C 'ate BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to execute an annual contract beginning January 1, 1996 with Beaumont Products and Services, Inc. for basic grounds maintenance services at City facilities and specified areas within Beaumont's Central Business District in the amount of $7,600 per month for a period of one (1) year. The contract is substantially in the form attached hereto as Exhibit "A." PASSED BY THE CITY COUNCIL of the City of Beaumont this the ',fc day of Mayor - CONTRACT GROUNDS MAINTENANCE AND LITTER REMOVAL SECTION I GENERAL SPECIFICATIONS 1.0 The City of Beaumont is requesting pricing for an annual contract that will include grounds maintenance and litter removal in the City's downtown area. The contract shall be in effect for a period of one year. At the end of one year the City may extend this contract for a period of one (1) additional year. There shall be no increase in price should an extension be granted. Any terms and conditions stated in the original specifications will apply to any extended periods. Approval on behalf of the City to renew this contract shall be made by the City Manager or his designee. 2.0 It is the intent of these specifications that the Contractor provide complete, timely, safe and professional work during the course of the contract. 3.0 The City Manager or his designee will be referred to in this Specification as the "City". 4.0 The omission of specific reference to any materials or labor necessary for such a job shall not be interpreted as relieving the contractor from furnishing said materials or labor. 5.0 The Contractor agrees to indemnify and save harmless the City of Beaumont and its officers, agents and employees from any and all claims, causes or action, and damages to property arising out of or in connection with the work done by Contractor under this Contract, and including acts or omissions of the City of Beaumont or its officers, agents or employees in connection with said Contract. 6.0 Contract work shall be performed in "Scope of Work," excluding official City holidays which include: Labor Day Thanksgiving Day Day after Thanksgiving Christmas Day New Year's Day Martin Luther King's Birthday Good Friday Memorial Day Independence Day If an event is scheduled on an official holiday, contractor shall be required to perform the duties stated herein. 7.0 The Contractor shall within ten (10) days after award of Contract furnish the City with proof of insurance as stated in Attachment A. EXHIBIT "A" SECTION 1 Page 2, 7.1 A certificate of insurance, or a copy of the insurance policies shall be furnished to the City within ten (10) days after the award of contract. 7.2 The City shall be named as additional insured on all policies. Should any insurance required by this Contract lapse, the Contractor shall immediately cease all operations until authorized in writing by the City. If the lapse period extends fifteen (15) days, the Contract shall automatically terminate and the Contractor shall be in breach of this Contract. 8.0 The operation of all mowing equipment will be done in a manner that is not hazardous to persons in the designated areas or the operators. 9.0 If the Contractor is unable to perform mowing services due to excessive water retention on the grounds, then the City's representative shall be contacted. A final determination will be made by the City's representative about mowing the area in question. 10.0 For purposes of this Contract, the Municipal Complex shall be defined as the area shown in Exhibits A & B. Grounds maintenance shall be defined as follows: 1. Removal of Litter 2. Mowing 3. Edging 4. Sweeping 11.0 The Contractor shall furnish the City with a work schedule indicating the areas that will be maintained on a daily basis. Example: Monday -Welcome to Beaumont Park Tuesday - City Hall, Police, Library and Julie Rogers Wednesday - Riverfront Park Thursday - Civic Center Friday - Medians and Triangles Due to various events conducted in Riverfront Park, Civic Center and Julie Rogers Theatre, the City reserves the right to change the Contractor's daily work schedule, if needed. 12.0 Each Contractor shall visit the work prior to submission of bid and completely satisfy himself as to the exact nature and existing conditions of the downtown area. 13.0 The Contractor shall insure at all times that each worker is provided with an identifiable standard worker's uniform before the commencement of each work day of the contract period. SECTION I .Page 3, 14.0 The Contractor shall not use premises or facilities for activities, storage, etc., not specifically allowed herein without written approval of the City. 15.0 The Contractor shall respond to all requests for maintenance, repair, and investigation as identified in this agreement as soon as practical. In cases where the Contractor is required to perform services as identified in this agreement, such services shall be performed within twenty-four (24) hours. Inspections will be made to ensure work was completed as indicated per the Contractor's schedule. 16.0 Inspection reports will be forwarded to the Contractor within twenty-four (24) hours following the inspection. 17.0 The City, besides all other rights or remedies it may have, shall have the right to terminate this agreement upon fifteen (15) days written notice from the City, for the following: 17.1 Failing to pay insurance premiums, liens, claims, or other charges. 17.2 Failing to pay payments due the City, State or Federal Government from the Contractor or its principals, including, but not limited to, payments identified in this agreement or any taxes, fees, assessments, or liens. 17.3 On the institution of voluntary or involuntary bankruptcy proceedings against the Contractor. 17.4 Death of the Contractor, or dissolution of the Contracting firm or business. 18.0 The City may terminate this Contract upon five(5)days written notice if the Contractor fails to perform the scope of work as herein provided. The decision to terminate shall be at the sole discretion of the City Manager or his designee. 19.0 The City may terminate this Contract at any time upon thirty (30) days notice in writing to the Contractor. 20.0 Upon termination or expiration of this contract, the Contractor shall be permitted five (5) days to remove Contractor owned material and equipment from the City's premises. Materials and equipment not removed within the specified time shall become the property of the City. 21.0 The Contractor may not assign any portion of this agreement to any other person, firm or corporation without prior consent, in writing, by the City. 22.0 The Contractor may not sell or assign all or part interest in activities to another party or parties without written approval of the City of such sale or assignment. The City may require any records or financial statements necessary in its opinion to ensure such sale or assignment will be in the best interest of the City. SECTION I Page 4 23.0 The Contract may not erect, place, alter, or remove any buildings, covers, signs, slabs, driveways, roads, or facilities of any nature without the prior written consent of the City. Such facilities shall become the property of the City of Beaumont upon termination or expiration of this agreement. SCOPE OF WORK- SECTION U 1.0 The Contractor shall keep all curbs, gutters, sidewalks and paved areas free of grass and weeds, including curbs and gutter lines and joints in the sidewalks. This may be accomplished by the use of an approved herbicide. Prior to using a herbicide, the Contractor shall obtain written permission on the use of herbicides from the City, shall provide all material data sheets, and provide proof of each applicator's certification to administer pesticides and herbicides in the State of Texas to the City prior to the herbicide being applied. All herbicides shall be applied according to manufacturer's specifications. Pesticides and herbicides must be administered in accordance with all laws, rules and regulations pertaining to its application. 2..0 Clean up shall include removing grass clippings from walks, curbs and paved areas and shall be done on the same day that edging or cutting occurs(no exceptions). Grass exceeding two (2") inches in height around signs, fence lines, trees, poles and other obstacles shall be removed by monofilament trimming. The Contractor shall be responsible for all other equipment, materials, and supplies for such cultivation. 3.0 The Contractor shall be responsible for mowing, edging and removing grass clippings and litter from the areas indicated on Exhibits A& B. Bed edges abutting concrete or paved areas shall be kept clean and well defined. The City reserves the right to install additional landscaping at its own expense, with maintenance to be the responsibility of the Contractor. 3.1 Grass (St. Augustine) - height shall be maintained/mowed at a minimum of once every five (5) working days during the growing season. Grass clippings shall be removed or evenly distributed over mowed areas to prevent clumping and windrowing of clippings. Edging shall occur the same day as mowing. 3.2 Areas requiring mowing and/or edging shall be cut a minimum of once every five (5) days in the growing season between March 1 and October 31. During the remainder of the year, the area shall be mowed and edged once every ten (10) days. 4.0 The Contractor shall provide sweeping to keep all paved areas reasonably free of debris. All walks shall be swept and debris removed from the site as indicated below: 4.1 Riverfront Park: sidewalks, shelters and all paved areas shall be swept on the day mowing and edging occurs. 4.2 Welcome to Beaumont Park: sidewalks and paved areas shall be swept on the day mowing and edging occurs. 4.3 City Hall, Julie Rogers Theatre, Civic Center, Police/Municipal Court Building, Beaumont Public Library and Tyrrell Library: sidewalks and paved areas shall be swept three times per week. Areas shall be swept by 10:00 a.m. on Monday, Wednesday and Friday. On the days mowing and edging is scheduled at these locations, sweeping may be performed after mowing and edging is completed. SECTION H Page 2 4.4 City Hall, Riverfront Park and South Parking Lots: Mowing shall be performed a minimum of five(5) feet outside of fence line. Severely sloped areas adjacent to railroad rights-of-way are not included in this contract. Litter is to be removed from parking lots three times per week (Monday, Wednesday and Friday). 4.5 Henry Dannenbaum Transfer Facility: Litter removal shall be performed daily. Sweeping shall be performed three times per week and on the same day mowing and edging occurs. Cleaning paved areas and sidewalks shall include but not be limited to the removal of bird droppings from paved areas and sidewalks. 5.0 Litter shall be removed from all areas a minimum of three times per week (Monday, Wednesday, and Friday). The Contractor is responsible for ensuring that the property is reasonably free of debris. The Contractor is also responsible for hauling debris and litter to appropriate disposal sites, such as the municipal landfill. Contractor shall be responsible for landfill fees. 6.0 The Contractor shall remove and replace litter bags in the City trash containers a minimum of three (3) times per week, unless otherwise directed by the City. When containers are emptied, the Contractor shall replace with new plastic trash liners. The Contractor shall be responsible for furnishing all trash liners and for the removal and disposal of all trash. Landfill fees are the responsibility of the Contractor. 7.0 The Contractor shall be responsible for the removal of all debris from the fountains located adjacent to City Hall. Skimmer traps located in fountain shall be removed and emptied daily. The exterior of the brick fountain shall be cleaned as needed. Cleaning shall include but not be limited to the removal of bird droppings on the exterior of the fountain. 9.0 The Contractor shall be responsible for securing work areas when necessary. Only approved traffic barricades will be allowed. Contractor is responsible for the safety of the public while operating equipment. Contractor may secure area with traffic cones, traffic barricades or barricade tape. 10.0 The Contractor shall not be required to maintain personnel at the Municipal Complex on a regular time schedule. However, the Contractor shall be available for service calls as necessary between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. 11.0 The Contractor shall have access to the storage area, as identified in Exhibit C and for purposes of conducting activities associated with this contract. The Contractor shall be responsible for maintenance of these areas. 11.1 The Contractor shall exercise due and prudent care in storage and use of any hazardous materials, fuel, etc., including security of such. SECTION II Page 3 11.2 Maintenance and repair of equipment used by the Contractor in the performance of this Contract shall be the responsibility of the Contractor. The Contractor shall avoid major maintenance and repair activities in public areas and, where applicable, shall perform such activities in the identified storage area or at locations not on the property. 12.0 The Contractor shall be provided with a list of scheduled and unscheduled recreational events during the course of the year for proper maintenance scheduling throughout the year. 13.0 The exact number of events cannot be given for the upcoming year. Events held on weekends will require the Contractor to provide maintenance to the Park prior to the event. Normal maintenance work may not be provided on the days events are scheduled. The City reserves the right to rearrange Contractor's work schedule, if necessary to accommodate event dates. 14.0 The maintenance of the Henry Dannebaum Transfer Facility shall include mowing, trimming, and sweeping as per the specifications stated herein. Litter removal shall be performed dailv. Trash containers shall be emptied daily. Trash liners shall be replaced daily. 15.0 The Contractor shall submit a separate invoice for grounds/facility maintenance services rendered for the Henry Dannenbaum Transfer Facility located at Liberty/Laurel intersection. 15.1 Billing invoices for the Henry Dannenbaum Transfer Facility shall be mailed to the following address: Beaumont Municipal Transit P.O. Box 3827 Beaumont, Texas 77704 16.0 City facilities and specific areas to be maintained are indicated on Exhibit D.
