WHEREAS, the City of Beaumont has recommended and
approved the sale of the property described in Exhibits "A" and
"B" attached hereto to the Port of Beaumont Navigation District
for a total price of Four Thousand Three Hundred Seventy-Five
Dollars ( $4,375.00 ) ;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute
a Deed Without Warranty to the Port of Beaumont Navigation
District transferring the interest that the City of Beaumont may
have in the properties described above for the amount listed.

THAT, the City of Beaumont, P. 0. Box 3827, Beaumont, Texas 77704, a
municipal corporation domiciled in Jefferson County, Texas hereinafter
called GRANTOR, for and in consideration of the sum of FOUR THOUSAND
TWO HUNDRED SEVENTY-FIVE Dollars ($4,275.00) and other good and valuable
consideration paid by the GRANTEE herein named, the receipt and
sufficiency of which is hereby acknowledged and confessed, have
GRANTED, SOLD and CONVEYED, and by these presents does hereby GRANT,
SELL, and CONVEY unto THE PORT OF BEAUMONT NAVIGATION DISTRICT OF
JEFFERSON COUNTY, TEXAS , a governmental agency, whose address is
P.O. Drawer 2297, Beaumont, Texas 77704, Jefferson County, Texas,
subject to the reservations hereinafter made, all of that certain real
estate (the "Property") lying and being situated in Jefferson County,
Texas, and being more particularly described as follows:
Being a 5,699 square foot parcel of land, more or less, known as City
Tax Tract 19-A, Plat "M" as per the Jefferson County Appraisal
District, being situated in the David Brown League, Abstract No.5,
Jefferson County, Texas, said tract being a part of the land conveyed
to the City of Beaumont by Willie Pullin and wife, Lena Pullin dated
November 27, 1979 and being recorded in Volume 2195, Page 185 of the
Deed Records of the aforementioned county and state, and being more
particularly described by metes and bounds as follows:
BEGINNING at the intersection of the existing North right-of-way line
of Buford Street with the East right-of-way line of Greer Street, also
being the Southwest corner of the herein described parcel;
THENCE North 89 degrees 29 minutes East, for a distance of 60.0 feet,
along the existing North right-of-way line of Buford Street to a point
for the Southeast corner of the herein described tract;
THENCE North 00 degrees 00' 00" West, for a distance of 95.0 feet along
the East line of the herein described parcel to a point for the
Northeast corner of the herein described tract;
THENCE South 89 degrees 29' West, 60.0 feet along the North line of the
herein described tract to a point for the Northwest corner, same being
the East right-of-way line of Greer Street;
THENCE South 00 degrees 53' East along and with the East line of Greer
Street for a distance of 94.99 feet to the PLACE OF BEGINNING, and
containing 5,699 square feet, more or less.
This conveyance is expressly made subject to all covenants,
restrictions and easements of record affecting said property, if any.
GRANTOR, for the consideration and subject to the reservations from
and exceptions to conveyance, conveys to GRANTEE the property without
express or implied warranty, and all warranties that might arise by
common law and the warranties in Section 5.023 of the Texas Property
Code (or its successor) are excluded.

part of a .88 acre tract of land conveyed to the City of Beaumont
by Deed from Mollie E. Langham, dated July 10, 1924 and being recorded
in Volume 242, Page 520 of the Deed Records of the County Clerk of
Jefferson County, Texas, and being more particularly described by metes
and bounds as follows:
BEGINNING at the Southwest corner of the herein described tract; same
being on the East right-of-way line of Sabine Pass and also being the
Northwest corner of a .839 acre tract of land as conveyed to the Port
of Beaumont Navigation District of Jefferson County, Texas by the City
of Beaumont, dated March 4, 1978 as described in Volume 2068, Page 415
of the Deed Records of the aforementioned county and state;
THENCE North 00 degrees 01' 30" East along and with the East right-of-
way line of Sabine Pass for a distance of 58.27 feet to a point;
THENCE North 40 degrees 50' 57" West continuing along the East right-of-
way line of Sabine Pass for a distance of 100.29 feet to a point for
the Northwest corner of the herein described tract;
THENCE South 89 degrees 50' 28" East along an existing fence line for a
distance of 135.95 feet to a point for the Northeast corner of the
herein described tract;
THENCE South 1 degrees 30' 51" West along an existing fence line for a
distance of 133.45 feet to a point for the Southeast corner of the
herein described tract;
THENCE South 89 degrees 41' 30" West along and with the North line of
the above-mentioned .839 acre tract, also being the South line of the
herein described tract, for a distance of 66.85 feet to the PLACE OF

SAVE AND EXCEPT
TRACT A
A 30 foot wide easement for storm sewer purposes out of the
above-described tract. Being more particularly described as follows:
Said strip of land being Thirty (30) feet in width and being Fifteen
(15) feet on each side of the following described centerline:
For locative purposes commencing at the Southeast corner of the above-
described 11,674 square foot tract;
THENCE North 1 degrees 30' 51" East along and with the East line of
said tract for a distance of 53. 74 feet to the PLACE OF BEGINNING of the
herein described easement;
THENCE North 42 degrees 18' 56" West for a distance of 108.04 feet to
THE POINT OF TERMINATION in the North line of said tract, said point
being a distance of 74.84 feet west of the Northeast corner of said
tract.
TRACT B
A 40 foot wide easement for storm sewer purposes out of the above-
described tract. Being more particularly described as follows:
Said strip of land being Forty (40) feet in width and being Twenty (20)
feet on each side of the following described centerline:
For locative purposes commencing at the Southwest corner of the above-
mentioned 11,674 square foot tract;

THENCE North 00 degrees 01' 30" East along and with the East right-of-
way line of Sabine Pass for a distance of 58.27 feet to a point;
THENCE North 40 degrees 50' 57" West continuing along the East
right-of-way line of Sabine Pass for a distance of 38.26 feet to the
PLACE OF BEGINNING of the herein described easement;
THENCE North 23 degrees 42' 20" East for a distance of 51.07 feet to
the POINT OF TERMINATION , said point being on the North line of the
aforementioned 11,674 square foot tract, at a point 74.84 feet West of
the Northeast corner of said tract.
The reservation of the easement herein shall be used for the purpose of
constructing, reconstructing, and maintaining storm sewer lines(all
upon the condition that at all times, after performing any work in
connection with said easement, the City of Beaumont or its agents
will restore said premises to the original condition in which it was
found before such work was undertaken), and the following rights are
also hereby reserved. It is expressly understood and agreed that the
City shall have the right of ingress to and egress from the tract of
land hereinbefore described and use the same for the purposes
aforesaid, and giving said City the right and privilege to improve,
maintain and operate the same as permitted by law.
TO HAVE AND TO HOLD the above-described easement and right-of-way unto
the said CITY OF BEAUMONT, Jefferson County, Texas.
THIS conveyance is expressly made subject to all covenants, restrictions
and easements of record affecting said property , if any.
GRANTOR, for the consideration and subject to the reservations from and
exceptions to conveyance, conveys to GRANTEE the property without
express or implied warranty, and all warranties that might arise by
common law and the warranties in Section 5.023 of the Texas Property
Code (or its successor) are excluded.
