WHEREAS, Mr. and Mrs. Jose Alvarez have requested that the City of Beaumont
grant a License to Encroach Agreement on a portion of a ten (10) foot utility easement at
the rear of their residence located at 7035 Glen Willow Drive, being Lot 24, Block 33,
Dowlen West Addition, Unit XXI, for a swimming pool is encroaching 1.36 feet for a
distance of 8.16 feet and 1.00 foot for a distance of 7.78 feet into the easement, as shown
in Exhibit "A" attached hereto and made a part hereof for all purposes, and,
WHEREAS, City staff has expended considerable time and effort in investigating
the effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a License to Encroach
with Mr. and Mrs. Jose Alvarez for a swimming pool that is encroaching 1.36 feet for a
distance of 8.16 feet and 1.00 foot for a distance of 7.78 feet onto a portion of a ten (10)
foot utility easement located on their property at 7035 Glen Willow Drive, being Lot 24,
dock 33, Dowlen West Addition, Unit XXI, as shown in Exhibit "A" attached hereto and
made a part hereof for all purposes for a one-time fee of Five Hundred Dollars ($500.00)
for each License to Encroach.
