WHEREAS, Merrill Construction Company, on behalf of Raymond and Senatta
Armstrong, has requested the City of Beaumont to allow them to encroach on a portion of
a twenty (20) foot utility easement on Lot 13, Block 4, Beaumont West Addition, Section
3 (1850 Wilcox Lane) for the slab of an addition to the house is encroaching 1.0 foot for a
distance of 28.9 feet into the twenty (20) foot utility easement on the north side of the
property, depicted on Exhibit "A" attached hereto and made a part hereof for all purposes;
and,
WHEREAS, City staff has expended considerable time and effort in investigating the
effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to
Merrill Construction Company, on behalf of Raymond and Senatta Armstrong, for a slab of
an addition to their house which is encroaching 1.0 foot for a distance of 28.9 feet into a
twenty (20) foot utility easement on the north side of Lot 13, Block 4, Beaumont West
Addition, Section 3, (8050 Wilcox Lane), as shown on Exhibit"A" attached hereto,for a one-
time fee of Five Hundred Dollars ($500.00).
