HomeMy WebLinkAboutRES 94-103 RESOLUTION NO. 9 41-/D,3 WHEREAS, James Hebert, agent for Patsy Smith, has requested the City of Beaumont to allow her to encroach on a portion of a fifteen foot utility easement on the rear of Lots 12 and 13, Block 5 of the McAnelly Place Addition (5185 McAnelly Drive) for a garage encroaching 5.3 feet and 6.6 feet into the easement for a distance of 20.0 feet as depicted on Exhibit "A" attached hereto and made a part hereof for all purposes; and, WHEREAS, City staff has expended considerable time and effort in investigating the effect of such encroachment upon the City and utilities serving the same; and, WHEREAS, it appears that it would be equitable to allow such encroachment at this time; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager is hereby authorized to execute a License to Encroach to James Hebert, agent for the owner, Patsy Smith, for a garage which is encroaching 5.3 feet and 6.6 feet for a distance of 20.0 feet on Lots 12 and 13, Block 5 of the McAnelly Place Addition (5185 McAnelly Drive), as shown on Exhibit "A" attached hereto, for a one-time fee of Five Hundred Dollars ($500.00).
