Manager and Planning staff were asked to determine some method of establishing ownership of non-profit properties for proper public notification for pending zone changes. COUNCILMAN MOORE: Too often good deeds go unnoticed and this Sunday I had the opportunity to attend the honoring of the people that worked in the Blood Drive and I would just like to compliment the number of City employees from the various departments that participated and were recognized with Certificates of Appreciation. -18- January 29, 1985 A "Memorandum of Understanding" between the City of Beaumont and District 4 State Senator and Districts 22 & 23 State Representatives was agreed on in answer to a suggestion by Councilman Samuel "to maintain an open channel of communication and good working relationship" between the State and local governments. -000- Mr. Gene Darst, 585 Iowa, addressed Council to complain about the high tax rate and City spending, especially in areas of surveys through consultants. Mr. Dan Kohlhofer, 855 Howell, addressed Council to urge enforcement of litter laws. Mrs. Halie Lindsey, 1833 Sabine Pass, addressed Council to complain that rehabilitation work started on her home in November under contract through the City's CDBG Rehabilitation Loan Program is not being properly done and asked for help in getting the work completed. -000- Mayor Neild called an Executive Session pursuant to Section II of the Texas Open Meetings Act to be held immediately following the City Council Workshop Session. -000- There being no further business, the meeting was recessed before continuing with the City Council Workshop Session. -000- I, Myrtle Corgey, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held January 29, 1985.
