HomeMy WebLinkAboutRES 94-129 RESOLUTION NO. 1 —i WHEREAS, the City Council of the City of Beaumont deems it necessary that a downtown public parking facility, in the City of Beaumont, Jefferson County, Texas be located, constructed and maintained; and, WHEREAS, said City Council has found that a public necessity exists requiring the location, construction and maintenance of said parking facility on the hereinafter described property; and, WHEREAS, the City Council deems it necessary to acquire the hereinafter described interests in and to the hereinafter described property for said location, construction and maintenance of said parking facility, and has found and determined that said interests in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, the City of Beaumont, through its duly authorized representatives, has negotiated in good faith with the owners of the hereinafter described land and has been unable to agree with such owners of such property as to the fair market value thereof and damages, if any and further negotiations for settlement have become futile and impossible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Attorney be and he is hereby authorized and directed to file or cause to be filed against all owners of the following parcel of land, and all claimants of any interest therein, proceedings in Eminent Domain to acquire fee simple title for said purposes, in and to the said parcel of land described in Exhibit "A" attached hereto and made a part hereof, �e_ ; 9 -5--t31-9�4 the parcel of land being situated in Beaumont, Jefferson County, Texas. PASSED BY THE CITY COUNCIL of the City of Beaumont this the /mot day of ) 1994. - Mayor - NIS PARTNERSHIP# GENERAL PARTNER TRACT I: BEING 19,200 square foot tract of land, and being all of Lots 175 and 176, and a portion of Lot 182 out of Block 38 of the Original Town of Beaumont, Beaumont, Jefferson County, Texas, and being described by metes and bounds as follows: BEGINNING at an iron rod which marks the southwest corner of said 176, and for the purposes of this description only, the direction of Orleans Street is considered to be north and south, said beginning corner marking the southwest corner o;' Block 38 and being the intersection of the east right-of-way line of Orleans Street and the north right-of-way line of College Street; THENCE North 40 degrees 35 minutes 00 seconds West along the west line of Block 38 and the west line of Lots 176 and 182 along the east right-of-way line of Orleans Street a distance of 160.0 feet to a nail in the concrete pavement for corner at the southwest corner of the Naman Tract; THENCE North 49 degrees 25 minutes 00 seconds East along the south line of the Naman Tract a distance of 120.0 feet to an iron rod for corner in the west line of the Hotel Site Tract; THENCE South 40 degrees 35 minutes 00 seconds East at 10 feet pass the northwest corner of the Langham tract and the southwest corner of the Hotel Site Tract and at a total distance for this course of 160.0 feet, an iron rod for corner in the south line of Block 38 at the southeast corner of Lot 175 and the southwest corner of Lot 174, and the southwest corner of the Langham Tract in the north line of College Street; THENCE South 49 degrees 25 minutes 00 seconds West along the south line of Lots 175 and 176 and along the south line of Block 38 and along the north right-of-way line of College Street a distance of 120.0 feet to the PLACE OF BEGINNING.
