RESOLUTION NO. //
WHEREAS, the City Council of the City of Beaumont deems it necessary that a
downtown public parking facility, in the City of Beaumont, Jefferson County, Texas be
located, constructed and maintained; and,
WHEREAS, said City Council has found that a public necessity exists requiring the
location, construction and maintenance of said parking facility on the hereinafter described
property; and,
WHEREAS, the City Council deems it necessary to acquire the hereinafter described
interests in and to the hereinafter described property for said location, construction and
maintenance of said parking facility, and has found and determined that said interests in and
to the hereinafter described land is suited for such purposes and that it is necessary to
acquire same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly authorized representatives, has
negotiated in good faith with the owners of the hereinafter described land and has been
unable to agree with such owners of such property as to the fair market value thereof and
damages, if any and further negotiations for settlement have become futile and impossible;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Attorney be and he is hereby authorized and directed to file or cause to be
filed against all owners of the following parcel of land, and all claimants of any interest
therein, proceedings in Eminent Domain to acquire fee title for said purposes, in and to the
said parcel of land described in Exhibit "A" and attached hereto and made a part hereof, the
parcel of land being situated in Beaumont, Jefferson County, Texas.

A 40, 355 square-foot tract of land out of Block Number
Thirty-eight (38) of the ORIGINAL TOWN OF BEAUMONT, Jefferson
County, Texas, according to the map or plat of said ORIGINAL
TOWN OF BEAUMONT of record in the office of the County Clerk of
Jefferson County, Texas, being described by metes and bounds as
follows:
BEGINNING at the Northeast corner of Lot 181, Block 38, the said
beginning corner being the intersection of the West
right-of-way line of Pearl Street and the South right-of-way
line of Wall Street, and for the purposes of this description
the direction of Pearl Street is considered to be North and
South;
THENCE S. 40 deg. 35 min. E. along the West line of Pearl Street
and the East line of Lots 181 and 183, a distance of 180.00
feet to corner at the Southeast corner of Lot 183 and the
Northeast corner of Lot 172;
THENCE S. 49 deg. 25 min. W. along the South line of Lot 183 and
the North line of Lots 172 and 173, a distance of 120. 00 feet
to corner at the Northwest corner of Lot 173 and the Northeast
corner of Lot 174;
THENCE N. 40 deg. 35 min. W. into Lot 183 a distance of 30.00
feet to corner;
THENCE S. 49 deg. 25 min. W. at a distance of 30. 00 feet cross
the West line of Lot 183 and the East line of Lot 182, and
continuing along said course a total distance of 60. 00 feet to
corner;
THENCE N. 40 deg. 35 min. W. a distance of 30. 00 feet to corner
in the North line of Lot 182, and the Southeast corner of Lot
178 and the Southwest corner of Lot 179;
THENCE S. 49 deg. 25 min. W. along the North line of Lot 182 and
the South line of Lots 178 and 177 a distance of 118.40 feet to
corner in the East right-of-way line of the Orleans Street and
Pearl Street Connector Street, said corner being located N. 49
deg. 35 min. E. a distance of 1.60 feet from the Northwest
corner of Lot 182 and the Southwest corner of Lot 177;
THENCE in a Northeasterly direction along the arc of a curve to
the right, and along the East right-of-way line of said
Connector Street, a distance of 119.21 feet to corner at the end
of said curve, the radius of said curve being 127. 74 feet with
a central angle of 53 deg. 28 min. 23 sec. ;
THENCE N. 21 deg. 54 min. 07 sec. E. , continuing along the East
line of said Connector Street, a distance of 57 .81 feet to
corner at the Northeast corner of Lot 178 and the Northwest
corner of Lot 179 in the South right-of-way line of Wall Street;
THENCE N. 49 deg. 25 min. E. along the North line of Lots 179,
180 and 181 and the South line of Wall Street, a distance of

B:EGIN,NING at the NE corner of Lot 178, being also the NW corner
of Lot 179, and said point being in the Southerly right-of-way
line of Wall Street;
THENCE S. 40 deg. 35 min. E. along the common line between Lot
178 and Lot 179 a distance of 120. 00 feet to a point for corner;
said point being the 'Southeast corner of Lot 178;
THENCE S. 49 deg. 25 min. 00 sec W. along the South line of Lots
177 and 178 a distance of 118.40 feet to a point for corner;
said point being the intersection of the new Orleans Street
right-of-way with the South line of Lot 177;
THENCE: in a Northeasterly direction along the arc of a curve
which has a central angle of 35 deg. 46 min. 50 sec. , a radius
of 127.74 feet, a tangent of 41.23 feet, a chord distance of
78.48 feet, a distance of 79.77 feet to a point; said point
being in the South line of the North 50 feet of Lot 177;
THENCE along the arc of a curve to the right which has a central
angle of 17 deg. 41 min. 33 sec. , a radius of 127.74 feet, a
tangent of 19. 88 feet, a chord distance of 39. 29 feet, a
distance of 39.44 feet to a point for corner;
THENCE ]N. 21 deg. 54 min. 07 sec. E. a distance of 57 .81 feet to
the place of beginning.
