RESOLUTION NO. S_7
WHEREAS, R. M. "Ric" Warchol has requested the City of Beaumont to allow him
to encroach on a portion of a ten (10) foot utility easement on Lots 1 and 2, and the South
1/2 of Lot 9, Block 4, Amelia Terrace Addition (8890 Gerald Drive) for a swimming pool
is encroaching 3.0 feet for a distance of 13.0 feet on the west side of the property and 3.0
feet for a distance of 14.0 feet into the ten foot utility easement on the north property line
as depicted on Exhibit "A" attached hereto and made a part hereof for all purposes; and,
WHEREAS, City staff has expended considerable time and effort in investigating the
effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at this
time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to
R. M. "Ric"Warchol for a swimming pool which is encroaching 3.0 feet for a distance of 13.0
feet on the west side of the property and 3.0 feet for a distance of 14.0 feet on the north
side of the property into a ten (10) foot utility easement on Lots 1 and 2, and the South 1/2
of Lot 9, Block 4, Amelia Terrace Addition (8890 Gerald Drive), as shown on Exhibit "A"
attached hereto, for a one-time fee of Five Hundred Dollars ($500.00).
