HomeMy WebLinkAboutRES 91-031 6 R E S O L U T I O N WHEREAS, Thurman and Patsy Bobo, owners, has requested the City of Beaumont to allow them to encroach onto the 20 foot utility easement at the rear of Lot 4, Block 35, Dowlen West Unit XVII (6970 Shanahan Drive) for a swimming pool encroaching 4 feet by 36 feet and the concrete apron encroaching 6 feet by 36 feet and 23 .2 feet by 10 feet into said easement as depicted on Exhibit "A", attached; and, WHEREAS City staff has expended considerable time and effort in investigating the effect of such encroachment upon the City and utilities serving the same; and, WHEREAS, it appears that it would be equitable to allow such encroachment at this time; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager is hereby authorized to execute a License to Encroach for Thurman and Patsy Bobo, owners, into the 20 foot utility easement at the rear of Lot 4, Block 35, Dowlen West Unit XVII for a swimming pool encroaching 4 feet by 36 feet and the concrete apron encroaching 6 feet by 36 feet and 23 .2 feet by 10 feet into said easement as shown on Exhibit "A" attached hereto, for a one-time fee of Five Hundred Dollars ($500. 00) .
