Patterson April 20,2004 Audwin Samuel Lane Nichols, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on April 20,2004, at the City Hall Council Chambers,801 Main Street,Beaumont,Texas,at 1:30 p.m.to considerthe following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda Consent Agenda Mayor Lord called the council meeting to order at 1:30 p.m. Pastor Benny Thomas of the Church of Living Waters gave the invocation. Mayor Pro Tern Ames led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Lord, Mayor Pro Tern Ames,Councilmembers Smith, Beaulieu, Cokinos, Samuel and Patterson. Also present were Kyle Hayes, City Manager; Lane Nichols, City Attorney; Rose Ann Jones, City Clerk. Proclamations, Presentations, Recognitions 1. Fifty-Sixth Neches River Festival Week-Proclamation read by Mayor Lord declaring the week of April 16-24 as"King Neches Fifty-Sixth Week';accepted by Tommy Lamb and King Neches Fifty-Sixth John J. Lovoi 2. Days of Remembrance- Proclamation read by Mayor Lord declaring April 18-25 as "Days of Remembrance"; accepted by Rabbi Barbara Metzinger, Temple Emanuel Public Comment: Persons may speak on scheduled agenda items No. 1-2/ Consent Agenda. None CONSENT AGENDA Approval of minutes - Minutes of April 13, 2004 Confirmation of committee appointments - None Minutes-April 20,2004 A) Approve a contract for the purchase of automotive batteries for use by the Fleet Management Division - Resolution 04-087 B) Approve a resolution accepting maintenance of the water and sanitary sewer improvements in Calder Addition subdivision - Resolution 04-088 Councilmember Cokinos wanted to know if the batteries were delivered to us or if the City had to go to Orange to pick-up the batteries. This would affect the cost of the contract with the price of gas increasing by going to Orange and the bid received from a Beaumont company. City Manger Hayes stated that this information is unknown at this time but will find out this detail and report back. Councilmember Smith moved to approve the Consent Agenda. Councilmember Beaulieu seconded the motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, SAMUEL AND PATTERSON NAYS: NONE ABSTAIN: COUNCILMEMBER COKINOS MOTION PASSED GENERAL BUSINESS 1) Consider approving a one (1) year contract for the purchase of fittings, pipes and couplings for use in the Water Utilities Division - Resolution 04-089 Administration recommended the award of an annual contract for couplings, brass fittings, plastic tubing and other water-related materials for use by the Water Utilities Division. According to the bids received,this contract would be made to Coburn Supply of Beaumont,Golden Triangle Pipe of Beaumont, Hughes Supply of Lufkin and Rural Pipe of Jasper at the unit costs for a total estimated annual expenditure of$397,130.14. The materials are used in the repair of existing water lines, installation of new water service lines, and in the maintenance of existing water mains and meters. The materials are utilized to maintain adequate water service throughout the City. Funds are available for these expenditures in the Water Utilities Division's operating budget. Councilmember Smith moved TO APPROVE RESOLUTION 04-089 TO APPROVE THE PURCHASE OF FITTINGS, PIPES AND COUPLINGS FOR USE IN THE WATER UTILITIES DIVISION AS PER BID ITEM. Mayor Pro Tern Ames seconded motion. Page 2 of 5 Minutes-April 20,2004 AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED 2) Consider authorizing the City Managerto increase the Barscreen Area and Belt Press Conveyor Improvements Project amount for "extra work"- Resolution 04-090 Administration recommended approval of increasing the Barscreen Area and Belt Press Conveyor Improvements Project amount by$163,626 to restore the structural integrity of 1,500 square feet of walls and ceiling surface inside the wet well of the main pump station at the Wastewater Treatment Plant. The interiorwalls and ceiling of the existing suction well at the Wastewater Treatment Plan built in the early 1950's have deteriorated and require major rehabilitation. The primary goals of the project are to restore the structural integrity of the wetwell,stop the deterioration of itswalls and ceiling,and prolong its life, in orderto provide customers with uninterrupted and adequate service. Funds for this project are available in the Capital Improvement Funds. Mayor Pro Tern Ames moved to APPROVE RESOLUTION 04-090 TO INCREASE THE BARSCREEN AREA AND BELT PRESS CONVEYOR IMPROVEMENTS PROJECT AMOUNT FOR "EXTRA WORK." Councilmember Smith seconded motion. AYES: MAYOR LORD, MAYOR PRO TEM AMES, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, SAMUEL AND PATTERSON NAYS: NONE MOTION PASSED COUNCILMEMBER COMMENTS COUNCILMEMBER PATTERSON - ASKED CITY MANAGER, KYLE HAYES AND TOM WARNER FOR UPDATE ON THE SPILL CLEAN UP ON GOLIAD STREET COUNCILMEMBER SAMUEL - REQUESTED WORKSHOP ON SOLICITATION OF 501-3C NONPROFIT ORGANIZATIONS ON PUBLIC STREETS;THANKED CITY MANAGER AND STAFF FOR INVESTIGATION OF THE ENTITY IN THE NORTH END ABOUT WHICH WE RECEIVED COMPLAINTS MAYOR PRO TEM AMES- REQUESTED SAFETY ISSUES TO BE INCLUDED IN WORKSHOP; VERIFIED THAT THE BIDDERS WERE AWARE THAT THEIR BID COULD BE AWARDED FOR THE SEPARATE ITEMS AS LISTED; Page 3 of 5 Minutes-April 20,2004 COMMENTED ON THE SUCCESS OF THE NECHES RIVER FESTIVAL PARADE COUNCILMEMBER COKINOS - REQUESTED CITY MANAGER TO INFORM HIM OF THE PROCEDURE OF RECEIVING THE BATTERIES COUNCILMEMBER BEAULIEU - CONGRATULATED THE NECHES RIVER FESTIVAL "CITIZEN OF THE YEAR" ROY STEINHAGEN; APPRECIATED THE FACT THAT THE CONTRACT AWARD WAS DIVIDED AMONG SEVERAL LOCAL VENDORS; CONCERNED ABOUT SAFETY ISSUES OF COLLECTING FUNDS ON THE STREET COUNCILMEMBER SMITH- APPRECIATED THE VISIT FROM RABBI METZINGER AND THAT WE SHOULD BE AWARE THAT THESE ISSUES ARE STILL TAKING PLACE TODAY IN THE WORLD CITY MANAGER HAYES - NONE CITY ATTORNEY NICHOLS - NONE MAYOR LORD - THANKED THE 4T" GRADE CLASSES THAT SHE HAS VISITED AND IS LOOKING FORWARD TO VISITING MORE CLASSES WHILE THEY STUDY CITY GOVERNMENT Public Comments (Persons are limited to three minutes) Alice F.
