RESOLUTION NO.
WHEREAS, Mr. and Mrs. Monty L. Lipp. have agreed to donate to the City of
Beaumont a twenty foot (20') Drainage and Utility Easement out of Lots 13 and 14, Block
31, Calder Highlands Addition (2790 West Lucas Drive) for the West Lucas Drive Project,
as described on Exhibit "A" attached hereto, in exchange for the abandonment of an
existing easement described as follows:
Being an easement twenty (20) feet in width across Lots 13
and 14, Block 31, Calder Highlands Addition to the City of
Beaumont, Jefferson County, Texas, and being ten (10) feet
each side of the following described centerline:
Beginning at a point in the west line of Lot 14, three (3) feet
north of the southwest corner of said Lot 14 or the northwest
corner of Lot 13;
Thence along a line parallel with and three (3) feet north of the
south line of said Lot 14 or the north line of said Lot 13, two
hundred and twenty-three and thirty-three hundredths (223.33)
feet, more or less, to the east line of said Lot 14.
and,
WHEREAS, the City Council has considered the donation and abandonment of said
easements and is of the opinion that the donated easement should be accepted and the
easement to be abandoned should be abandoned upon relocation of the utilities in such
easement into the donated easement;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT said easement described above in Exhibit "A" donated by Mr. and Mrs. Monty L.
Lipp be and the same is hereby in all things accepted and the easement to be abandoned
described above is hereby abandoned effective upon relocation of the utilities in such
easement into the donated easement.

EXHIBIT "A"
BEING a 0.0927 acre tract or parcel of land situated in the Hezekiah Williams Survey, Abstract
No. 56, Jefferson County, Texas, and being out of and part of Lot 13 and Lot 14, Block 31, of
the Calder Highlands Addition, according to the Map or Plat recorded in Volume 4, Pages 155-
157 of the Map Records of Jefferson County, Texas, said 0.0927 acre tract being more
particularly described by metes and bounds as follows:
BEGINNING at a 1/2" iron rod found for the northwest comer of a tract as conveyed from
Ronald Lee Whitener and Wife, Diane L. Whitener unto Monty L. Lipp and Wife, Doris J.
Lipp, by Warranty Deed with Vendor's Lien dated January 18, 1995, and recorded in Clerk's
File No. 95-9502108 of the Official Public Records of Jefferson County, Texas, said point being
in the east right-of-way line of West Lucas Drive, said point also being North 00 degree 00
minute 00 second East 50.00 feet from the common line of the aforementioned Lot 13 and Lot
14 of Block 31 of the Calder Highlands Addition;
THENCE South 90 degrees 00 minute 00 second East along and with the north line of the
aforementioned Lipp tract for a distance of 183.33 feet to an angle point in this tract, said point
being North 90 degrees 00 minute 00 second West 40.00 feet from a 1/2" iron rod found for the
northeast corner of said Lipp tract;
THENCE South 45 degrees 00 minute 00 second East for a distance of 45.25 feet to an angle
point in this tract;
THENCE South 90 degrees 00 minute 00 second East for a distance of 8.00 feet to a point in
the east line of said Lipp tract, same being the east line of.the aforementioned Lot 14, Block 31,
of the Calder Highlands Addition, said point also being South 00 degree 00 minute 00 second
West 32.00 feet from a 1/2" iron rod found for the northeast comer of said Lipp tract;
THENCE South 00 degree 00 minute 00 second West along and with the east line of the
aforementioned Lipp tract, same being the east line of said Lot 14, Block 31, at 18.00 feet pass
the southeast corner of Lot 14, Block 31, same being the northeast corner of Lot 13, Block 31,
and continuing for a total distance of 20.00 feet to a point for comer of this tract;
THENCE North 90 degrees 00 minute 00 second West, parallel to and 2.00 from the north line
of said Lot 13, Block 31, for a distance of 16.28 feet to an angle point of this tract;
THENCE North 45 degrees 00 minute 00 second West, at 2.83 feet pass the north line of Lot
13, Block 31, same being the south line of Lot 14, Block 31, and continuing for a total distance
of 50.91 feet to an angle point in this tract;
THENCE North 90 degrees 00 minute 00 second West, parallel to and 16.00 feet from the north
line of the aforementioned Lipp tract for a distance of 171.05 feet to a point for corner of this
tract, said point being in the east right-of-way line of West Lucas Drive;
