City of Beaumont Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager PREPARED: Tom Scofield, Chief of Police MEETING DATE: February 10, 2004 AGENDA MEMO DATE: February 2, 2004 REQUESTED ACTION: Consider an Amendment to Municipal Ordinance 99-45, Section 21-75 changing Grade I and Grade II positions. RECOMMENDATION Council consideration of an amendment to Municipal Ordinance 99-45, Section 21-75 changing Grade I Positions from 200 to 201 and Grade II positions from 48 to 47. BACKGROUND As of January 31, 2004, Grade II Sergeant John Kerr retured. In keeping with the reorganization within the Police Department that began with the October 1997 collective bargaining agreement,a reduction of the Grade II position is needed. By reducing this position and increasing the Grade I position, this will accurately reflect the current organization of the Police Department as well as allow the utilization of the police specialist positions. BUDGETARY IMPACT The current annual pay for a Grade II Sergeant is $54,480. The annual pay for one Grade I Patrolman is $35,256 which reflects a positive budget impact of$19,224. I am therefore requesting that the City Ordinance Section 21-75 be amended reducing the number of positions in the Grade II category by one from 48 to 47 and reallocating that position into the Grade I category increasing it from 200 to 201. This request is in keeping with the reorganization of the Police Department that began with the October 1997 contract and continues in the current collective bargaining agreement. Furthermore, it allows for the utilization of the police specialist positions. ENTITLED AN ORDINANCE AMENDING SECTION 21-75 OF THE CODE OF ORDINANCES TO AMEND THE GRADE I AND GRADE II POSITIONS IN THE BEAUMONT POLICE DEPARTMENT; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Section 1. THAT Chapter2l, Section 21-75 of the Code of Ordinances of the City of Beaumont be and the same is hereby amended to read as follows: Section 21-75. Grades and Classifications - Police Department The following grades and classifications are hereby established within the Police Department. BE IT ORDAINED BY THE CITY OF BEAUMONT: Grade Classification Positions I Officers 201 I I Sergeants 47 III Lieutenants 11 IV Captains 3 Deputy Chiefs 2 Total 264 Section 2. RECOMMENDATION Administration recommends approval of an ordinance amending Chapter 18, Section 18-7 of the Code of Ordinances allowing the discharge of firearms in an indoor firearm range. BACKGROUND The City has been contacted by an individual wishing to construct an indoor firearm range within the City limits. Currently, Section 18-7 states that is unlawful for any person, except a peace officer in the discharge ofhis official duties,to discharge any firearm within the City.The proposed amendment would permit the discharge of a firearm within an indoor firearm range by a person or entity with all the permits or licenses required to operate such a facility. In addition, structural, bullet trap, ventilation and noise requirements would have to be met prior to issuance of a Certificate of Occupancy. An indoor firearm range is permitted by right in NSC, GC-MD, CBD, C-M,LI,HI and PUD zoning districts and with a specific use permit in all other zoning districts. BUDGETARY IMPACT None. ENTITLED AN ORDINANCE AMENDING CHAPTER 18, SECTION 18-7 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ALLOW THE DISCHARGE OF FIREARMS IN AN INDOOR FIREARM RANGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; PROVIDING FOR A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Chapter18, Section 18-7, of the Code of Ordinances of the City of Beaumont be and it is hereby amended to read as follows: Section 18-7. Weapons — Discharging firearm. It shall be unlawful for any person, except a peace officer in the discharge of his official duties, to discharge any firearm within the City. It is an exception to this prohibition if the firearm is discharged within an indoor firearm range, operated by a person or entity with all permits or licenses required to operate such a facility, that meets the following requirements: J (1) The structure must be constructed in such a manner that a bullet of the maximum caliber allowed to be fired within the range may not escape from the structure. (2) The range must utilize bullet traps that prevent the bullet from escaping from the structure and, in addition, minimize the escape of lead particles into the air, both inside and outside the structure. S:WGENDXCITY CLERK\02-10-04.wpd (3) The ventilation of the structure must meet all regulations applicable to such use, including, but not limited to, the regulation of the Environmental Protection Agency and the Texas Commission on Environmental Quality. (4) The structure must be constructed such that noise from the structure during use will not cause a disturbance to those across the real property boundary of the facility. (5) The Building Official is charged with enforcement of this section and may not issue a certificate of occupancy for the structure and other properties associated with the use of the structure until it meets the requirements of this section and all other applicable codes of the City of Beaumont. (6) Any interpretation of this section by the Building Official may be appealed to the Building Board of Adjustment in accordance with the ordinances applicable to such appeal. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager PREPARED BY: Ingrid Holmes, Public Health Director MEETING DATE: February 10, 2004 AGENDA MEMO DATE: February 2, 2004 REQUESTED ACTION: Consider adoption of a resolution authorizing abatement by city forces of an imminent public health hazard located at 2356 Pope. Abatement to include demolition of the structure. RECOMMENDATIONS: The administration recommends that Council approve the resolution presented. BACKGROUND: On January 13, 2004, Animal Control was dispatched by the Beaumont Police Department to a house located at 2356 Pope. Upon arriving at the scene, it was discovered that the owner was deceased and had been inside the house in that condition for several days.In addition,her three dogs were trapped inside the structure. One of the dogs was removed by the animal control officer, however,the other two could not be captured. On January 14, 2004, Environmental Health, Animal Control and Clean Community personnel inspected the inside of the house. Based upon the findings of this inspection, the structure was declared to be an imminent public health hazard. At that time, one additional dog was captured by the animal control officer and the house was tagged by the demolition supervisor as a "dangerous structure." As required, written notice was sent by the Health Department to the estate of the deceased property owner,ordering immediate abatement ofthe health hazard.Notice was also issued by the Clean Community Department stating that the house was declared to be a dangerous structure. Both notices were returned as"unclaimed."Violations noted during the 1-14-04 inspection included strong,obnoxious and objectionable odors,human waste on the floor and furniture in the front room, animal waste accumulated on the floors,walls,and furniture throughout the house,garbage trash and debris scattered throughout the house,and large openings in the floors,walls and ceilings making the structure open and accessible to rodents. Box 3827 • Beaumont,Texas 77704-3827 Since 2002, the Health Department has received numerous complaints from neighbors about the conditions inside this house. Both written and verbal notices have been issued to the property owner ordering abatement ofthe violations. On 9-25-02,a letter declaring the property to be a public health nuisance and imminent health hazard was hand delivered to the owner.Because the owner was unable or unwilling to comply, the property was cleaned by city contractors on 11-22-02. In 2003, the Health Department once again began receiving complaints about foul odors emanating from inside the house.During that time period,the owner attempted to abate the problem by placing baking soda on the feces. However, conditions inside the house continued to worsen. BUDGETARY IMPACT: Estimated cost of demolition of the structure is $1200.00. The Clean Community Department has funds for this demolition in the C.D.B.G. fund. PREVIOUS ACTION: Property was previously cleaned by city contractors; work was completed on 11-22-02. SUBSEQUENT ACTION:Clean Community Department will demolish or cause to be demolished said structure. Animal Control & Clean Community personnel during an inspection on January 14, 2004, I am hereby declaring the structure located at 2356 Pope Street (Lt. 7, Bll:4; Cousins ? Addition) to be a public nuisance and health hazard as evidenced by situations/problems stipulated in this letter. The above named premise is in violation of the City of Beaumont Codes & Ordinances as follows: Violation(s): (1) Chapter 13. Health and Sanitation. Article I. Sec. 13-1. Nuisances generally: "Whatever is dangerous to human health or welfare, or whatever renders the around, the water, the air or food, a hazard or an injury to human health, is hereby declared to be a nuisance." These referenced ordinances are violated based upon the following findings at the above named premise: animal feces throughout the premises accompanied by very strong. obnoxious, and objectionable odors. openings in the floors and windows allowing for the entrance of rodents and an accumulation of Qarba-e. trash and debris throughout the structure. Under Chapter 13. Health and Sanitation.Article I, Sec. 13-32.you are hereby-directed to abate these violations within five (5) days of receipt of this notice. Failure to comply with this order may result in a hearing before City Council to obtain an order to allow abatement by city forces. Electric meter was pulled by the Fire Department. Hand notice given to Ms. Rich to clean up dog feces. Pictures taken of inside the house: conditions are horrible. Extension cords ever.where, floors covered Nvith dog, feces. urine, and mrbage. There is a hole in the bathroom floor. 07%22/02 Rebecca spoke to neighbor. Mary and her family_ have cleaned up the living room and have started on the kitchen. The dogs are now living in the back yard. Ms. Rich is still living with Man Nlosbv and family. 08A2;02 Rebecca spoke to Mary Mosby. Ms. Rich still living with her. Ms. Mosby wanted some references for new,used furniture and appliances as they are disposing of almost everything in Nis. Rich's house. Ms. Mosby was Oiven some places to call such as Some Other Place, Adult Protection Services, Nutrition for Seniors, and Samaritan Counseling Center of Southeast Texas. There was a strong foul odor emanating from Ms. Rich's properm as we were standing on the porch next door. Nis. She was at her neighbors house. Informed her we needed to check the inside of her house. She attempted to secure the dogs and was out of breath. She informed us that the living room was clean and she was almost Finished with the middle room. We told her that we would be back on Wednesday 9/4102 at 9:OOam. She needed to have the dogs secured. Mrs. Rich asked us not to bring the Police Department. We told her that would not be necessary if she would allow us inside the house. She a-reed. Also asked Ms. Rich to apply more lime to the feces in the yard. Odor from dog feces was very strong inside and outside premises. 09 04 OZ Sandy, Matt,/Animal Control. and myself inspected the premises at 9:OOam. Nis. Rich had the dogs secured. See pictures. Odor was horrible. Dog feces completely covering every floor except the living room which was recently cleaned by the neighbor. 09/06.02 Sandy and I hand delivered nuisance letter to Ms. Rich. She signed the letter. There was a seven day abatement period. 09,13 02 Sandy and I reinspected. Small amount of feces had been removed. Odor is still horrible. Will reinspect on 9,,17,/02. 09;'1_ 02 Sandy and Rebecca reinspected. Small amount feces had been removed. Still no improvement to the odor. 09;25 02 Letter declaring the propem to be a public health nuisance and imminent health hazard was hand delivered to Ms. Rich. She willingly signed the letter and understands that after five days if the violation has not been corrected that the city would take bids to have the premises abated. A hand notice was also given requesting that the odor in the front yard be eliminated within one day. 09;26 02 Majority of the yard has been covered with lime which has eliminated most of the odor on the outside. The doss are still living, in the house with her. She was hesitant to allow me to look inside her house. When she agreed. I observed piles of fresh dog feces and urine soaked floors. I also observed an accumulation of trash in the middle bedroom. I explained to NIs. Rich that I would send her a letter and allow 5 days for compliance. I tried to encourage her to consider moving into a retirement home-(to no avail) 03,'12,'03 Reinspected, odor is still deplorable but dog, feces was cleaned from living room, dining room, and hallway. BACKGROUND On December 19, 2000, City Council awarded a contract to ALLCO, Inc., for the construction of Concord Road Pavement Improvement Project Phase III(including Travis Street) in the amount of$5,538,569.25. Change Order No. 1 increased the contract amount to $5,560,689.42. Due to a decrease in construction quantities, Change Order No. 2 in the amount of$107,978.69 is required to adjust the estimated quantities, to reflect the quantities actually used during the performance of the project, decreasing the contract amount to $5,452,710.73. The MBE participation in the performance of the contract totals $464,400.25 representing 8.5% of the final contract amount. A copy of Schedule C identifying the MBE participation is attached. The project has been inspected by the Engineering Division and found to be complete in accordance with the provisions and terms set out in the contract. RECOMMENDATION Administration recommends the award of a three (3) year contract to Perfect Cut Lawn Care for grounds maintenance services at seventeen (17) parks and various street triangles for a estimated annual expenditure of$53,930.52. BACKGROUND Seven (7) companies submitted bids on Thursday, January 15, 2004, for performing grounds maintenance services at seventeen(17)city parks and various street triangles. Grounds maintenance services include mowing, edging, litter removal and sweeping once per week between March 1 and November 30, and biweekly from December 1 to February 28. The parks included in this contract are as follow: Caldwood, Combest,Forest, Guseman,Halbouty, Magnolia, Wuthering Heights, Central, Chaison, Fletcher, Gilbert, Ida Reed, McLean, Pipkin, Roberts, Sprott, and Weiss Parks. Triangles include College and I Vh) 800 Eight St., Joachimi at Blanchette,Royal at Avenue F,Royal at Avenue G,Harriot at Kenneth,Burt at Carroll, 1500 Pipkin Avenue, Sarah at Bob, 1600 Avenue C, 2800 Arthur, 800 Ascot, Jay at Hooks,Jay at Kohler, 1200 Oakcrest, 700 Rankin, 4000 E. Lynwood, 2400 W. Lynnwood, and 100 W. Circuit. Prices were requested per cutting per park as shown on the attached bid tabulation. Based on the mowing schedule there will be approximately 48 cuttings per year. The street triangles require bi- weekly mowing during the growing season and one mowing per month during the non-growing season. The Parks Manager may reduce or increase the number of cuttings as needed with payments made per cutting cycle. The Parks and Property Services Division is responsible for managing the contract and inspecting the work. The second lowest bidder, Perfect Cut Lawn Care, provided a work plan and has met with the City Parks Manager to discuss expected work performance and contract terms and conditions . Perfect Cut Lawn Care currently maintains grounds at Fair Park,Tyrrell Park,Elmo Willard Library and the Theodore Johns Library. Currently,there are eight(8)vacant positions in the Parks and Property Services Division created by retirement and employee separation. A time and motion study conducted last year determined that four(4)positions could be eliminated as a result of outsourcing the maintenance of these parks. By eliminating these positions, personnel costs will be reduced by approximately$80,000. Since these positions are vacant, no employee will lose their job or be subject to a layoff. Personnel costs represent the bulk ofthe savings to the Parks and Property Services Division's budget but other savings will be realized from the reduction in equipment and vehicle maintenance,fuel, and new vehicle and equipment replacement. Employees currently performing grounds maintenance services at these parks will be assigned to other park maintenance crews, resulting in a higher level of maintenance previously not performed on a scheduled basis. Additional services such as tree trimming and removal, beautification and frequent litter removal will be some of the duties assigned to the reorganized crews. Parks and Property Services will continue to maintain the following four(4)parks: Leffler Park, Klein Park, Collier's Ferry Park and the Athletic Complex. To date,the Community Development Advisory Committee(CDAC)has held one meeting to discuss and review the process for submitting 2004 Action Plan Budget recommendations to the City Council. Subsequent public hearings/workshops will follow. Also, because of HUD's allocation formula, the City of Beaumont will not receive Emergency Shelter Grant Funds in 2004. t BUDGETARY IMPACT The proposed 2004 budget is comprised of federal allocations of$2,126,000 in Community Development Block Grant funds and$837,000 in HOME funds.The loss of$82,000 in Emergency Shelter Grant funds will have a negative impact on the annual budget and the funds that we provide to organizations that assist low to moderate income persons.
