The City Council of the City of Beaumont, Texas, met in a regular session on October 1, 1996, at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Mayor Moore called the meeting to order at 1:30 p.m. Mr. Bill Walker, of the Westgate Church of
Christ gave the invocation. Mr. Lynn DeMary, president of Federation of Neighborhood
Associations, led in the pledge of allegiance.
Present at the meeting were: Mayor Moore, Mayor Pro Tem Cokinos, Councilmen Ames, Smith,
Goodson, and Davis. Councilman Bobbie Patterson was absent. Also, present were Ray A. Riley,
City Manager, Lane Nichols, City Attorney, Patrice Fogarty, City Clerk, and Barbara Liming, Dep.
City Clerk.
Mayor Moore announced an executive session to be held in accordance with Section 551.071 of
the Government Code to discuss pending or contemplated litigation regarding the claims of
Mandolyn J. Stanley, Cynthia Foutz, and Joseph Trahan, and in accordance with Section 551.074
of the Government Code, regarding the annual evaluation of the City Manager.
Citizens were invited to comment on the Consent Agenda. No one wished to address these topics.
CONSENT AGENDA
The following consent agenda items were considered:
* Approval of minutes of the September 24, 1996, meeting;
a. Confirmation of committee appointments - No committee appointments;
b. Authorize the acquisition of property - Resolution Nos. 96-227 and 96-228;
C. Authorize a Pipeline License Agreement with Centana Intrastate Pipeline Company -
Resolution No. 96-229;
d. Approve the purchase of various sized water pipe and fittings for use by the Water
Distribution Division- Resolution No. 96-230;
e. Reappoint Lupe Flores as the Chief Magistrate of the City of Beaumont - Resolution
No. 96-231;
f. Reappoint James D. McNicholas and Theodore Johns as Magistrates of the City of
Beaumont - Resolution No. 96-232;
g. Approve an annual salary increase for the City Attorney - Resolution No. 96-233;
h. Accept improvements constructed in Oakmont Addition for City maintenance - Resolution
No. 96-234
Councilman Davis moved to approve the consent agenda. Councilman
Ames seconded the motion. MOTION PASSED.

GENERAL BUSINESS
1. Amend Section 26-24 of the Code of Ordinances dealing with school zones.
Mayor Pro Tem Cokinos moved to adopt Ordinance No. 96-55
ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-24 OF THE
CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO AMEND SCHEDULE A
IN SCHOOL ZONES;PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL;
AND PROVIDING A PENALTY. Councilman Ames seconded the motion.
MOTION PASSED.

Smith, Goodson, Ames, and Davis
Noes: None
2. Approve a lease agreement and an operations agreement with the Art Museum of Southeast
Texas.
Councilman Smith moved to adopt Resolution No. 96-235, approving
a lease agreement and an operations agreement with the Art Museum
of Southeast Texas. Councilman Ames seconded the motion.

3. Approve agreements with Bison Leasing Texas, L.P. to finance the purchase of seven
pieces of equipment.
Councilman Ames moved to adopt Resolution No. 96-236, approving
agreements with Bison Leasing Texas, L.P. to finance the purchase of
seven pieces of equipment. Councilman Goodson seconded the
motion. MOTION PASSED.

4. Approve a contract with the Innovative Housing Development Corporation which will provide
assistance for 11 new home purchases in the Charlton-Pollard neighborhood.
Councilman Smith moved to adopt Resolution No. 96-237, approving
a contract with the Innovative Housing Development Corporation which
will provide assistance for 11 new home purchases in the Charlton-
Pollard neighborhood. Councilman Davis seconded the motion.
MOTION PASSED.

5. Approve agreements between the City and Houston Pipe Line Company and MidCon Texas
Pipeline Corporation for the relocation of their pipelines at the City's landfill.
Mayor Pro Tem Cokinos moved to adopt Resolution No. 96-238,
approving agreements between the City and Houston Pipe Line
Company and MidCon Texas Pipeline Corporation for the relocation of
their pipelines at the City's landfill. Councilman Goodson seconded
the motion. MOTION PASSED.

OTHER BUSINESS
Review proposed 1997 Street Rehabilitation Program, as attached hereto and made
a part hereof.
Councilmembers comment on various matters.
Mayor Moore spoke of Councilman Patterson's soon return to Council
and recovery from an accident and her interest and involvement in
voter registration this past weekend. He requested that Lyle Street be
returned to a good state upon completion of the State Project and
relayed requests from citizens for automatic withdrawal payment of
water bills and told by the City Manager that information concerning
that process will be included in the next billing. Mayor Moore
complimented City Staff for "herculean efforts" assisting citizens last
Friday with flood problems and announced: the beginning of the
Southeast Texas Fair on Thursday, a hearing regarding Entergy rates,
a walk-a-thon sponsored by the Golden Triangle Links Saturday
morning to benefit a local shelter, a special mass for law enforcement
officers at Saint Anthony's Cathedral, dedication of the rose gardens,
an over-55 bowling tournament attracting over 500 participants from
four states, kick-off of an after-school program directed by the YMCA
at Blessed Sacrament Church in the Charlton-Pollard neighborhood,
a literacy program banquet in Houston organized by Beaumonter
Yvonne Cormier honoring Mr. Tom Harkin for his efforts in speaking
across the country on behalf of literacy and the opportunity to meet
famous authors that included Kareem Abdul Jabar.
Councilman Goodson thanked Chief Magistrate Lupe Flores and
Magistrates James D. McNicholas and Theodore Johns for their
service to the City of Beaumont and expressed appreciation for
operation of Municipal Court and Mayor Pro Tem Cokinos for
answering many of his calls received Friday regarding flooding caused
by the heavy rain.
Councilman Davis reported that representatives from the Heart of the
City Neighborhood Association will speak later regarding a
neighborhood problem and an emergency meeting. He requested that
the Building Codes Division and the Police Department investigate
activities that are occurring at the Land Manor location on Orange
Street regarding any possible Code violations or illegal action,
especially since there are grade schools in close proximity. He
expressed a desire for empowerment to limit the number of group
homes in an area that is already saturated

Mr. Bill Fitzpatrick, 2117 Orange, spoke about the number of halfway
houses or group homes in his neighborhood that are near schools,
asked for advice and help and consideration of rezoning for single
family dwellings.
Mr. Tyrone Thompson, P. O. Box 2013, spoke about a drainage
problem, unemployment and proposed the City establish a program to
educated and help the unemployed become self-supportive.
Mr. Henry Cormier, 3390 West Euclid, recited Bible Scriptures and
spoke about prophets of God.
Mr. Ronnie Shilo, 2198 Victoria and Mr. Joe Pizzo, 1675 Orange,
added their concerns about group homes and released sex offenders
moving into the facilities and solicited Council support and help with
rezoning.
Councilman Davis interjected comments that it is not without
compassion that concerns about the large number of group homes, sex
offenders, school proximity, property values and zoning are expressed,
and said he hopes citizens from the Heart of the City neighborhood
recognize Council's desire to help. Councilman Smith spoke about law
changes lowering the distance between group homes and said the
availability of the older, large homes are attractive to agencies wishing
to establish group homes.
Mr. Bill Howell, 2415 Avenue G, questioned and expressed displeasure
at the closing of Orleans Street near the parking lot of the postal
encoding facility.
Mr. Lynn DeMary, 430 East Elgie, compared problems and opportunity
for the Heart of the City neighborhood and Old Town about fifteen
years ago and encouraged Council support.
Mr. Tony Jones, 3715 East Lucas, spoke in favor of a cross walk with
a pedestrian controlled signal being installed in the 3700 block of East
Lucas for the safety and convenience of senior citizens.
Mr. LaFayette Spivey, 6010 Chandler, asked that City and County
officials join in an attempt to alleviate flooding in the Tyrrell Park
neighborhood, asked that ditches be cleaned as a stop-gap measure
until permanent strides are made and conveyed a message from Mrs.
Ward at the corner of Phelps and Downs that in repairing the road, her
driveway was damaged and needs to be repaired. Councilman
Goodson reported that conversations occurred between Jefferson
County Judge Stroder and Drainage District 6 Director Richard

LeBlanc and he regarding proposed drainage improvements in that
area.
Mr. Thomas Rogers, 5330 Phelps Road, a member of the Tyrrell Park
Neighborhood Association, also complained about flooding and said
his home has flooded for the past three years.
Mayor Moore asked that Staff research and submit an update on statutes and legislation regarding
group homes to determine if the City has any regulatory powers and suggested utilizing resources
of Carolyn Chaney, our Washington Assistant. Mayor Moore asked Councilman Goodson to
spearhead a meeting with Jefferson County and DD6 officials, the City Manager, Public Works
Director, he and Councilman Goodson to discuss the problem of drainage.
There being no further business, the meeting recessed at 2:35 p.m. to reconvene in executive
session.

SUBJECT: 1996 STREET REHABILITATION PROGRAM
COMIMENTS
Please find enclosed the proposed 1996 Street Rehabilitation Program. This year's program
is estimated to cost $1.6 million and consists of sixty-nine (69) residential streets totaling
approximately eighteen(18)miles. The primary method of rehabilitation is reconstruction,
80% of the streets, while the remaining 20% will be overlaid.
The estimated schedule is provided below:
• Review with City Council October 1, 1996
• Advertise for Bid October 7, 1996
• Open Bids October 28, 1996
• Award by City Council November 5, 1996
• Notice to Proceed November 25, 1996
• Project Complete April 23, 1996
An overview of the program will be presented to City Council during the October 1, 1996
Council Work Session.
