RESOLUTION NO.
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Council hereby accepts the Texas Department of Transportation (TxDOT)
Minute Order 104238. The minute order is substantially in the form attached hereto as
Exhibit "A".

WHEREAS, in JEFFERSON COUNTY in the City of Beaumont (the city) on WEST
LUCAS from Phelan Boulevard, north to Delaware Street, a distance of approximately 1.4 miles, a
project was requested in the 1988-92 Urban System Program (Non-Major Urbanized Areas) at an
estimated cost to the State of$2,200,000; and
WHEREAS, Minute Order 89663 dated December 14, 1989, ordered the executive
director to tender a proposal to the city; and
VVHEREAS, the city accepted the provisions of Minute Order 89663, and
WHEREAS, in JEFFERSON COUNTY in the city on LIBERTY AVENUE and
LAUREL AVENUE from the proposed intersection of Phelan Boulevard and West Lucas to 11th
Street, a distance of approximately 1.1 miles, $4,800,000 was authorized for a demonstration
project by Section 149 of the Surface Transportation and Uniform Relocation Assistance Act of
1987; and
WHEREAS, Minute Order 89664 dated December 14, 1989, ordered the executive
director to tender a proposal to the city to provide the nonfederal-aid twenty percent match
portion of the project cost of$61000,000, and one hundred percent of all costs that exceed the
estimated construction cost of$6,000,000; and
WHEREAS, the city accepted the provisions of Minute Order 89664; and
WHEREAS, the city has now requested that the aforementioned West Lucas project be
canceled and removed from the Metropolitan Highway System, and the $2,200,000 be transferred
to the aforementioned Liberty Avenue and Laurel Avenue project; and
WHEREAS, the Liberty Avenue and Laurel Avenue project construction cost is now
estimated to be $7,700,000 which is gr eater than previously estimated; and
WHEREAS, the provision of Minute Order 89664 that the city provide one hundred
percent of all costs that exceed $6,000,000 would no longer be applicable if the additional funds
are transferred to the Liberty Avenue and Laurel Avenue project; and
s= WHEREAS, the Texas Department of Transportation (the department) agrees with the
city's proposal to cancel the West Lucas project and transfer the $2,200,000 to the Liberty Avenue
and Laurel Avenue project;
NOW, THEREFORE, IT IS ORDERED that the executive director is hereby directed to
tender the following proposal to the city:
Provided the city A ill:
1. Provide one hundred percent of all costs that exceed $8,200,000 for the Liberty
Avenue and Laurel Avenue project.
2. Meet all of the other provisions of Minute Order 89664 except for the second
provision listed for the city in that Minute Order.

3. Reimburse any state funds expended on the West Lucas project.
The department will:
1. Meet all of the provisions of"Nfinute Order 89664 listed for the department in that
Minute Order.
2. Transfer $2,200,000 from the West Lucas project to the Liberty Avenue and
Laurel Avenue project. Any funds remaining below $8,200,000 will be returned to
the department for use in the statewide Urban System program.
Upon acceptance of the provisions of this Order by the city, IT IS FURTHER
ORDERED that the executive director is hereby authorized to proceed in the most feasible and
economical manner with project development on the Liberty Avenue and Laurel Avenue project to
include any necessary agreements and construction as funds for the project become available; and
IT IS FURTHER ORDERED that Minute Order 89663 dated December 14, 1989 be
canceled, that the West Lucas project be canceled and removed from the Metropolitan Highway
System, and that the $2,200,000 be transferred to the Liberty Avenue and Laurel Avenue project.
This Order shall become operative upon acceptance by the city; and if not accepted within
30 days of the date hereof, the action herein contained shall be automatically canceled.
