WHEREAS, on April 14, 1992, the City Council passed a Resolution awarding
the contract for the construction of the Cartwright Drainage Project to Russ Miller
Construction Company, Inc. in the amount of $8,920,589.50; and,
WHEREAS, on June 16, 1992 Change Order No. 1 was executed in the
amount of $206,110.28 for the excavated dirt to be hauled to the City's Landfill; on
September 15, 1992 Change Order No. 2 was executed in the amount of $58,954.68
for the addition of approximately four-hundred-sixty-three feet (463') of paving on
Bolivar Street; on November 16, 1992 Change Order No. 3 was executed in the
amount of $4632.09 to change four Type B Inlets to Type A Inlets; on January 11,
1993 Change Order No. 4 was executed with no change in Contract price for the
sealing of joints in the box sewer and an increase of pavement thickness due to
defective materials; the total of these Change Orders has increased the Contract
amount to $9,186,286.54; and,
WHEREAS, Change Order No. 5 has been created to increase the Contract
amount by $11,506.88 to $9,197,793.42 to revise Change Order No. 4 and to replace
sidewalks and driveway pipes that are necessary because of field changes;

NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute Change Order
No. 5 with Russ Miller Construction Company, Inc. for a contract price increase in
the amount of$11,506.88 to revise Change Order No. 4 and to replace sidewalks and
driveway pipes that are necessary because of field changes.
