WHEREAS, in Cause No. D-142,176 styled the City of Port Arthur, An
Incorporated Texas Municipality, on Behalf of Itself and All Others Similar
Situated, vs. Southwestern Bell Telephone Comps A Missouri Corporation; and
H.Paul Adams, An Individual the judge has certified a class action; and,
WHEREAS, the City of Beaumont has received a notice that it is a potential
member of the class; and,
WHEREAS, in order to join this litigation as a member of the class it is
necessary that a resolution be passed authorizing the inclusion of the City of
Beaumont in the class; and,
WHEREAS, the City Council of the City of Beaumont desires that the City
of Beaumont join as a litigant in the above styled class action lawsuit;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City of Beaumont hereby authorizes the inclusion of the City of
Beaumont as a member of the class in the lawsuit styled City of Port Arthur An
Incorporated Texas Municipality, on Behalf of Itself and All Others Similar
Situated, vs. Southwestern Bell Telephone Company A Missouri Corporation: and
H. Paul Adams, An Individual, Cause No. D-142,176 and authorizes the City
Manager and the City Attorney to take all actions necessary to assure that the City
of Beaumont is included in such litigation.
