BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Council hereby approves the 1994 Annual Update for a Plan Implementing the Complementary Paratransit Requirements of the American with Disabilities Act of 1990. If this occurs, there will be no need to seek alternative funding sources to purchase the additional paratransit vehicles needed. A notice of the public hearing was placed in the local newspaper, the Beaumont Enterprise, on Wednesday, January 19, and again on Wednesday, January 26, 1994. This notice not only announced the public hearing but also invited the public to obtain copies of the plan and to make any written comments or recommendations. The plan will be made available in accessible formats upon request. Copies of the plan were also distributed to the Transit Advisory Committee (TAC) , a seven member citizen group appointed by the City Council to recommend transit policy, and to the Mayor's Committee on Employment of the Disabled. The plan was reviewed and certified by the local Metropolitan Planning Organization (MPO) , the South East Texas Regional Planning Commission. In addition, news releases were sent to the local television and radio stations to be aired as public service announcements. The public comment period will run from Wednesday, January 19, 1994, at the time of publication of the first public notice, through February 1, 1994, culminating at the public hearing. All written comments or recommendations received from the public prior to the public hearing, as well as any verbal comments or recommendations made at the public hearing, will be considered by City Council prior to final submission of the plan. A copy of the public notice published in the Beaumont Enterprise, as well as a copy of the news release sent to local television and radio stations are attached. A copy of any written comments or recommendations received prior to the public hearing, as well as a transcript of the public hearing will be submitted with the plan. William Munson General Manager NOTICE OF PUBLIC HEARING AND REQUEST FOR COMMENTS ON BEAUMONT MUNICIPAL TRANSIT SYSTEM'S 1994 ADA PARATRANSIT PLAN UPDATE The annual update to the Beaumont Municipal Transit (BMT) System's Special Transit Services (STS) Program, known as the 1994 ADA Paratransit Plan Update, is due to be submitted to the Federal Transit Administration (FTA) . A public hearing will be conducted on Tuesday, February 1, 1994, at 1:30 pm in the City Council Chambers of City Hall, 801 Main Street, in downtown Beaumont. The public hearing will afford the opportunity for the public, disabled individuals, social service agencies who serve the disabled community, and any other disabled transportation providers to make comments and recommendations. Copies of the plan are available at the BMT Office at 550 Milam Street and may be picked up between the hours of 8:00 am and 5:00 pm, Monday through Friday. Copies of the plan will be mailed to specific individuals upon request. Accessible formats will also be provided upon request. Munson, General Manager, BMT The Beaumont Municipal Transit System has prepared their annual Paratransit Plan Update for submission to the Federal Transit Administration as required by the Americans with Disabilities Act (ADA) . Written comments and recommendations on the plan will be accepted during the public comment period from Wednesday, January 19, through February 1, 1994. William JV Munson General Manager SECTION VI UNRESOLVED ISSUES In the Federal Transit Administration's letter dated August 26, 1993, which determined that BMT's 1993 ADA Paratransit Plan Update was in compliance, the following two comments were included: 1. The City of Beaumont should continue to monitor on-time performance, ride-time, and trip denials and report results in the 1994 update. Note that, in filling out the demand table, and for the purposes of determining whether capacity constraints still exist, trips scheduled more than one hour before or after the requested time should be considered a form of denied trip. 2. The City's revised paratransit budget (using $13 .00 per trip as the basis for operating expenses) should be reflected in a revised total system budget which should be included in the City's 1994 update submittal. In response to the first comment, the following data is reported: DATA REPORTED IS FOR CALENDAR YEAR 1993 ON-TIME PERFORMANCE (STANDARD IS 90%) 92% (percentage of passengers picked up within 30 minutes of scheduled time) RIDE-TIME (STANDARD IS 90%) 94% (percentage of passengers which stay on vehicle after pick-up for one hour or less) TRIP DENIALS (STANDARD IS 0) NUMBER OF TRIPS NOT ABLE TO SCHEDULE 476 NUMBER OF TRIPS SCHEDULED BUT NOT WITHIN ONE HOUR EITHER WAY OF INITIAL REQUEST 921 TOTAL TRIP DENIALS 1,397 In response to the second comment, a projected total system budget is located in Table 6 of the 1994 update. Note that FY 1993 paratransit data resulted in a $13 . 62 cost per trip. Therefore, projected paratransit costs through 1997 are based on a $14. 00 per trip cost. These are most probably low cost estimates because factors such as contractual labor wage increases, employee fringe benefit cost increases, increased cost of repair parts, tires, fuel, and other supplies are not considered. SECTION VII OTHER ISSUES In reviewing the Other Issues Checklist provided in the update packet, the following question was the only one which was answered "yes" and therefore required to be discussed in this section of the update: Is there a change to the target date for ADA paratransit compliance? The 1993 ADA Paratransit Plan Update set the target date for compliance as April 1994. This assumed that the FTA Section 9 Grant request for the capital project of purchasing three additional paratransit vehicles would be fully funded and approved by 10/1/93. However, the grant request was submitted one quarter cycle later than planned because of the City budget process. Therefore, the Section 9 Grant was not approved until January 1994. This has delayed the other actions of specification preparation, bidding, contract awarding, and delivery of new vehicles by several months. The new target date for ADA paratransit compliance in the 1994 ADA Paratransit Plan Update is now July 1994. This only pushes the target date back three months and total compliance is still expected to be accomplished in FY 1994 as earlier projected.
