BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute an agreement with
Entergy-Gulf States Utilities for the adjustment of electrical lines and furnishing of
ornamental street lights in the amount of$266,200 for the Liberty-Laurel Project Phase III.
The agreement is substantially in the form attached hereto.

PROJECT AGREEMENT
CITY OF BEAUMONT/ENTERGY-GULF STATES UTILITIES
This agreement is made this day of 1994 by and between the City of Beaumont,a municipal
corporation of the State of Texas,(hereinafter referred to as City)and Entergy-Gulf States Utilities,a company
authorized to do business in the State of Texas,(hereinafter referred to as Gulf States Utilities or GSU).
a. City Commitrents• The City,through an agreement with the Texas Department of
Transportation,will contract for the trenching,backfilling,acquisition and laying of
conduit for the URD luminaires as shown on the liberty-Laurel Phase 111 plans.
Additionally,the successful bidder for this project shall install the poles,globes,
lamp's junction boxes and install the electrical wire from the poles up to the junction
boxes. The successful bidder shall be responsible for the entire lighting system,
including damage,breakage or theft until completion of the thirty day test period.
b. nt rgy-Gulf States Utilities Commitments-- GSU agrees to provide all labor,
equipment and material necessary to relocate the overhead utilities as shown on
the plans.
GSU will provide 108 ornamental poles and luminaires to the City for the successful bidder to install. GSU will
provide the electrical wire and junction boxes to the City at no charge. GSU will install the electrical wire through the
conduit from the transformer to the junction boxes and make the necessary connections.
An inspector from GSU will be designated to work with the City to assure that the electrical work performed by the
successful bidder meets the necessary GSU standards in order that GSU will be able to accept ownership of the
project. GSU commits to take ownership of the luminaires and the URD distribution system and maintain it as their
own. GSU wil make an initial investment to stock approximately 10 percent of the total number of poles 01)in their
storeroom to use as replacement poles. GSU will make every attempt to replace damaged poles with like poles,
however,if this is not possible,they will install a similar one in its place. The City will pay a monthly lease fee on
each luminaire as described in the Street and Highway Lighting Rate Schedule for 100 Watt HPS fixtures.
In consideration for the relocation of overhead utilities,the City also agrees to pay GSU$169,000. Additionally,the
City agrees to reimburse GSU$900 per luminaire totaling$97,200. These two amounts,totaling$266,200 will be
paid upon completion of the thirty dory test period.
