Richardson, Planning Manager MEETING DATE: April 27, 2004 AGENDA MEMO DATE: April 20, 2004 REQUESTED ACTION: Council consider a request for a zone change from RS (Residential Single Family Dwelling) to RM-H (Residential Multiple Family Dwelling-Highest Density) District at 1005 E. Lucas Drive. RECOMMENDATION The Administration recommends approval of a zone change from RS (Residential Single Family Dwelling) to RM-H (Residential Multiple Family Dwelling-Highest Density) District at 1005 E. Lucas Drive. BACKGROUND Statewide Consolidated Community Development Corporation,Inc. is requesting this zone change in order to build a 14 unit housing complex for persons with disabilities. The property is located at 1005 E.Lucas. The north 170'of the subject property is zoned RM-H. The south 236'is zoned RS. Statewide will serve as sponsor and property manager of this housing complex under the Section 811 Supportive Housing for Persons with Disabilities Program. In addition to the 14 residential units, there will be one unit for a resident manager . The specific purpose for these units is to give the disabled a nice, clean, safe living environment. The proposed use is permitted by-right in the RM-H District,thus the need for the zone change for the rear of the property. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held April 19,2004,the Planning Commission voted 8:0 to approve a zone change from RS (Residential Single Family Dwelling) to RM-H (Residential Multiple Family Dwelling-Highest Density)District at 1005 E. Lucas Drive. SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission, City Manager, Public Works Director and the Planning Manager. ORDINANCE NO. ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS,AS INDICATED UPON THE ZONING MAP OF BEAUMONT,TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLYZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING) TO RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST DENSITY) DISTRICT, LOCATED AT 1005 E. LUCAS DRIVE, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the zoning of property presently zoned as RS (Residential Single Family Dwelling) to RM-H (Residential Multiple Family Dwelling-Highest Density) District, located at 1005 E. Lucas Drive, as described on Exhibits "A" and "B", and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property herein above described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. RECOMMENDATION The Administration recommends denial of a zone change from RCR(Residential Conservation and Revitalization) to LI (Light Industrial) District for property on the west side of Carroll Street, between Lincoln and Grant. BACKGROUND Sherman and Sherman, Inc., the property owner, is requesting a zone change from RCR to LI for property located on the west side of Carroll Street, between Lincoln and Grant. Sherman and Sherman is requesting this zone change to allow them to park their house moving equipment on the subject property. The property is surrounded by RCR zoning on the north, west and south sides. These properties were originally rezoned from RM-H to RCR in 1987. The purpose of that rezoning was to allow the granting of a specific use permit for a fraternal lodge. That use no longer exists. The property is currently vacant. BUDGETARYIMPACT None. PREVIOUS ACTION At a Joint Public Hearing held April 19,2004,the Planning Commission voted 7:0:1 to deny a zone change from RCR to LI District for property on the west side of Carroll Street,between Lincoln and Grant. BACKGROUND Cingular Wireless has made an application for a specific use permit to allow the construction of a 180'tall telecommunication tower at 345 E. Lucas Drive. Included in the 80'x 80'screened fence compound will be an 11'5"x 20'equipment shelter. The surface of the compound and the driveway will be crushed limestone. The site will be unmanned and will be monitored remotely from the company's switch office. The subject property is surrounded by Forest Lawn Cemetery. BUDGETARY IMPACT None. ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A CELL TOWER IN AN A-R (AGRICULTURAL-RESIDENTIAL) DISTRICT LOCATED AT 345 EAST LUCAS IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to Cingular Wireless to allow a cell tower in an A-R (Agricultural-Residential) District located at 345 East Lucas, being that certain piece or parcel of land, lying and being situated in the County of Jefferson, State of Texas, and being located in the A. Williams Survey, and being a part of Lot No. Two (2), of the Subdivision of the Hopkins' 41.3 acres shown in the decree of partition in cause No. 5711, in the 58th District Court in Jefferson County, Texas, and also a part of the tract of land deeded to J. Cotton by G. H. BACKGROUND Scott Monroe, Access Self Storage, is requesting an amended specific use permit to allow the expansion of a mini-warehouse facility at 250 S. Dowlen Road. The expansion will be located south of the existing building and will consist of 20,380 sq. ft.of non- climate controlled warehouse space in three buildings and 29,250 sq. ft. of concrete slab for both covered and uncovered boat and RV storage. The original specific use permit for the mini-warehouse facility was granted in January, 2002. In February, 2004, City Council granted conditional approval of an amended specific use permit to allow the driveway on Long Street to remain open during business hours. BUDGETARYIMPACT None. The property is zoned RCR (Residential Conservation and Revitalization)District. An existing 616 sq. ft. building will be used for a 4 chair barbershop. Eight parking spaces will be provided. The Planning Manager stated that the site plan would need to be revised to allow for the proper layout of the required parking. RECOMMENDATION Administration recommends authorizing the City Manager to execute a contract with BFI for sanitary sewer service. BACKGROUND BFI contacted the City regarding the ability of the Water Reclamation Plant to accept wastewater from their landfill on LaBelle Road. Currently, BFI transports and disposes of the wastewater at other locations. Under the terms of the agreement,BFI would be responsible for the installation and maintenance of a 3-inch force main,lift station and a meter to pump the wastewater from their landfill to the Water Reclamation Plant. The maximum amount of wastewater to be accepted by the City is 20,000 gallons per day. BUDGETARY IMPACT The rate charged to BFI for sanitary service is the same rate charged for service outside of the City limits. Additionally, BFI may be surcharged for wastewater discharges of ammonia as nitrogen concentration in excess of 35 mg/L. The estimated annual revenue will range between$50,000 and $150,000, depending upon the surcharges. PREVIOUS ACTION None. SUBSEQUENT ACTION None. RECOMMENDED BY City Manager, Public Works Director and Water Utilities Manager. i STATE OF TEXAS § COUNTY OF JEFFERSON § WHEREAS, Golden Triangle Landfill, TX LP, (BFI) doing business in the State of Texas (herein"Owner), and the City of Beaumont, a municipal corporation of the State of Texas (herein "City") entered into a Contract on April 15, 2004, for City to provide sewer services to BFI; WHEREAS,the City and BFI desire to adopt a Contract for the provision of sanitary sewer services to BFI and agree as follows: WITNESSETH I BFI agrees to install and maintain, free of charge to the City, the 3" diameter force main. II The City shall have the right to enter on the property or premises for any purposes reasonably incidental to or necessitated by the terms and provisions of this Contract. III BFI agrees to install and maintain a lift station, 3-inch force main, and a meter to pump their wastewater for monitoring the quantity of sewage delivered to the City's collection system. The type and model of meter shall be approved by the City. BFI further agrees to test the accuracy and calibrate the meter upon installation and semi-annually thereafter,in a manner approved by the City, with the results submitted to the City. BFI shall bear all costs associated with installation and maintenance of the lift station, 3-inch force main, and the meter. Until the meter is installed and tested or in the event of a malfunction of the meter,BFI agrees to pay for a volume of sewage which is equivalent to previous billing actually provided to BFI for the billing period. In the event that the City questions the accuracy of the meter,the City shall have the right, at its own expense,to test the accuracy of the meter. If the meter is inaccurate by at least 5 percent, BFI agrees to repair and recalibrate the meter at its expense. N The City shall have the right, at its discretion, to require BFI to install and maintain, at a place to be determined by the City, equipment and facilities for monitoring sewage quality and for the purpose of determining that no prohibited industrial waste, oils, bilges, or other similar sewage is delivered to the City's system unless approved by the City in accordance with Federal and State requirements. V BFI agrees to comply with applicable City Code of Ordinances including the sewer use ordinance regarding the discharge of industrial wastewater. BFI will only discharge leachate and/or any other wastewater when approved and authorized by the City in accordance with local,state,and federal requirements. VI In the event of an overflow, bypass, or other noncompliance from the City's sanitary sewage collection system,BFI agrees to promptly report the noncompliance as required by State and Federal authorities. BFI also agrees to promptly mitigate any environmental hazard created by the i noncompliance and to correct the problem which led to the noncompliance. BFI also agrees to submit a copy of the notification and report of the mitigation to the City. BFI's collection is defined as all of the pipes within BFI transporting sewage from individual connections to the lift station,and including the lift station and pump discharge piping. The City's responsibility shall begin at the point where the 3" force main enters the City's manhole on Frint Road below the ground. VIII The City agrees to accept a maximum of 20,000 gallons of wastewater per day from BFI under normal operating conditions. Additional flow volumes must be approved by the City prior to discharging to the City collection system. The City reserves the right to reject any additional flow. IX BFI agrees to pay to the City all charges for sewer service within fifteen (15) days after receipt of statement from the City. In the event of failure of BFI to so pay said charges, City shall have the right, upon thirty(30) days' written notice to BFI, to refuse to accept further sewage from BFI. X BFI will pay the same rate for sewer services as established from time-to-time by the City Council for outside the City of Beaumont, for strength of sewage discharged, and applicable surcharges. The event said rates and surcharges are altered or amended by City Ordinance, BFI agrees to pay said amended rates. BFI agrees to pay an additional surcharge for the discharge of ammonia as nitrogen concentration in excess of 35 mg/L. The ammonia surcharge will be$0.45 per 1000 gallons per mg/L over 35 mg/L. Determination of the strength of BFI's waste shall be made r by the City based on tests conducted on representative samples collected in accordance with the Industrial Wastewater Discharge Permit issued. XI BFI agrees to maintain with the City the sum of five thousand and no/100 dollars($5,000) to be retained by the City as payment for any delinquent amounts owing City for said services furnished at time of cancellation or expiration of this agreement. XII BFI agrees to: A. Adopt a resolution or take some other official action agreeing to the terms and conditions of this agreement; b. Adopt a resolution or take some other official action ratifying, affirming and accepting the benefits and agreeing to the terms,conditions and requirements of this agreement; and C. Enter into such other or additional contracts or agreements as may be reasonably required to carry out the purpose and intent of this agreement. XIII This agreement shall be for a period of ninety(90) days from and after the date of execution hereof or upon the adoption and/or amendment of sewer service rates by City Ordinance, which ever occurs first. XIV BFI may, from time to time,convey or assign this agreement with respect to all or any part of the land contained within BFI's boundaries, and the assignee or assignees shall be bound by this agreement. Upon prior approval by the City Council, of the assignee or assignees, and only upon the condition that the assignee or assignees assume the liabilities, responsibilities and obligations under this agreement with respect to the land involved in the assignment or assignments,or as may be otherwise approved by the City Council. RECOMMENDATION Administration recommends award of a contract to McGriff, Seibels& Williams of Texas, Inc. for the purchase of a one (1)year fire, extended coverage, flood and quake property insurance policy. The annual premium of$268,713 includes an all risk peril policy with a loss limit of$110,000,000, Terrorism coverage and Boiler and Machinery coverage. BACKGROUND Five (5) proposals were received on Thursday, April 8, 2004, for furnishing a one (1) year fire, extended coverage, flood and quake property insurance policy. Proposals varied in cost and coverage, however proposals allowed for variations to the requested limits based on the uncertain conditions of today's insurance market. The proposals received ranged in cost from$201,818 to$388,392. The proposal submitted by Frost Insurance Agency in the amount of$201,818 is for excess coverage only and begins with losses exceeding$10,000,000. Primary coverage would still be required with a separate carrier. The apparent low bidder providing an all risk peril policy was submitted by McGriff, Seibels and Williams of Texas, Inc. The premium cost for the policy proposed is as follows: Fire,Extended Coverage,Flood and Quake Damage $242,500 Boiler&Machinery $8,410 Terrorism Coverage $17,803 Purchase of Property Insurance April 23, 2004 Page 2 The terms of the policy include a total loss limit of$110,000,000 and specific loss limits. Specific loss limits the total payment to the amount stated on the City's property schedule. For example, City Hall has a value of$5,163,601. Should a loss occur and the replacement cost exceeds the amount on the attached property schedule,funds to be provided from the coverage will not exceed the stated amount. The City's property values have been upgraded during the past two years to reflect current estimated replacement costs. The policy offered by McGriff, Seibels&Williams,includes deductibles in the amounts shown below: Fire $50,000 Windstorm 1% of the Total Insured Value with a minimum of $100,000 and a maximum of$500,000 per occurrence Flood and Quake $100,000 Boiler&Machinery $25,000 Electronic Data Processing $50,000 Terrorism $50,000 The policy begins May 1, 2004 and expires May 1, 2005. The current insurance provider is Texas Municipal League-Intergovernmental Risk Pool (TML-IRP). The policy premium submitted by McGriff, Seibels & Williams of Texas, Inc. represents a 20% reduction in cost from last year's premium of$313,347. In addition,the current policy was layered. TML provided fire and flood coverage but wind coverage was provided by others. This resulted in a primary windstorm policy and two separate excess wind policies with various expiration dates. A prorated refund will be due the City with the cancellation of the two excess windstorm policies. Meeting Date: April 27,2004 Agenda Memo Date: April 20,2004 Requested Action: Council review of Resolution authorizing application for new funding of the Southeast Texas Auto Theft Task Force Recommendation Administration recommends approval of Resolution authorizing application for and acceptance of Southeast Texas Auto Theft Task Force Grant. Background As result of Title 43,Part III,Chapter 57 of the Texas Administrative Code, local governmental agencies may apply for one year funding for a State Grant through the Texas Automobile Theft Prevention Authority. The City of Beaumont has been the grantee of the Southeast Texas Auto Theft Task Force since 1993. The Task Force is presently operating on$362,638 funded by the Texas Automobile Prevention Authority. Participating agencies are also providing$268,274 in cash match, and$143,542 in in-kind match. The Southeast Texas Auto Theft Task Force is a multi jurisdiction agency comprised of six personnel from the Beaumont Police Department, and one each from Jefferson County Sheriffs Office,Pt.Arthur Police Department, Orange County District Attorney's Office, and the Hardin County Sheriff's Office. Since the inception of the Task Force motor vehicle thefts have decreased in Beaumont by 72% from 1721 in 1992 to 487 in 2003. The Task Force currently covers Jefferson,Orange,Hardin, and Jasper Counties. The Task Force focuses efforts in two areas: investigations,which target thefts for profit, street gang related thefts,and repeat offenders; and public awareness,which uses media campaigns, training, and public presentations to promote prevention techniques and awareness. The application for the FY'2005 is in the amount of$833,013. State funds in the amount of$414,433 are being requested from the Automobile Theft Prevention Authority. It is estimated that the participating agencies will provide$209,754 of matching funds to assist with the operation of the Task Force, along with$208,826 considered in-kind match. I Budgetary Impact The requested State Funds will pay salaries,estimated at$164,767 for one Lieutenant and two patrol officers. The City's matching funds estimated at$119,888,will pay for the salary of one patrol officer along with benefits for one Lieutenant and three patrol officers. This is in-line with the current Task Force budget, and is an increase of$5,398 to the overall City budget due to salary and benefit increases. Included in this year's application are one Sergeant Investigator,and one detective specialist. These are existing auto theft investigators that are housed in the task force office. They are listed as an in-kind match of $146,225,and will not have a budgetary impact on the City budget. They are shown on the grant to emphasize the support of the program by the City. The operating expenses for the Beaumont officers assigned to the Task Force are estimated at$80,778. Requested State funds will cover$36,978 of the cost. The estimated cash match by the City is $10,000, which provides,fuel, oil, and maintenance for the Beaumont Police Department personnel assigned to the Task Force. Included in this years grant is the fuel, oil, and maintenance for the two vehicles driven by the existing auto theft detectives housed with the Task Force. Impact on the City Budget is estimated at $10,000 for fuel and maintenance on the four Task Force vehicles. Previous Action Resolution No. 03-101 was passed by The City Council on May 13,2003 authorizing the City Manager to apply for and execute all necessary documents to authorize acceptance,receive and disburse grant funds, and to execute inter-local agreements related to the operation of the Southeast Texas Auto Theft Task Force for fiscal year 2004.
